AGENDA TITLE: Public Hearing to Consider Electric Residential and Commercial Rate Changes

RECOMMENDED ACTION: That the City Council by ordinance approves the attached Electric Rate
Schedules to be effective October 1, 2000:
1. Electric Rate Schedule EE, Residential All Electric Service
2. Electric Rate Schedule ED, Residential SHARE Program Service
3. Electric Rate Schedule EF, Residential All Electric SHARE Program Service
4. Electric Rate Schedule EM, Mobile Home Park Service
5. Electric Rate Schedule G1, General Service — Group 1 Commercial/Industrial
6. Electric Rate Schedule G2, General Service — Group 2 Commercial/industrial

BACKGROUND INFORMATION: The proposed rate schedule changes are in response to customer
requests, legislative issues and Electric Utility Department concerns
about competitiveness.
The City of Lodi has not had an "All Electric Service" Rate, because in the past the regular residential rate
schedule was competitive with other utilities' "all electric" rates; this is no longer the case. This will be a
self -certifying program.
The City of Lodi started a Low -Income Discount program for electric service on November 1, 1991. The
current Low -Income program has a ten -percent discount for those customers who qualify for SSI/SSP.
The proposed changes are:
a) Change the name of the program from Low -Income Discount to SHARE (Single Household Alternative
Rate for Energy);
b) Increase the discount from ten to twenty percent; and
c) Expand the qualification for the program from just SSI/SSP to a maximum income level per household.
This will be a self -certifying program.
In addition, the current mobile home park master -metered customers receive a Distribution Service
Payment of $8.13 per number of spaces wired for service. The changes to the mobile home park master -
metered rate changes the payment to a discount on the bill, incorporates the All Electric Service and
SHARE programs as described above, and institutes a minimum charge for this rate. The changes from

payment to discount also require deletion of language from Rule 19, Page No. 19-3 and to the Appendix
Page No. A-1.
Lastly, an Economic Development and Benefits program was instituted for small (G1), medium (G2)
commercial customers and for certain qualifying non-profit commercial customers on December 1, 1996.
This program provided various discounts for new business in the City of Lodi. These discounts for new
customers were in effect through June 30, 2000. This proposal would extend the Economic Development
program through September 30, 2002, and apply to new business that establish electric service with the
City of Lodi on and after July 1, 2000. The discount would be effective the first practicable billing after the
customers eligibility has been approved. There is no retroactive application for the discount. The prior
discount expired on June 30, 2000. There is no proposed change to the Community Benefits Incentive
Discount.
The fiscal impact on increased revenues to the City of Lodi is estimated to be:

Funding for the SHARE program will be part of the Residential Public Benefits Program. A decrease in
electric revenues resulting from customers exercising the All Electric or Economic Development option
was anticipated and reflected in forecasted budget revenues.

AN ORDINANCE OF THE LODI CITY COUNCIL AMENDING
CHAPTER 13.20 ELECTRICAL SERVICE BY AMENDING
SECTIONS 13.20.200, 13.20.210, 13.20.240 AND 13.20.250, AND
ADDING SECTION 13.20.202 RESIDENTIAL ALL ELECTRIC
BE IT ORDAINED BY THE LODI CITY COUNCIL AS FOLLOW:
SECTION 1. Lodi Municipal Code Chapter 13.20 - Electrical Service, Article III. Rates, is hereby
amended by amending Sections 13.20.200, 13.20.210, 13.20.240 and 13.20.250 and adding
Sections 13.20.202 by attaching new Exhibits EE, ED, EF, EM, G1, G2, made a part hereof as if
set out in full.
SECTION 2. The Sale of electric energy by the City of Lodi shall be at the rates hereinafter set
forth.
SECTION 3. Electric rates, established by contract prior to adoption of this Ordinance which
reference any previously published electric rate schedule(s) shall be governed by the applicable
published electric rate schedule(s) in effect at the time of such contract execution.
SECTION 4. Schedule EE — Residential All Electric Service - See schedule attached hereto,
marked Exhibit A and thereby made a part hereof.
SECTION 5. Schedule ED - Residential SHARE Program Service - See schedule attached
hereto, marked Exhibit B and thereby made a part hereof.
SECTION 6. Schedule EF — Residential All Electric SHARE Program Service - See schedule
attached hereto, marked Exhibit C and thereby made a part hereof.
SECTION 7. Schedule EM - Mobile Home Park Service - See schedule attached hereto, marked
Exhibit D and thereby made a part hereof.
SECTION 8. Schedule G1 - General Service - Group 1 Commercial/Industrial - See schedule
attached hereto, marked Exhibit E and thereby made a part hereof.
SECTION 9. Schedule G2 - General Service - Group 2 Commercial/Industrial - See schedule
attached hereto, marked Exhibit F and thereby made a part hereof.
Section 10. - No Mandatary Duty of Care. This ordinance is not intended to and shall not be
construed or given effect in a manner which imposes upon the City, or any officer or employee
thereof, a mandatory duty of care towards persons or property within the City or outside of the City
so as to provide a basis of civil liability for damages, except as otherwise imposed by law.
Section 11. - Severability. If any provision of this ordinance or the application thereof to any person
or circumstances is held invalid, such invalidity shall not affect other provisions or applications of
the ordinance which can be given effect without the invalid provision or application. To this end,
the provisions of this ordinance are severable. The City Council hereby declares that it would have
adopted this ordinance irrespective of the invalidity of any particular portion thereof.
SECTION 12. All ordinances and parts of ordinances in conflict herewith are repealed insofar as
such conflict may exist.
SECTION 13. The increased rates shall be effective on applicable electric utility billings prepared
by the City of Lodi on or after May 1, 1998.

