HomeMy WebLinkAboutResolutions - No. 79-1857 RESOLUTION NO. 79-135 BEFORE THE CITY COUNCIL OF THE CITY OF LODI, CALIFORNIA INDUSTRIAL WAY AND BECKMAN ROAD ASSESSMENT DISTRICT NO. I A RESOLUTION OF INTENTION TO ORDER CHANGES AND MODIFICATIONS RESOLVED, by the City Council of the City of Lodi, California, that WHEREAS, this City Council did, on the 15r -h day of November, 1978, adopt its Resolution No. 78-165, A Resolution of Intention to Acquire and/or Construct Improvements, declaring its intention to order the acquisition and/or construction of certain improvements, as more fully described therein, and on the plans, profiles and drawings therein referred to, and did provide for the costs and expenses of said work to be assessed against the district described in said Resolution of Intention; and WHEREAS, the public interest, convenience and necessity require that certain changes and modifications be made in the proposed work to be done under said Resolution of Intention and in the boundaries of said district; NOW, THEREFORE, IT IS HEREBY RESOLVED as follows: 1. That the public interest, convenience and necessity require and it is the intention of the City Council of the -City of Lodi, California, to order the following changes and modificiatr4pns in the improvements to be acquired and/or constructed, as described in Resolution of Intention No. 78-165, by adding to Paragraph 5(a) of said Resolution, the following subparagraphs to include the following portions of streets to be improved: -I- "(5) The southerly half of Industrial Way from its intersection with Beckman Road easterly approximately 408.13 f eet; "(6) The easterly side of Beckman Road from its inter- section with Industrial Way southerly approximately 370.60 feet. " The estimated increase in assessment for the costs and expenses of the aforesaid proposed changes or modifications is the sum of $98,000.00. 2. That the boundaries of said district should be extended to include the parcels of real property fronting on the west line of Beckman Road from the center line of Industrial Way southerly approxi- mately 370.60 feet, and the aforesaid increase in assessment for the costs and incidental expenses of said additional improvements are made chargeable upon said additional properties in accordance with the benefits thereto, said additional properties being delineated upon a map thereof, entitled, "Amended Proposed Boundaries of Industrial Way and Beckman Road Assessment District No. 1", on file with the City Clerk of the City of Lodi, to which reference is hereby made for further particulars. 3. NOTICE IS HEREBY GIVEN that on the 16th day of January. 1980, at the hour of 8: 00 o'clock P.M., in the regular meeting place of said Council, Council Chambers, City Hall, Lodi, California, any and all persons having any objections to the proposed changes and modifications herein proposed may appear and show cause why said changes and modificacions should not be done and carried out in accordance with this Resolution. 4. That the City Clerk is hereby directed to publish this Resolution in the Lodi Sentinel, a newspaper printed, published and of general circulation in the City of Lodi, said publication to -2- be made not less than ten (10) days prior to the date of hearing hereinabove set forth, and to mail, or cause to be mailed, notices of the adoption of this Resolution, postage prepaid, at least twenty (20) days prior to said date of hearing objections, to all persons owning the additional real property to be assessed for said changes and modifications, whose names and addresses appear on the last equalized assessment roll for City taxes prior thereto or as known to said City Clerk, together with a statement of the amount as shown by the revised Engineer's Report to be assessed against the particular parcel covered by the notice, and that any person interested may file a protest thereto. 5. That the City t4anager, Telephone (209) 334-5634, is the local department or agency designed by this Council to answer inquiries regarding the protest proceedings or objections to the proposed changes and modifications hereinabove set forth.
