provisions of Sections 8320 et seq. of the Streets and Highways Code of the State
of California, did on the 16th day of March, 1988, pass and adopt Resolution No.
88-3#, therein declaring the intention of said City Council to vacate a portion
of the public utility easements along the east line of Lower Sacramento Road,
between Taylor Road and Vine Street, and the north and south lines of St. Moritz
Drive, Lodi, California, and more particularly described in said resolution; and
WHEREAS, said matter has been referred to the Planning Commission of the
City of Lodi and a favorable recommendation has been made by said Planning
Commission to this City Council; and
WHEREAS, notice of adoption of said Resolution of Intention to vacate was
regularly given by publication in the "Lodi News Sentinel", a newspaper of
general circulation published in the City of Lodi, County of San Joaquin, and by
posting on the property, both in the time, form, and manner as required by law,
and there are on file in the office of the City Clerk affidavits showing said
publication and posting; and
WHEREAS, in accordance with the notice given in said Resolution No. 88-33, a
public hearing was held before said City Council in the Council Chambers, City
Hall, 221 West Pine Street, Lodi, California, at 7:30 p.m., on April 6, 1988; and
WHEREAS, at the aforesaid time and place set for public hearing, no person
appeared to object to the vacation of said portion of the public utility
easement; and
WHEREAS, the City Council of the City of Lodi did then and there determine,
at said public hearing, that the portion of the public utility easements more
particularly hereinafter described is unnecessary for present or prospective
public use.
NOW, THEREFORE, IT IS HEREBY ORDERED, pursuant to the foregoing findings and
under the authority of Sections 8320, et seq., of the Streets and Highways Code
of the State of California, that there is hereby abandoned and vacated a portion
of the public utility easements situated in the City of Lodi, County of San
Joaquin, State of California, more particularly described as follows:

RESOLUTION/ORDER
VACATING A PORTION OF THE PUBLIC UTILITY EASEMENTS
ALONG THE EAST LINE
OF LOWER SACRAMENTO ROAD,
BETWEEN TAYLOR ROAD
AND VINE STREET,
AND THE NORTH AND SOUTH LINES
OF ST. MORITZ DRIVE
WHEREAS, the City Council of the City of Lodi, acting in accordance with the

City of Lodi, San Joaquin County, described as follows:
The East 4 feet of that 10 foot wide public utility easement along
the east line of Lower Sacramento Road and the South
4 feet of that 10 foot wide easement along the south line of St.
Moritz Drive, and the north 4 feet of that 10 foot wide easement
along the north line of St. Moritz Drive being described as follows:
Easement "A" A 10 foot wide public utility easement beginning at
the southwest corner of Parcel "A" as shown on Parcel Map, Book 14,
Page 9, San Joaquin County Records; thence along the west line of a
10 foot wide public utility easement, North 499.39 feet, N 45°00'
E, 23.08 feet; thence along the north line of a 10 foot wide public
utility easement, East 58.19 feet; thence along a curve to the
right, having a radius of 472.50 feet, a central angle of 27°00'
and an arc length of 222.66 feet; thence S 63°00' E, 167.11 feet to
the point of termination.
Easement "B" A 10 foot wide public utility easement beginning at
the northwest corner of Parcel "A" as shown on Parcel Map, Book 14,
Page 9, San Joaquin County Records; thence along the west line of a
10 foot wide public utility easement, South 535.98 feet, S 45°00'
E, 23.08 feet; thence along the south line of a 10 foot wide public
utility easement, East 58.19 feet; thence along a curve to the
right, having a radius of 527.50 feet a central angle of 27°00' and
an arc length of 248.58 feet; thence S 63°00' E, 160.65 feet to the
point of termination.
The name of the assessed owner as it appeared on the latest secured
assessment roll Chris R. Keszler, et al., 317 W. Lodi Avenue, Lodi, California,
95240.
Reference is hereby made to a map or plan on file in the office of the City
Clerk of the City of Lodi for the particulars as to the proposed vacation.

City Council of the City of Lodi in a regular meeting
