RESOLUTION ENDORSING NOVEMBER 3, 1981 BALLOT
MEASURE WHICH IF PASSED WOULD PROVIDE FOR AN
ANNUAL SPECIAL TAX FOR ADDITIONAL FUNDING FOR
THE SAN JOAQUIN COUNTY MOSQUITO ABATEMENT
DISTRICT
RESOLVED that the City Council of the City of Lodi
does hereby endorse the November 3, 1981 ballot measure, which
if passed would provide for an annual special tax for additional
funding for the San Joaquin County Mosquito Abatement District;
and which is hereinafter set forth in full:
WHEREAS, a decrease in property tax revenues has required
a reduction in expenditures by this District for personnel and
materials; and
WHEREAS, such reductions have limited the ability of
this District to control and abate disease carrying and pest
mosquitoes in San Joaquin County, thus threatening the health
and safety of the San Joaquin County residents; and
WHEREAS, this Board of Trustees believes that the special
tax rate set forth below is necessary to provide additional
revenue for mosquito abatement; and
WHEREAS, for the aforementioned reasons, this action is
exempt from the provisions of the California Environmental
Quality Act pursuant to Section 21080(b)(8) of the Public
Resources Code of the State of California; and
WHEREAS, in conformance with Section 50077 of the
Government Code and following notice as required by law, a
public hearing was held this day; and
WHEREAS, evidence was received and considered by this
Board of Trustees as the legislative body of Mosquito Abatement
District and, there being no protest, either writen or oral,
against the proposed special tax and after consideration of the
same and the entire record, this Board finds the proposed tax
necessary.

NOW, THEREFORE, BE IT RESOLVED AND ORDERED AS FOLLOWS:
1. That this Board of Trustees does hereby call an election
concerning the adoption of a special tax, such election to
be held on November 3, 1981, which shall be consolidated with
any statewide election that may hereinafter be called or with
any other election to be held that date within San Joaquin
County and hereby agrees to pay all reasonable costs of such
election to the County of San Joaquin.
2. The measure to be presented to the voters shall read as
follows:
"Shall the proposed special tax set forth in Resolution 81-5
of the Board of Trustees of the San Joaquin County Mosquito
Abatement District be adopted?"
3. The special tax shall be authorized upon approval of two-thirds
of the votes cast by the registered voters voting within the
District.
4. The proposed special tax shall be levied once per annum
on all non-exempt real property in San Joaquin County at
a rate not to exceed the square footage rate set forth below.
The tax may vary yearly and shall be determined by the
difference between the proposed budgeted expenditures and the
expected receipts for that year. Expected receipts shall
include subvention money received from the State of California.
In no event shall this special tax exceed the maximum rates
set forth below:
a) Land used for single family residential purposes shall
be taxed at a maximum of $.0002194 per square foot which
rate is $9.56 an acre, or $1.75 for a lot 80' x 100'.
b) Land used for apartments, duplexes, other multiple living
units, and institutions shall be taxed at a maximum of
$.00021993 per square foot which rate is $9.58 per acre.
c) Land used for commercial or industrial purposes shall
be taxed at a maximum of $.00029316 per square foot which
rate is $12.77 an acre.
d. Vacant land used for agriculture or similar purposes
which is irrigated shall be taxed at a maximum of $.00000735
which rate is 32 cents an acre.
e. Vacant land which is not irrigated shall be taxed at a
maximum of $.00000344 which rate is 15 cents an acre.
5. No special tax shall be imposed upon land owned by a Federal,
State of Local Governmental agency.

6. The special tax may be collected at the same time and in the
same manner as ordinary county ad valorem property taxes
are collected and shall be subject to the same penalties and
the same procedure and sale in case of delinquencies as
provided for ad valorem property taxes.
7. As provided for in Section 50077 (c) of the Government Code,
the County of San Joaquin may deduct its reasonable costs
incurred for such service before remittal of the balance to
the Mosquito Abatement District.
IT IS FURTHER ORDERED that the Manager of this District
forward a copy of this Resolution to the San Joaquin County Board
of Supervisors together with a letter requesting said Board to
institute the necessary proceedings to consolidate this election
with any other to be held within this County on November 3, 1981.
I hereby certify that Resolution No. 81-137 was passed
and adopted by the City Council of the City of Lodi in
a regular meeting held October 7, 1981 by the following
vote:
Ayes: Councilmen - Murphy, Pinkerton, Katnich and
McCarty
Noes: Councilmen - None
Absent: Councilmen - Hughes
