HomeMy WebLinkAboutAgenda Report - October 21, 1998 (44)AGENDA TITLE: Encroachment Permit and Hold Harmless Agreement for 2817 West Turner Road MEETING DATE: October 21, 1998 PREPARED BY: Public Works Director RECOMMENDED ACTION: Approve the Encroachment Permit and Hold Harmless Agreement for 2817 West Turner Road and direct the City Manager and City Clerk to execute the Agreement on behalf of the City. BACKGROUND INFORMATION: The property owners, A. Fred and G. Camy Baker, have submitted a construction application (#12879) to obtain a building permit for the construction of an entry feature for the Bridgetowne development. The Bridgetowne development is located north of Turner Road and south and west of the WID canal. The entry feature consists of decorative walls on Lot A and Lot 1 of the Bridgetowne development and a raised median with decorative column in the Bridgetowne Drive right-of-way as shown on Exhibit A. The entry feature is to be privately owned and maintained. The proposed structures will encroach on a 10 -foot public utility easement on Lot 1 and the street right-of-way of Bridgetowne Drive. The Public Works Department has approved the encroachments on the condition that the owners submit a structural encroachment permit application, execute a Hold Harmless Agreement, which will be recorded in the County Recorder's office, and obtain written approval for the encroachments from other public utilities. The Community Development Department has reviewed and approved the plans for the entry features. The owners have executed the encroachment permit application and required Hold Harmless Agreement, provided written authorization for the encroachments from PG&E, Pacific Bell, and MediaOne, and paid the necessary fees for recording the Hold Harmless Agreement.
