HomeMy WebLinkAboutResolutions - No. 79-35 ERRESOLUTION NO. 79-35 RESOLUTION CALLING FOR A SPECIAL ELECTION WHEREAS, a petition has been received by the City Council of the City of Lodi requesting that the following Ordinance be submitted immediately to a vote of the people at a Special Election: "Section 27-9(b)2(i). 'Building Site Area Requirements' is hereby amended to read in full as follows: (i) For the various residential types of buildings per- mitted the provisions shall be as follows: a. For one family dwellings: a minimum of five thousand square feet and fifty feet in width for each main building and its accessory buildings. b. For two family dwellings: A minimum of eight thousand square feet and eighty feet in width for each main building and its accessory buildings. c. For multiple family and group dwellings: a minimum of four thousand square feet for the first dwelling unit and four thousand square feet for each additional attached dwell- ing unit, with a minimum lot width of one hundred feet. d. However, in areas that are adjacent to the Central Business District and surrounded by areas classified in the R -HD District, the provisions for dwellings shall be the same as the R -HD District as provided in subsection (b) 1 and Z of Section 27-8A. Section 27-9 (c)1 Subsection (c)1, 'Minimum Yards' is hereby amended to read as follows: 1. For dwellings the provisions shall be the same as the R- 1 Zone. " -1- WHEREAS, said petition has been certified by the City Clerk of the City of Lodi as containing sufficient signatures of qualified registered voters of the City of Lodi to require action by the City Council pursuant to State of California Election Code 4010. WHEREAS, in accordance with provisions of Section 4010 of the Elections Code of the State of California, the City Council shall either: a) Introduce the ordinance without alteration at the regular meeting at which it is presented and adopt the ordinance within 10 days after it is presented; or b) Immediately order a special election to be held not less than 74 nor more than 89 days after the date of the order at which the ordinance, without alterations, shall be submitted to a vote of the voters of the City. BE IT RESOLVED, that the City Council of the City of Lodi does hereby call a Special Election to be held not less than 74 nor more than 89 days from this date to vote on the question: "Shall Section 27-9 (b) 2 (i) 'Building Site Area Requirements' be amended to read in full as follows: (i) For the various residential types of buildings permitted the provisions shall be as follows: a. For one family dwellings: a minimum of five thousand square feet and fifty feet in width for each main building and its accessory buildings. b. For two family dwellings: A minimum of eight thousand square feet and eighty feet in width for each main building and its accessory buildings. c. For multiple family and group dwellings: a minimum of four thousand square feet for the first dwelling unit and four thousand square feet for each additional attached dwelling unit, with a minimum lot width of one hundred feet. -2- d.
