NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lodi does hereby implement the fee schedules as attached hereto and made a part of this Resolution. SECTION 2. All resolutions or parts of resolutions in conflict herewith are repealed insofar as such conflict may exist, SECTION 3. This resolution shall be published one time in the "Lodi News -Sentinel," a daily newspaper of general circulation printed and published in the City of Lodi, and shall be in force and take effect October 15, 2003, or as soon thereafter as administratively possible. Dated: October 1, 2003 I hereby certify that Resolution No. 2003-185 was passed and adopted by the City Council of the City of Lodi in a regular meeting held October 1, 2003, by the following vote: AYES: COUNCIL MEMBERS — Beckman, Hansen, Howard, Land, and Mayor Hitchcock NOES: COUNCIL MEMBERS — None ABSENT: COUNCIL MEMBERS — None ABSTAIN: COUNCIL MEMBERS — None SUSAN J. BLACKSTON City Clerk 2003-185 Lodi i Police Department Proposed Fee Structure Adjustments Prepared by: Captain David J. Main The current fee structure of the Lodi Police Department has remained static for a number of years. Periodic review and analysis of fees is necessary in order to ensure fees are consistent with allied agencies performing similar services with similar overhead costs. Additionally, cost recovery fees should be consistent with the cost of providing the service. With continuing budgetary constraints, rising personnel costs and reduced revenues staff is recommending adjustments in a number of fees. FEES Current Proposed Vehicle Impound Release Fee $75.00 $100.00 Justification: This fee charged for persons who have been arrested for various violations such as DLII, or driving unlicensed or with suspended or revoked license. Salaries and benefits have steadily increased over the past four years as well as other related costs associated with providing this service. As an example, certified mailing is required when a vehicle is ordered towed and stored by police officers, certified mailing costs alone has increased from $1.00 to $4.42. The proposed increase is intended to recover costs for providing this service. Vehicle Repossession Fees $15.00 Justification: Cannot adjust due to statutory requirements. N/C Fingerprinting $15.00 $25.00 Justification: Live scan takes additional staff time to complete data entry and then ensuring fingerprints are properly sent to appropriate agencies. Increased personnel costs also justify an adjustment. Bicycle Licenses $3.00 $5.00 Justification: This fee has not been adjusted in the past twelve years. While the increase makes an attempt to recover actual costs, a significant increase in this fee could prove more costly. The Lodi Police Department is committed to encouraging citizens to properly license their bicycle. Lodi Police personnel each year deal with hundreds of bicycles. Most bikes either have no license or identifying marks making it very difficult to locate the owner. While a slight adjustment is recommended staff continues to recommend the fee be situated at a level affordable as to not discourage people against licensing. Mechanical Citation Sign Offs $10.00 No Change VIN Verifications $35.00 $45.00 Justification: Increased personnel costs associated with responding to off site location in order to conduct VIN verifications. NEW, FEES DUI Cost Recovery This fee would allow the City of Lodi to attempt to recover costs associated with persons arrested for Driving Under the Influence or alcohol and or drugs in those circumstances resulting in a traffic collision. DUI Arrest DUI Non Injury Collision DUI Injury Collision DIJI Fatal Collision $200.00 $300.00 $400.00 $1,000.00 Justification: DUI arrests in association with a traffic collision prove very costly to the City of Lodi, Often times DUI related collisions require a number of sworn officers, support staff and volunteers extended periods of time to adequately investigate. Cases involving a fatality have proven to be extremely costly mainly due to the emergency response required and that the investigation is conducted by the department's Major Accident Investigation team (MAIT). The likelihood of collection for this fee remains fairly low. Most cities surveyed report having difficulty collecting this fee. The most successful cities have a collection rate of approximately fifty percent which most