BE IT RESOLVED that the City Council of the City of Lodi does hereby authorize the City Manager and City Clerk to execute the Agreement, a copy of which is attached hereto, marked Fxhibit "A", and thereby made a part hereof, on behalf of the City. The subject program is adopted in accordance with Paragraph 2 of Article H of the aforemen- tioned agreement under authority of City&=tW Resolution No. approved by the City Counci.l4kw&rcon (See copy attached). Reconstruct pavement and widening. al covenants or Remam : DLA -411A (11/81) *Local Agency Funds unless otherwise specified All maintenance, involving the physical condition and the operation of the improvements, referred to in Article VI MAINTENANCE of the aforementioned Master Agreement will be performed by the rili--y of Lodi at regular intervals or as required for efficient operation of the completed improvements. EXHIBIT B Page 2 June 12, 1984 I 2. The City of Lodi will advertise, award and administer this project. The City will obtain State's concurrence prior to either award or rejection of contract. 3. The City will reimburse the State for their share of'costs for work requested to be performed by the State. 4. In awarding the contract, the Local Agency agrees that payment of Federal funds will be limited to the Detail Estimate amount approved by the Federal Highway Administration in the Federal -Aid Project Agreement (PR -2), or its modification (PR -2A), and accepts any increases in Local Agency funds. 5. The use of Federal funds for this project is subject to the project being selected as part of the County FAU Program for the Lodi Urban Area. 6. The availability of Federal funds will be subject to meeting deadlines and/or other conditions as may be imposed by the Director upon the recommendation of the Federal -Aid Urban Advisory Committee. 7. In executing this Program Supplement, the Local Agency hereby reaffirms the "Nondiscrimination Assurances" for Federal -Aid Programs contained in the aforementioned Master Agreement. 8. This Program Supplement supersedes Local Agency -State Agreement, Program Supplement No. 18 executed by the City of Lodi on December 8, 1982.
