A RESOLUTION AUTHORIZING ISSUANCE OF RIGHT OF
WAY CERTIFICATE FOR TRAFFIC SIGNAL INSTALLATION
AT INTERSECTION OF LODI AVENUE AND STOCKTON STREET.
WHEREAS, the City of Lodi City Council at their regular meeting
of June 21, 1972 approved the TOPICS high priority project request for
the installation of traffic signals at the intersection of Lodi Avenue and
Stockton Street; and,
WHEREAS, it is necessary that a Right of Way Certificate be issued
to comply with the State of California and Federal Government requirements
for TOPICS projects;
NOW THEREFORE, BE IT RESOLVED THAT the City Council
of the City of Lodi does hereby authorize the issuance of the attached
Certificate; and,
BE IT FURTHER RESOLVED that the City of Lodi agrees to hold
the State of California harmless from any liability that may result in the
event the right of way is not clear as certified and if the State is named
in a damage suit, as a result of the right of way not being clear as certified,
the City of Lodi agrees that at the request of the State, it will assume full
responsibility for the conduct of the defense or provide such assistance
as the State may require and will pay any judgements issued against the
State and all costs in connection with the defense.
