HomeMy WebLinkAboutResolutions - No. 3695RESOLUTION NO. 3695 RESOLUTION GIVING NOTICE OF PROPOSED ANNEXATION TO CITY OF LODI OF UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED "MOORE ADDITION, " AND 01VI,�G NOTICE OF TIME AND PLACE FOR HEARING PROTESTS THERETO BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LODI: 1. That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, a petition signed by owners of not less than one-fourth of the land in the hereinafter described territory, by area and by assessed value as shown on the last equalized assessment roll of the County of San Joaquin, was filed with the Council of the City of Lodi on October 25, 1972, requesting annexation of the hereinafter described territory to said City. 2. That the territory which the petitioners request be annexed to the City of Lodi and which said City and its Council propose to annex is situate in the County of San Joaquin, State of California, hereby designated "Moore Addition. 11 and described as follows: A portion of the Northeast Quarter of Section 10, Township 3 North, Range 6 East, Mount Diablo Base and Meridian, being more particularly described as follows: Beginning at a point on the East line of said Section, which point is also the southeast corner of the parcel of land annexed to the City of Lodi as the "TALLEY ADDITION" as described in City of Lodi Resolution No. 2794; thence North 89' lZ' 30" Wast along the South line of said "TALLEY ADDITION, " being also an existing City limit line, 355.45 feet to the southwest corner of said "TALLEY ADDITION"; thence North, along the West line of said "TALLEY ADDITION, '° 190.5 feet to the Northwest corner of said "TALLEY ADDITION," said point being also in the South line of the parcel of land annexed to the City of Lodi as the "WESTDALE ADDITION" as described in City of Lodi Ordinance No. 719; thence North 89' 12' 30" West, along the South line of said "WESTDALE ADDITION, 11 being also an existing City limit line, 194. 00 feet to the northeast corner of Lot 1, "TALLEY TRACT, " as shown on map filed for record August 19, 1953, in Volume 13, page 162, Book of Maps and Plats. San Joaquin County Records, said point being also in the West line of PEACH STREET; thence South, along the West line of said PEACH STREET, 285. 50 feet to intersection with the south line of Lot 4 of said "TALLEY TRACT, 11 produced westerly; thence South 89' 12' 30" East along said westerly production and south line, 150 feet to the northwest corner of the parcel of land conveyed to Claude A. Lewis, et ux, recorded in Volume 2284, page 426, Book of Official Records of San Joaquin County; thence South along the west line of said Lewis parcel, 130.00 feet to the North line of 40 -foot wide COCHRAN ROAD, said point being also in the North line of the parcel of land annexed to the City of Lodi as the "SLN WEST ADDITION" as described in City of Lodi Resolution No. 3612; thence South 89' 12' 30" East, along the North line of said "SUN WEST ADDITION, " being also an existing City limit line, 399. 45 feet to a point in the East line of Section 10, said point being also the Northeast corner of said "SUN WEST ADDITION. " thence North along said East line of Section 10, being also an e�istinb City limit line, 225. 00 feet to the point of beginning; the area thus described containing 3.24 acres, more or less. -Z- 3. That the Local Agency Formation Commission of San Joaquin County, California, did in session duly assembled on Monday, September 11, 1972, consider and approve the proposed annexation of said "Moore Addition, " as above described, and as submitted to said Commission by the proponents of said annexation. 4. That Wednesday, December 20, 1972, at the hour of 8:00 p, m. in the Council Chambers in the City Hall in the City of Lodi, County of San Joaquin, California, is hereby fixed as the time and the place when and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Lodi, and having any objections to the proposed annexation, may appear before the Council of the City of Lodi and show cause why such uninhabited territory should not be so annexed to the City of Lodi, The protest must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected and the description and area of such property, in general terms. 5. The City Clerk of the City of Lodi is hereby authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in the "Lodi News Sentinel," a newspaper of general circulation published in said City of Lodi, the city to which it is proposed to annex the aforesaid territory, and also in the "Stockton Record, rr a newspaper of general circulation published outside the City of Lodi, but in the County of San Joaquin, California, the county in which is located the territory proposed to be annexed to the City of Lodi, said publication to be complete at least twenty days prior to the date set for hearing. 6. The said City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to 3- whom land within the territory proposed to be annexed was assessed in the last equalized county assessment roll available on the dare the above said proceedings were initiated, at the a d d r e s s shown on said assessment roll or known to said Clerk, and to any person who has filed his name and address and the designation of the lands in which he has an interest, either legal or equitable, with said Clerk, such notice to be given not less than twenty days before the first public hearing on the proposed annexation. 7. In the event there is. upon the land proposed to be annexed to said City, a structural improvement owned, being acquired or leased by a county fire protection district, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such district, such notice to be sent not less than ten days before the first public hearing upon such proposed annexation. 8. The City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law, Dated: November 1, 1972 I hereby certify that Resolution No. 3695 was passed and adopted by the City Council of the City of Lodi in regular meeting held November 1, 1972, by the following vote: Ayes: Councilman - Hughes, Katnich.
