HomeMy WebLinkAboutResolutions - No. 90-173RESOLUTION NO. 90-173 ------------------------- ------------------------- A RESOLUTION OF THE LODI CITY COUNCIL APPROVING THE NORTH COUNTY SANITARY LANDFILL AS THE REPLACEMENT SITE FOR THE HARNEY LANE SANITARY LANDFILL WHEREAS, on June 25, 1986, this City Council adopted Resolution No. 86-91 which approved the 1986 San Joaquin County Solid Waste Management Plan; and WHEREAS, one of the recommendations of the Plan was that a replacement site for the Harney Lane Sanitary Landfill be procured and developed; and WHEREAS, the County of San Joaquin, consistent with that recommendation, has procured and is developing the North County Sanitary Landfill, which is identified as the real property located at 17900 and 17916 East Harney Lane, and described as Assessor's Parcel Numbers 065-012-03 and 065-012-02, as the replacement site for the Harney Lane Sanitary Landfill; and WHEREAS, Assembly Bill 2296 establishes criteria for the approval of new disposal sites, until the counties in California have State -approved county -wide integrated waste management plans; and WHEREAS, the County of San Joaquin does not currently have a county -wide integrated waste management plan; and WHEREAS, one of the specified requirements of Assembly Bill 2296 establishes that any new solid waste disposal facility be approved by the county and a majority of the cities within the county representing a majority of the population of the incorporated areas; NOW, THEREFORE, BE IT RESOLVED, that this City Council, in conformance with Assembly Bill 2296, does hereby approve the North County Sanitary Landfill, which is identified and described above, as the replacement site for the Harney Lane Sanitary Landfill. The County's Harney Lane Sanitary Landfill is reaching its capacity and must be closed in 1991. The 1986 County Solid Waste Management Plan, which was approved by your City Council on June 25, 1986, recommended the procurement and development of a replacement site for the Harney Lane Sanitary Landfill (HLSL). The replacement site was to be located near -the existing HLSL. Consistent with that recommendation, the in 1987, purchased a 320 acre parcel as a the HLSL. This site is located on Harney of the HLSL. Presently, the County is in the necessary State operating permits for landfill is referred to as the North Coun (NCSL), and is expected to be in operatio County of San Joaquin, replacement site for Lane, 1 1/2 Niles east the process of securing the landfill. Basically, the Bill facilitates the permitting of new disposal sites until each county in California has a State approved integrated waste management plan. Since San Joaquin County does not have an approved integrated waste management plan at this time, the NCSL project is subject to the provisions of AB 2296. One of the provisions requires that the facility be approved by the County and a majority of the cities within the county representing a majority of the population of the incorporated areas. Accordingly, we respectfully request that your City Council consider adopting a resolution, similar to the one attached, declaring its approval of the NCSL. If adopted by your City Council, please forward a certified copy of the resolution to us. Thomas Peterson October 17, 1990 Page 2 We are currently working with staff from the California Integrated Waste Management Board (CIWMB) to place the permitting of the NCSL on the CIWMB's November 1990 agenda. Therefore, we request that, if possible, your City Council consider this matter at its earliest convenience. Preferably, by November 15, 1990.