others are between ten and twenty percent. There is considerable staff time involved reviewing each report and then sending the violator a bill. Most of the bills require follow up and some form of collection. Most cities utilize the finance department for collection. Parking Citation Fee Adjustments Most Lodi Municipal Code parking violations have not been adjusted in the past few years. Many of them have not been adjusted in over ten years. We are recommending a flat rate increase of $5.00 for nearly an municipal code parking violations with some exceptions. Attached is a list of the most common violations cited with the current and proposed fines. Licensing Animal Services Related Fees Current Fronosed Unaltered $10.00 $20,00 Justification: Shelter impounds approximately three times the amount of unaltered animal versus altered. Increase fee is to discourage irresponsible and or unintentional breeding and to recover costs associated for impounding and handling these types of animals. Altered $5.00 $6.00 Justification: Rising personnel costs and related costs to provide the service. Repla cem t $.50 $3.00 Justification: Significant to help recover costs but not so great as to discourage l icensing. Late Fee 20% per month $20.00 Justification: Encourage pet owners to renew their license on time and to recover costs associated with providing this service. Impound Animal ln $12.00 $30.00 Impound Animal 2" $24.00 $60.00 Impound Animal 3rd $36.00 $120.00 Impound Additional $36.00 $240.00 Justification: Added personnel costs and other related costs to provide this service. Staff time having to impound animals on a continual basis is a drain on scarce resources. Boarding Dogs $4.00 per day $8.00 per day Boarding Cats $3,00 per day $6.00 per day Boarding Quarantine $3.00 per day $10.00 Justification: To adequately recover costs associated with the cleaning and special handling for these types of animals. Adoption $12.00 $15.00 Justification: Recover costs associated with providing service and not so great as to dissuade adoption Vaccinations $5.00 $8.00 Justification: To better reflect the actual costs associated with providing this service. Spay/Neuter Deposit Dogs $40.00 Spay/Neuter Deposit Cats $30.00 Justification: Per requirements outlined in the Food and Agriculture Code $50.00 $40.00 SCHEDULE OF PENALTIES For council resolution per10.5E4040 LMC SECTION OFFENSE DESCRIPTION 10.44.010 B Overtime arkin 30 in - 90 inin 10.44.010 13 Permit Zone on City streets 10.4.4.020 A No Parking sign, or Red Curb 10.44.020 13 Parking on side -walk or,parkway 10.44.020 C Parking in alley except loading/unloading 10.44.020 I) Special Event no parking when previously signed 24 -hours 10.44.020 G Blockingachair ramp where signed or red curb. -10.44.030 Parking exceeds 72 consecutive hours 10.44.040 A Vehicle "For Sale" except at the residence of owner 10.44.040 B Person of firm displaying three or more vehicles for sale on public roadway/right-of-ways I AMOUNT $20.00, $25.00* 125.00* $25.00* $25.00 * 10.44.040 C For Sale within 200 feet ofsignalized intersection 10,44.040 D For Sale on private property within 30 -feet of public street 10.44.040 F Use of public street for washing/polishing vehicles if charge is made for suchservice 10.44.050 Parking in a position that obstructs traffic 10.44.070 No parking of vehicle 6 -feet in height, including load, within 100 -feet of any signed and designated intersection 10.44.100 A Angle Parking - out of markings 10.44.100 B Angle 'parking - wheel nearest curb within 6 inches of curb 10.44.110 B Out of designated space - straddling spaces 10.44.13013 Permit required zone in City lot 10.44.150 13 "Loading Zone" 20 minutes max for freight, 3 minutes for passengers 10.44.150 C "Passenger Loading Zone" 3 minutes max, freight prohibited 10.48.010 A Residential Patnit required 10.52.050 A Commercial vehicle, 10,000 GVW, in residential district 10.52.05013 Commercial vehicle outside of specific signed area 10.52.060 A Semi -trailer unattended without tractor on any public street, alley, etc 10.52.080 A Commercial vehicle auxiliary engine within 250 of residential district between 10 p.m. and 7.a.m, 15.40.100 C 17.57.190 17.60.160 A Private property FireLane properly signed Specific commercial vehicles greater than 3,000 GVW shall not park on private property in residential zones unless out of public view.
