BACKGROUND INFORMATION: Improvements at 1310 Thurman Street, have been completed in substantial conformance with the requirements of the Improvement Agreement between the City of Lodi and Thurman Street Company, LLC, as approved by the City Council on May 6, 1998, and as shown on Drawing No. 97D074. The parcel map creating 1310 and 1330 Thurman Street included the dedication of Thurman Street along both of these frontages. Street improvements fronting 1330 Thurman Street (approximately 200 linear feet) have been deferred until that parcel develops. Staff is recommending that the City also accept the dedication of this undeveloped portion of Thurman Street at this time. The street to be accepted is as follows: Street Length in Miles Thurman Street .11 Total New Miles of City Street 0.11 FUNDING: Not applicable. 4AA � Richard C. Box 3006 Lodi, CA 95241-1910 RESOLUTION NO. 98-133 A RESOLUTION OF THE LODI CITY COUNCIL ACCEPTING THE DEVELOPMENT IMPROVEMENTS INCLUDED IN THE IMPROVEMENT AGREEMENT FOR 1310 THURMAN STREET The City Council of the City of Lodi finds: 1. That all requirements of the Improvement Agreement between the City of Lodi and Thurman Street Company, LLC, for the improvements at 1310 Thurman Street, have been substantially complied with. The improvements are shown on Drawing No. 97DO74 on file in the Public Works Department, and as specifically set forth in the plans and specifications approved by the City Council on May 6, 1998. 2. The streets to be accepted are as follows: Streets Thurman Street Length in Miles .11 Total New Miles of City Streets 0.11 3. The parcel map creating 1310 and 1330 Thurman Street included the dedication of Thurman Street along both frontages. Street improvements fronting 1330 Thurman Street have been deferred until that parcel develops. The City Council of the City of Lodi hereby accepts the dedication of this undeveloped portion of Thurman Street at this time. A copy of the resolution is enclosed for your files. The Certificate of Deposit guaranteeing faith performance will be reassigned as of the date of acceptance of the improvements. The Certificate of Deposit guaranteeing labor and materials must remain in effect until December 15, 1998, in conformance with State law. If you have any questions, ple/ecntact me. HAYS City Attorney The Lodi City Council accepted the development improvements for the Thurman Street Extension Project at its regularly scheduled meeting on September 16, 1998. This letter constitutes notice to you that the subject Certificate of Deposit dated April 3, 1998, in the amount of $152,021.11, to guarantee faithful performance has now been reassigned to Thurman Street Company, LLC. The City of Lodi no longer has any interest in this Certificate of Deposit. Certificate of Deposit No. 2330787030 to guarantee labor and materials will be reassigned 90 days from the date of acceptance of the improvements. HAYS City Attorney The City Council of the City of Lodi, at its meeting on September 16, 1998, accepted the public improvements that were made in the subject development. Enclosed for your files is a copy of the resolution accepting the public improvements. From the date of the resolution, the City of Lodi will maintain the street and other public improvements installed within rights-of-way and public utility easements as shown on the approved plans. The Certificate of Deposit assigned to the City to guarantee faithful performance can now be reassigned to you. The Certificate of Deposit guaranteeing labor and materials will have to remain in effect for a period of ninety days from the date of the resolution in conformance with State law. Your representative can pick up these reassignments and certificates at our office during normal working hours. If you have any questions, please intact me.