Residential All Electric service and the City of Lodi may verify the Customer's eligibility at any

SPECIAL CONDITIONS:
(a) This rate is available only for mobile home park master metering in service prior to March 3
1989.
(b) It is the responsibility of the master -metered customer to notify the City Finance Department
within 15 days following any change in the number of occupied mobile home park units wired for
service.
(c) Miscellaneous electric loads such as general lighting, laundry rooms, general maintenance, and
other similar use incidental to the operation of the premises as a multi -family accommodation will
be considered domestic use.
(d) An additional first block medical quantity is available as described in Schedule MR, Residential
Medical Rider.
(e) To qualify for Single Household Alternative Rate for Energy (SHARE) the sub -metered tenants of
the master -metered City of Lodi Customer will submit an application, including the tenant's unit
number, to the City of Lodi Finance Department. The City of Lodi Finance Department will notify
the master -metered Customer of the tenant's certification.
(f) Self -Certification will be used to determine income eligibility for the SHARE program. Sub -
metered tenants of the master metered City of Lodi Customer must sign a statement upon

application indicating that the City of Lodi may verify the sub -metered tenant's eligibility at any
time. The master -metered Customer, not the City of Lodi, is responsible for extending the
SHARE program to tenants certified to receive them. If verification establishes that the SHARE
tenant is ineligible, the tenant will be removed from the master -metered Customer's qualified
tenants and the City of Lodi may render corrective billings.
(g) The master -metered Customer shall not bill any sub -metered tenant more than that tenant would
be billed if that tenant were an individual customer of the City of Lodi. For a qualifying SHARE
tenant, the master -metered Customer should bill the qualifying tenant at the applicable rates
equivalent to Schedule ED, Residential SHARE Program Service or Schedule EF, Residential All
Electric SHARE Program Discount Service. A non -qualifying tenant should be billed at the
applicable rates equivalent to Schedule EA, Residential Service or Schedule EE, Residential All
Electric Service.

GENERAL SERVICE - GROUP 1 COMMERCIAL/INDUSTRIAL
APPLICABILITY
This schedule is applicable to single-phase or three-phase service, or to a combination thereof,
whose energy consumption does not exceed 8,000 kilowatt-hours (kWh) per billing cycle for three
consecutive billing cycles. This schedule is not available for service when another
commercial/industrial schedule is applicable.
Assignment to Schedule: If, in the judgement of the City, an account is expected to have usage
below 8,000 kWh per billing cycle, the City has the option of placing the account immediately on
this schedule.
When an account billed on this schedule permanently changes the nature of electrical operations
to such an extent that the account would in time qualify for another rate schedule, such billing
change will be made as soon as practicable after customer notification and verification of said
changes.
If energy consumption equals or exceeds 8,000 kWh for three consecutive billing cycles, the City
will transfer the account to the appropriate rate schedule. If the demand reaches or exceeds 400
kW for three consecutive billing cycles, the account will be transferred to the appropriate rate
schedule.

