RESOLUTION GIVING NOTICE OF PROPOSED ANNEXATION
TO CITY OF LODI OF UNINHABITED TERRITORY DESCRIBED
HEREIN AND DESIGNATED "E. E. WISNER ADDITION NO. 1, "
AND GIVING NOTICE OF TIME AND PLACE FOR HEARING
PROTESTS THERETO
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LODI:
1. That, pursuant to the provisions of the Annexation of Uninhabited
Territory Act of 1939, a petition signed by owners of not less than one-fourth
of the land in the hereinafter described territory. by area and by assessed
value as shown on the last equalized assessment roll of the County of San
Joaquin, was filed with the Councii of the City of Lcdi on December ZO, 1972,
requesting annexation of the hereinafter described territory to said City.
2. That the territory which the petitioners request be annexed to the
City of Lodi and which said City and its Council propose to annex is situate in
the County of San Joaquin, State of California. hereby designated " E. E. Wisner
Addition No. 1, " and described as follows:
A portion of the Northeast C,uarter of Section 10, Township 3
North Range 6 East, Mount Diablo Base and Meridian, San Joaquin
County, California.
Beginning at the Northwest Corner of "WISNER TRACT"
as filed for record January 7, 1947 in Volume 11, at page 131,
Bcok of Maps and Plats, San Joaquin County Records, said point
being also in the South lint cf "WESTDALE ADDITION" as
annexed to the City of Lcdi by Ordinance No. 7 19 and being an
existing City Limits lin th?:- e South 89' 1Z' 30" East. along
the South line of said "WESTDALE ADDITION," 591. 10 feet to
the Ncrtheast corner of Lo: 1 of "TALLEY TRACT" as filed for
record August 19, i?53 i . Vclum= 13, at page 162, Book of Maps

and Plats. San Joaquin County Records. said point being also in
the West line of PEACH STREET; thence South, along the West
line of PEACH STREET, 255. 50 feet; thence South 89' 12' 30"
East, 150.00 feet to a point 'a the South line of Lot 4 of said "TALLEY
TRACT, " said point being South 89' 12' 30" East, 100' from the
Southwest corner of said Lot 4: thence South, 130.00 feet to a point
in the North line of "SUN WEST ADDITION" as annexed to the City
of Lodi by Resolution Nc. 3612 and being an existing City Limits
line: thence North 89' 12' 30" West. along said North line, 204. 00
feet; thence North. 165, 00 feet co a point in the South line of Lot 3
of said "TALLEY TRACT"; thence North 89" 12' 30" West, along
said South line, 102.00 feet to the Southwest corner of said Lot 3,
said point being also in the East line of said "WISNER TRACT";
thence North, alcng said East line, 90. 50 feet to the Southeast
corner of Lot 2 of said "WISNER TRACT"; thence North 89' 12' 30"
West, along the South lines of Lot 2 and Lot 9 of said "WISNER
TRACT, " 331. 10 feet, to a point in the South line of said Lot 9,
said point lying Sosth 89' 12' 30" East. 104.00 feet, from the
Southwest corner of said Lot 9; thence North through Lot 9. 80.00 feet
to a point in the South line of Lot 10 of said "TALLEY TRACT"; thence
North 89' 12' 30" West, 105. 00 feet to the Southwest corner of said
Lot 10, said point being also in the East line of "HIXSON ADDITION"
as annexed to the City of Lodi by Resolution No. 363I and being an
existing City Limits line; thence North along said East line, 50, 00
feet to the point of beginning.
3. That the Local Agency Farmation Commission of San Joaquin
County, California, did in session duly assembled on Friday, October 20,
1972, consider and approve the proposed annexation of said "E. E. Wisner
Addition No. 1, " as abave described, and as submitted to said Commission by
the proponents of said annexation.

4. That Wednesday, February 7, 1973, at the hour of S:00 p. rn,
in the Council Chambers in the City Hall in the City of Lodi, County of San
Joaquin, California, is hereby fixed as the time and the place when and where
any person owning real property within the uninhabited territory above des-
cribed and proposed to be annexed to the City of Lodi. and having any objections
to the proposed annexation, mag appear before the Council of the City of Lodi
and show cause why such uninhabited territory should not be so annexed to the
City of Lodi. The protest must be in writing, may be filed at any time before
the hour set for hearing objections to the proposed annexation, and shall state
the name or names of the owner or owners of property affected and the des-
cription and area of such property, in general terms.
5. The City Clerk of the City of Lodi is hereby authorized and
directed to cause a copy of this resolution to bepublisbed at least twice, but
not oftener than once a week, in the "Lodi News Sentinel, " a newspaper of
general circulation published in said City of Lodi. the city to which it is
proposed to annex the aforesaid territory, and also in the "Stockton Record,"
a newspaper of general circulation published outside the City of Lodi, but in
the County of San Joaquin, California, the county in which is located the
territory proposed to be annexed to the City of Lodi, said publication to be
complete at least twenty days prior to the date set for hearing.
6. The said City Clerk is further authorized and directed to cause
written notice of such proposed annexation to be mailed to each person to
whom land within the territory proposed to be annexed was assessed in the
last equaiized county assessment roll available on the date the above said
proceedings were initiated, at the address shown on said assessment roil
or known to said Clerk, and to any person who has filed his name and address
and the designation of the lande in which he has an interest, either legal or
equitable, with said Clerk, such notice to be given not less than twenty days
before the first public hearing on the proposed annexation.

7. In the event there is. upon the land proposed to be annexed to
said City, a structural improvement owned, being acquired or leased by a
county fire protection district, the City Clerk is directed to cause written
notice of such proposed annexation to be mailed to the governing body of such
district, such notice to be sent not less than ten days before the first public
hearing upon such proposed annexation.
8. The City Clerk is directed to cause written notice to be given to
such other persons as may be legally entitled thereto, in the manner required
by law.
