BEFORE THE CITY COUNCIL OF THE CITY OF LODI, COUNTY
OF SAN JOAQUIN, STATE OF CALIFORNIA
RESOLUTION AUTHORIZING ISSUANCE OF A PERMIT TO
CONSTRUCT, RECONSTRUCT, MAINTAIN AND OPERATE
A RAILROAD INDUSTRIAL TRACK
WHEREAS, by application dated July 3, 1979, GENERAL MILLS, INC.,
a corporation, has requested that the City Council of the City of Lodi permit
the construction, reconstruction, maintenance and operation of a railroad
industrial track in and across Turner Road in the City of Lodi; and,
WHEREAS, the applicant has submitted with said application a map
designating the location of the proposed railroad industrial track which indicates
that said railroad track would cross in a direct line 60 feet in length lying
between and at right angles to the northerly and southerly boundaries of Turner
Road, approximately 955 feet west of the northeast corner of Section 3, Township
3 North, Range 6 East, Mount Diablo Base and Meridian; and
WHEREAS, this City Council has been fully advised in the premises
and has determined that said track is required for the purpose of serving
GENERAL MILLS, INC., and for other industrial purposes; and;
WHEREAS, this City Council has been further advised that said
industrial track will be used for the transportation of freight only and will
not be used as a main line of the Southern Pacific Company;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council
of the City of Lodi, that GENERAL MILLS, INC., a corporation, be and it
hereby is authorized to construct, reconstruct, maintain and operate a railroad
industrial track in and across Turner Road in the City of Lodi, County of San
Joaquin, State of California in a direct line 60 feet in length lying between
and at right angles to the northerly and southerly boundaries of Turner Road,
approximately 955 feet west of the northeast corner of Section 3, Township 3
North, Range 6 East, Mount Diablo Base and Meridian.
BE IT FURTHER RESOLVED that this permit shall be subject to the
following restrictions and conditions:
(1) Said track will be laid level with the street and will be
operated and maintained in full compliance with all rules
and regulations of the Public Utilities Commission of the
State of California.

(Z) GENERAL MILLS, INC., a corporation, shall pay the
entire cost of any and all crossing protection devices that
may be required by the Public Utilities Commission of the
State of California, and GENERAL MILLS, INC., will hold
the City of Lodi free and harmless from the costs of instal-
lation and maintenance of any such protection devices.

regular meeting held July 3, 1979 by the following vote:

TO THE HONORABLE CITY COUNCIL OF THE CITY OF LODI, COUNTY Or SAN JOAQUIN, STATE OF
CALIFORNIA.
General Mills herewith makes application to this Honorable Council for a permit to
construct, reconstruct, maintain and operate a railroad industrial track in and
across Turner Road in the City of Lodi, County of San Joaquin, State of California,
the location of the center line of said railroad industrial track being particularly
described as follows: A direct line 60 feet in length lying between and at right
angles to the northerly and southerly boundaries of Turner Road, approximately
955 feet west of the northeast corner of Section 3, T.3 N. R.6 E. MDM.
Your applicant has attached hereto and made a part hereof a map marked upon which is
shown in red line the location of the center line of the proposed railroad industrial
track.
Your applicant represents said track is required for industrial purposes only and for
purposes of serving General Mills, Inc., and connecting warehouses, manufactories and
other business industries and enterprises with the line of railroad of Southern
Pacific Company. The track will be used for the transportation of freight only and
will not be used as a main line or part thereof.
Your applicant further represents that said track will be laid level with the street
and will be operated under such restrictions as not to interfere with the use of the
street by the public, and that said track will be operated under such regulations and
conditions as may be prescribed from time to time by your Honorable Council.
