PENNINO March 8, 1999 CITY OF LODI CITY HALL, 221 WEST PINE STREET P.O. BOX 3006 LODI, CALIFORNIA 95 241-1 91 0 (209) 333-6711 FAX (209) 333-6842 Anil Yadav 39675 Cedar Boulevard, Suite 160 Newark, CA 94560 Dear Mr. Yadav: City Manager ALICE M. REIMCHE City Clerk RANDALL A. HAYS City Attorney Approximately two weeks ago we met to discuss various issues of concern regarding your Jack-in-the-Box restaurant in Lodi. At that meeting you promised to prepare a letter to me outlining the activities you planned to undertake to rectify the complaints we have received from neighboring property owners. As of this date, I have not received anything from you. Mr. Yadav, it appears to me from your inability to keep your promise that you do not take my position seriously. I can assure you that I intend to personally see this issue through to an acceptable conclusion. Acceptable by my definition insures that the adjacent residents are not kept awake by your patrons. Since our meeting, those residents have found it necessary to call the Lodi Police Department several times due to noise during the early morning hours. Once again, I will reiterate that this will not be tolerated. You have until March 17, 1999 at 4:00 pan. to respond to my request. Failure to do so will result in my scheduling the Use Permit that exists for this property for public hearing before the Lodi Planning Commission. At that time, I will be prepared to recommend additional conditions be placed on the permit which will include a limitation on the hours of operation for your restaurant.
