HomeMy WebLinkAboutResolutions - No. 91-156RESOLUTION NO. 91-156 ---------------------- ---------------------- A RESOLUTION OF THE LODI CITY COUNCIL IN OPPOSITION TO PROPOSED SENATE BILL 376 RELATING TO THE USE OF TOBACCO ----------------------------------------------------------------------- ----------------------------------------------------------------------- WHEREAS, SB 376 preempts local ordinances adopted after July 1, 1991, taking away local control and local decision-making processes; and WHEREAS, SB 376 repeals certain sections of the California Health and Safety Code and Penal Code that regulate tobacco sales or free distribution of tobacco, sale of tobacco to minors and smoking in health care facilities; and WHEREAS, SB 376 severely reduces the restrictions on sale of tobacco to minors and increases their access to tobacco products; and WHEREAS, SB 376 penalizes minors for purchasing tobacco rather than vendors of tobacco products; and WHEREAS, SB 376 does not have any enforcement components to the regulatory activities included in the bill nor does it give local government any authority for funding the enforcement activities; and WHEREAS, SB 376 undermines the national goals of having a smoke-free environment by year 2000. A similar goal was also voted by the citizens of California in Proposition 99; NOW, THEREFORE, BE IT RESOLVED, that the Lodi City Council, by this resolution, expresses its opposition to proposed Senate Bill 376.
