HomeMy WebLinkAboutResolutions - No. 3701RESOLUTION NO. 3701 ESTABLISHING NEW ACCESS RIGHTS TO A PARCEL OF LAND LOCATED AT 1011 SOUTH CHEROKEE LADE WHEREAS, the City of Lodi is the successor and interest to the strip of land in and to the access rights along and abutting Cherokee Lone within the City Limits of the City of Lodi; and WHEREAS, Peters Pontiac -Cadillac -GMC, Inc. presently has three driveway permits and now proposes to close one 20 -foot driveway and relocate the same to a more southerly position of the property line and continue to use the other 20 -foot and 30 -foot driveways to the real property at 1011 South Cherokee Lane having a frontage of 250 feet; and WHEREAS, said request appears reasonable to the City Council of the City of Lodi. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lodi as follows: 1 . The existing 20 -foot driveway granted to Peters Pontiac -Cadillac -GMC, Inc. situate approximately 80 feet north of the south property line is hereby abandoned and curb and gutter shall be installed thereon. 2. A 20 -foot driveway located 16 feet north of the south property line is hereby established. 3. This resolution is adopted on the express condition that Peters Pontiac - Cadillac -GMC, Inc. shall be fully responsible for the cost of installing street improvements to comply with the Cherokee Lane Beautification Plan as prepared by Paul Tritenbach, Landscape Architect, dated November 8, 1966. Said beautification plans require the installation of an automatic sprinkler system, planting and maintenance of turf, and the planting and future care of four 15 -gallon Zelkova serrata trees. 4. The cost of all of the improvements herein required, including curb, gutter, sidewalk, street paving, and the installation of the aforesaid landscaping, shall be at the cost and expense of Peters Pontiac -Cadillac -GMC, Inc.
