RECOMMENDED ACTION: Approve the encroachment permit and hold harmless agreement for
40 East Neuharth Drive and direct the City Manager and City Clerk to
execute the agreement on behalf of the City.
BACKGROUND INFORMATION: The owners of the subject property, Terry R. Knutson and
Rose Knutson, have submitted a construction permit application
(#11571) to obtain a building permit for installation of an
evaporative condenser unit on the property. The unit will encroach
on an existing 8 -foot public utility easement (PUE) along the south property line and the owners have
requested a permit be issued to allow the encroachment. In addition, there are existing improvements
consisting of a pump receiver, two compressor units, an evaporative condenser and an ice builder
which encroach on the PUE and need to be included in the encroachment permit.
The Electric Utility Department has aboveground facilities in the PUE and has approved the
encroachments on condition that the owners execute a hold harmless agreement, to be recorded in the
County Recorder's office, and obtain approval for the encroachments from other public utilities.
The owners have executed the encroachment permit application and required hold harmless
agreement, provided written authorization for the encroachments from PG&E, Pacific Bell and
Continental Cablevision, and paid the necessary fees for recording the hold harmless agreement in the
County Recorder's office.
Staff recommends the encroachment permit and hold harmless agreement be approved.
FUNDING: Recording fees paid by owner.