following discount on Energy charges:

GENERAL SERVICE - GROUP 2 COMMERCIAL/INDUSTRIAL
APPLICABILITY:
This schedule will be applied to accounts with energy consumption in excess of 8,000 kilowatt
hours (kWh) per billing cycle for three consecutive billing cycles. This schedule is not available for
service when another commercial/industrial schedule is applicable.
Billing Demand: The billing demand in any billing cycles will be the maximum average power taken
during any metering interval in the period, but not less than the diversified resistance welder load.
(The customary metering interval is 15 minutes; in cases where the use of energy is intermittent or
subject to violent fluctuations, a 5 -minute interval may be used.)
Assignment to Schedule: If, in the judgement of the City, an account is expected to have usage
above 8,000 kWh per billing cycle, the City has the option of placing the account immediately on
this schedule.
When an account billed on this schedule permanently changes the nature of electrical operations to
such an extent that the account would in time qualify for another rate schedule, such billing change
will be made as soon as practicable after customer notification and verification of said changes

GENERAL SERVICE - GROUP 2 COMMERCIAL/INDUSTRIAL
PURCHASED POWER ADJUSTMENT (PPCA):
A purchased power cost adjustment may be included in each bill for service. The adjustment shall
be the product of the total kilowatt-hours (kWh) for which the bill is rendered times the adjustment
amount per kWh. The adjustment amount per kWh will reflect amounts charged the City by various
suppliers of bulk power not covered in the above rates.
VOLTAGE DISCOUNT:
When delivery is made at the same primary distribution voltage as that of the line from which the
service is supplied, a 4% discount will be allowed on the sum of the Demand Charge and the
Energy Charge.
COMMERCIAL DEVELOPMENT INCENTIVE DISCOUNT:
G2-Commercial//Industrial customers establishing accounts in the City of Lodi on or after July 1,
2000 are eligible for the following discount on Energy and Demand Charges:
October 1, 2000 - September 30, 2002 .......................................... 5%

A RESOLUTION OF THE LODI CITY COUNCIL ADOPTING
CERTAIN AMENDMENTS TO THE ELECTRIC UTILITY
DEPARTMENT'S RULES AND REGULATIONS
WHEREAS, on March 1, 1989, the City Council adopted Ordinance No. 1447
§13.20.010 of the Lodi Municipal Code, authorizing and allowing adoption by resolution
Rules and Regulations for the Electric Utility Department; and
WHEREAS, on May 18, 1994 the City Council adopted Resolution No. 94-58
adopting by reference, certain Rules and Regulations; and
WHEREAS, amendments to the Electric Utility Department Rules and Regulations
are necessary from time to time.
NOW, THEREFORE, BE IT RESOLVED that the Amendments to the Electric
Utility Department's Rules and Regulations are hereby approved as shown on Exhibit A
attached hereto.

6. a. Mobile home parks for which submetering was permitted prior to
March 31, 1989, and for which electric service is included in the
facilities furnished to their tenants, may employ metering equipment
as a means of retroactively adjusting rental charges for energy
consumption, provided that the portion of such charges allocable to
electricity may not exceed the rates the City would charge if it served
the tenants directly.
b. Expansion of submetering systems in service as of March 31, 1989
will only be permitted in the case of minor rearrangement of pads
within an existing mobile home park. Development of land even
though contiguous to an existing mobile home park shall not qualify
for expansion of an existing submetering system. The City will serve
each such pad directly at the park operator'slowner's expense.
Master Meters and Submetering Systems
Master meters and submetering systems are not permitted except for those in
service as of March 31, 1989 and by exception °05' above.
Testing of Submeters
As a condition of service for submetering, where electric energy is furnished in
accordance with "D6" above, customers using submeters as a basis for charges
for electricity shall submit to the City certification by a meter testing laboratory,
satisfactory to the City, as to the accuracy of the submeters upon request of the
City. As a further condition of service for submetering, the customer shall agree
that he/she will be governed by the City's Rule No 18, Meter Tests and
Adjustment of Bills for Meter Error. As a further condition of service for
submetering, the customer shall agree that the City may inspect and examine
custbmer's billing procedures from time to time to determine that such service is
made in accordance with this rule.
