HomeMy WebLinkAboutResolutions - No. 79-85RESOLUTION NO. 79-85 CALLING A PUBLIC HEARING TO DETERMINE WHETHER PUBLIC NECESSITY, HEALTH, SAFETY, OR WELFARE REQUIRES THE FORMATION OF AN UNDERGROUND UTILITY DISTRICT 5,, INCLUDING THE AREA BOUNDED BY ELM STREET ON THE SOUTH, LOCUST STREET ON THE NORTH, CHURCH STREET ON THE WEST, AND SACRAMENTO STREET ON THE EAST. as follows: BE IT RESOLVED by the City Council of the City of Lodi WHEREAS, Ordinance No. 937 established a procedure for the creation of underground utility districts and requires as the initial step in such procedure the holding of a public hearing to ascertain whether public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service in any such district; and WHEREAS, it has been recommended that such an under- ground utility district, hereinafter called Underground Utility District 5," be formed to encompass the area in the City of Lodi described as follows: Beginning at the point of intersection of the West Line of Church Street and the North Line of Elm Street, the point known as the Southeast corner of Lot 5, Block 2, -I- City of Lodi; thence Northerly along the West right-of-way line of Church Street to the Southwest corner of Church Street and Locust Street; thence Easterly along the South right-of-way line of Locust Street to the Southeast corner of Locust Street and Sacramento Street; thence Southerly along the East right-of-way line of Sacramento Street to the Southeast corner of Sacramento Street and Elm Street; thence Northwesterly to the Northwest corner of Elm Street and Sacramento Street; thence Westerly along the North right-of-way line of Elm Street to the point of beginning. NOW, THEREFORE, BE IT RESOLVED as follows: 1. NOTICE IS HEREBY GIVEN that a public hearing will be held by the City Council of the City of Lodi on Tuesday, July 3, 1979 at the hour of 8:00 p. m. in the Council Chambers of the City Hall, 221 West Pine Street, Lodi, California to ascertain whether the public necessity, health, safety, or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication or similar associated service in the District hereinabove described. -2- 2. At such hearing all persons interested shall be given an opportunity to be heard. Said hearing may be continued from time to time as may be determined by the City Council. 3. The City Clerk shall notify all affected property owners as shown on the last equalized assessment roll and utilities concerned of the time and place of such hearing by mailing a copy of this resolution to such property owners and utilities concerned at least ten (10) days prior to the date thereof. 4. The area proposed to be included in the District is shown upon that certain map entitled "City of Lodi Underground Utility District 5", dated June 15, 1979 which is on file in the office of the City Clerk of the City of Lodi.
