HomeMy WebLinkAboutResolutions - No. 2003-50RESOLUTION NO. 2003-50 A RESOLUTION OF THE LODI CITY COUNCIL REJECTING THE APPARENT LOW BID FOR CONDUIT FITTINGS AND AWARDING THE BID IN THAT CATEGORY TO SECOND LOW BIDDER; AND FURTHER AWARDING THE BID FOR POWER UTILITY CONDUIT TO THE LOW BIDDER IN THAT CATEGORY WHEREAS, in answer to notice duly published in accordance with law and the order of this City Council, sealed bids were received and publicly opened on March 19, 2003, at 11:00 a.m. for power utility duct and fittings, described in the specifications, therefore approved by the City Council on March 5, 2003; and WHEREAS, since prices for conduit and for fittings move somewhat independently of each other, bid specifications separated conduit and fittings into separate categories, and bid instructions indicated that award would be made to the low bidder in each category. WHEREAS, said bids have been compared, checked, and tabulated and a report thereof filed with the City Manager as follows: Intraline,lnc., Burlingame Graybar Electric, Roseville AZCO, Stockton Herning Underground Supply, Sacramento G E Supply Company, North Highlands Wesco Distribution, San Francisco *All -Phase Electric Supply, Stockton 'All -Phase Electric's bid contained an exception considered non-responsive. Fittings Conduit $5,769.50 $33,303.18 $ 5,770.55 $37,022.39 $ 7,622.21 $26.784.80 $ 7,407.22 $29,162.95 $ 7,606.29 $29,352.29 $ 8,166.16 $29,956.85 $ 5,486.85" $35,231.90* to price protection, and is therefore WHEREAS, the bid submitted by All -Phase Electric Supply Company, the apparent low bidder for the conduit fittings, contained an exception to specifications in that quoted prices were valid for only 19 days. Bid specifications required that prices be firm for thirty days. The 19 -day "firm" period requested by All -Phase may have given them an unfair pricing advantage over other bidders who complied with the 30 -day "firm" requirement. Staff therefore recommends the bid from All -Phase Electric Supply be considered non-responsive and be rejected; and WHEREAS, staff therefore recommends rejecting the bid from All -Phase Electric Supply Company, of Stockton, California, as being non-responsive, and awarding the bid for conduit fittings to the next lowest bidder, Intraline Inc., of Burlingame, California; and WHEREAS, staff further recommends awarding the bid for utility conduit to the low bidder in that category, AZCO, of Stockton, California. NOW, THEREFORE, BE IT RESOLVED by the Lodi City Council that the bid for conduit fittings from All -Phase Electric Supply Company, of Stockton, California, is hereby rejected, and the bid is hereby awarded to the next lowest bidder, Intraline Inc., of Burlingame, California, in the amount of $5,769.50; and BE IT FURTHER RESOLVED that the Lodi City Council hereby awards the bid for utility conduit to the low bidder in that category, AZCO, of Stockton, California, in the amount of $26,784.80.
