HomeMy WebLinkAboutResolutions - No. 3577RESOLUTION NO. 3577 WHEREAS, by Deed dated October 19, 1960 and recorded February 14, 1961 in Book 2383, Page 485, Official Records of San Joaquin County, HAROLD L. MERRILL and ISABELLA F. MERRLLL, his wife, granted to the CITY OF LODI, a municipal corporation, that certain real property situated in the City of Lodi, County of San Joaquin, State of California, and more, particularly described as follows: A portion of the Northeast Quarter of Section 11, Township 3 North. Range 6 East, Mount Diablo Base and Meridian and further described as follows: Beginning at the Southwest corner of Lot Z3, Turnage Subdivision, as filed for record on September 14, 1946 in Vol. 11, Page 119, Book of Maps and Plats, San Joaquin County Records; thence East 100.0 feet along the South line of said Lot 23 to the Southeast corner of said Lot 23: thence North 0' 35 1/2' West 50. 0 feet along the East line of said Lot 23 to a point; thence West 80. 21 feet along a line 50.0 feet North of and parallel to the South line of said Lot 23 to a point; thence 31. 21 feet along a curve concave to the North, said curve having a central angle of 89" 24 1/21, a long chord of 28. 14 feet, and a radius of 20. 0 feet, to a point on the West line of Lot 22 of said Turnage Subdivision; thence South 0' 35 1/2T East 69. 79 feet along the West lines of Lots 22 and 23, Turnage Subdivision, to the point of beginning. WHEREAS, the aforesaid Deed covered a parcel of land that the City of Lodi required the grantors to donate to said City so that said strip of land could be used for a street if the future development of adjoining property required a street; and WHEREAS, the City of Lodi does not now require said strip of land for a street; and WHEREAS, said strip of land is not now nor has it ever been improved, paved or used by the public: and WHEREAS, the Planning Commission bas held a public hearing and has determined that said parcel of real property will not be required for development into a public street; and WHEREAS, the original donors, HAROLD L. MERRILL and ISABELLA F. MERRILL, his wife, have requested the City to convey back the title to said strip of land; NOW. THEREFORE, BE IT RESOLVED by the City Council of the City of Lodi that the Mayor and the City Clerk be and are hereby authorized to 36-77 execute the attached deed of conveyance to HAROLD L. MERRILL and ISABELLA F. MERRILL, his wife; RESOLVED FURTHER that as no consideration was originally paid for said deed, no consideration will be required for the execution of the deed on behalf of the City of Lodi.
