HomeMy WebLinkAboutResolutions - No. 3700RESOLUTION NO. 3700 ESTABLISHING NEW ACCESS RIGHTS TO A PARCEL OF LAND LOCATED AT 1210 SOUTH CHEROKEE LANE WHEREAS, the City of Lodi is the successor and interest to the strip of land in and to the access rights along and abutting Cherokee Lane within the City Limits of the City of Lodi; and WHEREAS, Sanborn Chevrolet, Inc. is desirous of abandoning an existing access and establishing two new driveways to the real property owned by them at 1210 South Cherokee Lane having a frontage of 397 feet; and WHEREAS, said request appears reasonable to the City Council of the City of Lodi. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lodi as follows: 1. The existing 40 -foot access at 1210 South Cherokee Lane is hereby abandoned. 2. A 20 -foot driveway located 124 feet north of the south property line and one 30 -foot driveway located 21 feet south of the north property line are hereby established. 3. This resolution is adopted on the express condition that Sanborn Chevrolet, Inc. shall be fully responsible for the cost of installing street improvements to comply with the Cherokee Lane Beautification Plan 85 prepared by Paul Tritenbach, Landscape Architect, dated November $ 1966. Said beauti- fication plans required the installation of an automatic sprinkler system, the planting and maintenance of turf, and the planting and future care of six 15 -gallon Zelkova serrata trees. 4. The cost of all of the improvements herein required, including curb, gutter, sidewalk, street paving, and the installation of the aforesaid landscaping, shall be at the cost and expense of Sanborn Chevrolet, Inc.
