HomeMy WebLinkAboutResolutions - No. 92-86RESOLUTION NO. 92-86 -------------------- -------------------- A RESOLUTION OF THE LODI CITY COUNCIL DIRECTING THE CITY CLERK, PURSUANT TO STATE OF CALIFORNIA GOVERNMENT CODE SECTION 57000 ET SEQ. TO SET A PUBLIC HEARING TO CONSIDER THE "BENNETT/COMPTON ADDITION" ANNEXATION/REORGANIZATION, INCLUDING ANNEXATION TO THE CITY OF LODI AND DETACHMENT FROM THE WOODBRIDGE FIRE DISTRICT, THE WOODBRIDGE LIGHTING DISTRICT AND THE SJC RESOURCE CONSERVATION DISTRICT. ----------------------------------------------------------------------- ----------------------------------------------------------------------- WHEREAS, the above -entitled proposal for the "Bennett/Compton Addition" Reorganization, including annexation to the City of Lodi and detachment from the Woodbridge Fire District, the Woodbridge Lighting District and the SJC Resource Conservation District was initiated by the City of Lodi with adoption of Resolution No. 92-36 entitled "A Resolution of the Lodi City Council For Application to the San Joaquin County Local Agency Formation Commission in the Matter of the Proposed "Bennett and Compton Addition, Including the Detachment of Certain Territory Within the Area Proposed For Annexation to the City of Lodi" on March 4, 1992, and on March 16, 1992, the Local Agency Formation Commission of San Joaquin Executive Officer certified the application filed for processing in accordance with the Local Government Reorganization Act; and WHEREAS, following a public hearing regarding the matter held on April 17, 1992 , the Local Agency Formation Commission of San Joaquin County adopted Resolution No. 857 - "A Resolution Approving Proposed Bennett/Compton Reorganization (LAFC 3-92) Including Annexation to the City of Lodi and Detachment from the Woodbridge Fire District, The Woodbridge Lighting District, and the SJC Resource Conservation District", determining and ordering the following: Section 1. The Negative Declaration adopted by the City of Lodi, as lead agency, was reviewed and considered. Section 2. The above entitled reorganization is approved subject to the following condition: A. Whenever city sewer service is "provided to the two parcels now served by the Woodbridge Sanitary District, the City of Lodi shall file an application with LAFCO to detach the overlapped territory from the District. Section 3. The boundaries are hereby approved as submitted, said boundaries being set forth in Exhibit A. Section 4. The affected territory is uninhabited. Section 5. The City of Lodi is designated as the conducting authority and the City Council is authorized to initiate proceedings for uninhabited reorganization in accordance with Section 57000 et seq. of the Government Code. Section 6. The Executive Officer is hereby authorized and directed to mail and file certified copies of this resolution as required by Section 56853 of the Government Code. NOW, THEREFORE, BE IT RESOLVED, that the Lodi City Council does hereby direct the City Clerk, pursuant to State of California Government Code Section 57000 et seq. to set a public hearing for Wednesday, June 3, 1992 at 7:30 p.m. to consider the Bennett/Compton Reorganization including annexation to the City of Lodi and detachment from the Woodbridge Fire District, the Woodbridge Lighting District, and the SJC Resource Conservation District". Dated: May 6, 1992 I hereby certify that Resolution No. 92-86 was passed and adopted by the Lodi City Council in a regular meeting held May 6, 1992 by the following vote: Ayes: Council Members - Pennino, Sieglock, Snider and Pinkerton (Mayor) Noes: Council Members - None Absent: Council Members - Hinchman Alice M. eimche City Clerk 92-86 RES9286/TXTA.02J � A - April 2, 1992 DESCRIPTION OF PROPOSED BENNETT/COMPTON ANNEXATION TO THE CITY OF LODI San Joaquin County, California A portion of the south half of Section 34, Township 4 North, Range 6 East, Mount Diablo Base and Meridian, more particularly described as follows: Beginning at the southwest corner of the northwest quarter of the southeast quarter of said Section 34, said corner being the northwest corner of WOODLAKE NORTH, UNIT NO. 2 (the map or plat of which is filed in Book of Official Maps and Plats, Volume 27, page 52, San Joaquin County Records), and also being on the Lodi City Limit line; thence easterly along said City Limit line, being along the south line of said northwest quarter of the southeast quarter of Section 34, and also being along the north line of said WOODLAKE NORTH, UNIT NO. 2, a distance of 650.92 feet to intersection with the east line of Lilac Street (60 feet wide); thence leaving said City Limit line and running along said east line the following three (3) courses: (1) North 9049115" East, 4.91 feet, (2) North 8052143" East, 547.6 feet and (3) North 54020159" East, 42.08 feet to the south line of Academy Street (60 feet wide); thence leaving said south line, northerly, 60 feet to the east end of the round corner curve at the northeast corner of the intersection of Academy Street and Lilac Street; thence northwesterly along said round corner curve, having a radius of 20 feet, an arc distance of 31.42 feet to the north end of said curve, being on the east line of Lilac Street (66 feet wide); thence along the east line of said Lilac Street, as shown on WOODBRIDGE VILLAGE (the map or plat of which is filed in Book of Official Maps and Plats, Volume 25, page 110, San Joaquin County Records), the following five (5) courses: (1) North 11°36100" East, 15.0 feet, (2) South 78024100" East, 4.0 feet, (3) North 11036100" East, 172.0 feet, (4) North 78024100" West, 4.0 feet and (5) North 11°36100" East, 58.41 feet to the southeasterly line of the Woodbridge Irrigation District's 120 foot wide right of way; thence along said southeasterly line the following four (4) courses: (1) South 56030100" West, 121.83 feet to the original west line of Lilac Street, (2) South 67030100" West, 740.91 feet to intersection with the west line of said southeast quarter of Section 34, (3) North, 49.85 feet and (4) South 67°17100" West 76.97 feet to the west line of Chestnut Street; thence leaving said Woodbridge Irrigation District's right of way line and running along said west line of Chestnut Street the following three (3) courses: (1) South, 184.91 feet, (2) southerly on a curve to the left, having a radius of 1040 feet (the long chord of which bears South 5003102" East, 183.11 . feet), an arc distance of 183.35 feet to a point of reverse curve and (3) southerly along a curve to the right, having a radius of 960 feet (the long chord of which bears South 5003102" East, 169.03 feet) an arc distance of 169.25 feet; thence East 40.0 feet to the point of beginning.
