HomeMy WebLinkAboutAgenda Report - December 16, 1998 (74)AGENDA TITLE: Addendum to the Improvement Agreement for Millsbridge, Tract No. 2788 MEETING DATE: December 16, 1998 PREPARED BY: Public Works Director RECOMMENDED ACTION: That the City Council take the following action with regard to the Millsbridge subdivision: 1. Approve the Addendum to the Improvement Agreement for the Public Improvements of Millsbridge, Tract No. 2788, and direct the City Manager and City Clerk to execute the Improvement Agreement on behalf of the City. 2. Appropriate funds for required reimbursements. BACKGROUND INFORMATION: The final map and Improvement Agreement for the development was approved by Council on November 18, 1998. The subdivision is located south of the Woodbridge Irrigation District (WID) Canal, east of the Sunwest XIV development and north of Tienda Drive as shown on Exhibit A. The project includes improvements related to the finished roadway for the Mills Avenue canal crossing and the modification of the existing traffic signal at the Mills Avenue/Kettleman Lane intersection, and striping in Kettleman Lane. Under the terms of the above-mentioned Agreement, the developer is eligible for reimbursement for the traffic signal modification and striping work in conformance with LMC §16.40 Reimbursements for Construction and reimbursement for the canal crossing pavement work in conformance with the terms of the Improvement Agreement for the Public Improvements of Millsbridge Subdivision, Phase 1, executed January 12, 1998. The developer has submitted the necessary plans and specifications, construction contract prices, and Caltrans encroachment permits, where required, and has executed an addendum to the Agreement to provide for the reimbursements. Staff recommends that Council approve the addendum to the Agreement and appropriate $113,494.84 for the necessary reimbursements. The developer will be reimbursed when the work has been completed and accepted by the City. As a matter of information, the developer is also eligible for reimbursement for costs associated with the retaining walls needed for the Mills Avenue bridge crossing of the WID Canal in accordance with the January 12 Agreement. This work required the acquisition of backfill material. The developer borrowed soil from their adjacent residential and commercial development to expedite the construction of the bridge. The City "reimbursed" the developer for the borrowed soil by allowing an equivalent amount of soil to be taken from G -Basin for the Millsbridge residential and commercial developments and for the residential development at Thayer Ranch. As a result of this trade-off, the City avoided hauling costs and a significant amount of the grading costs. APPROVED: H.
