HomeMy WebLinkAboutResolutions - No. 80-121RESOLUTION NO. 80-121 DECLARING THE INTENTION OF THE CITY COUNCIL OF THE CITY OF LODI TO ABANDON CLUFF AVENUE, NORTH OF TURNER ROAD, LODI BE IT RESOLVED by the City Council of the City of Lodi as follows: Section 1. It is the intention of the City Council of the City of Lodi, acting in accordance with the provisions of Part 3 of Division 9 of the Streets and Highways Code of the State of California, to vacate, close, and abandon the following portions of a street situated in the City of Lodi, County of San Joaquin, State of California, more particularly described as follows: A portion of the North one half of Section 6, T.3N.R.7E., M:D.B. & M. being more particularly described as follows: A strip of land 40.00 feet in width, the centerline of said strip being more particularly described as follows: Beginning at the Northeast corner of the Northwest Quarter of said Section 6; thence S. 0 38' W., along the East line of said Quarter, 290.00 feet to the north line of Turner Road as shown on the Specific Plan for Turner Road between Church Street and Myrtle Road and Recorded June 9, 1971 in Book 3538, page 228, San Joaquin County Records said point being the southerly terminal of said 40.00 foot strip of land. Reserving, however, and excepting from the vacation of said street, the permanent easement and the right therein to construct, maintain, repair and operate lines for public utilities, both publicly and privately owned, in over, and across said alleys. -1-- Reference is hereby made to a map or plan on file in the office of the City Clerk for particulars as to the proposed vacation. Section 2. NOTICE IS HEREBY GIVEN that this City Council does hereby fix WEDNESDAY, OCTOBER 15, 1980, at the hour of 8:00 p.m. and the City Council Chambers, City Hall, Lodi, California, as the time and place when and where all persons interested in or objecting to the vacation herein proposed may appear before this City Council and be heard. Section 3. Upon adopting of this resolution, the Superinten- dent of Streets shall post, or cause to be posted, notice of such passage and of the time, form and manner as prescribed by law for the vacation of streets. Section 4. This resolution shall be published one time in the "Lodi News Sentinel", a daily newspaper of general circulation printed and published in the City of Lodi, said publication to be completed at least fifteen days prior to said hearing.
