HomeMy WebLinkAboutResolutions - No. 92-03RESOLUTION NO. 92-3 ---------------------- ---------------------- A RESOLUTION OF THE LODI CITY COUNCIL ORDERING THE ANAGNOS REORGANIZATION (LAFC 19-91) WITHOUT NOTICE AND HEARING, INCLUDING ANNEXATION TO THE CITY OF LODI, AND DETACHMENT FROM THE WOODBRIDGE FIRE DISTRICT AND THE SJC RESOURCE CONSERVATION DISTRICT. IN THE MATTER OF THE ANAGNOS ) RESOLUTION MAKING REORGANIZATION (LAFC 19-91) INCLUDING ) DETERMINATIONS AND ANNEXATION TO THE CITY OF LODI, AND ) ORDERING REORGANIZATION DETACHMENT FROM THE WOODBRIDGE ) WITHOUT NOTICE AND FIRE DISTRICT AND THE SJC RESOURCE ) HEARING CONSERVATION DISTRICT. ) Section 1. RESOLVED, BY THE CITY COUNCIL OF THE CITY OF LODI that it determines: a) Preliminary proceedings for the annexation of certain described territory to the City of Lodi and detachment from the Woodbridge Fire District and the SJC Resource Conservation District were initiated by the filing of the City of Lodi's Resolution No. 91-180 with the Local Agency Formation Commission in the County of San Joaquin, proposing annexation of approximately 9 acres of property, pursuant to the requirements of the Local Government Reorganization Act. b) Thereafter, appropriate proceedings were conducted by said Local Agency Formation Commission, and said Commission on December 6, 1991 adopted Resolution 841 approving the proposed annexation, subject to certain conditions, to wit: 1) The City of Lodi shall initiate separate proceedings to propose annexation of the three parcels located immediately north along Lower Sacramento Road, containing about 9 acres. c) Resolution No. 841 of the Local Agency Formation Commission approving the proposed annexation also authorized the City of Lodi to complete proceedings for uninhabited reorganization without notice and hearing as the designated conducting agency in accordance with Section 57002(c) of the Government Code. Section 2. BE IT FURTHER RESOLVED, BY THE LODI CITY COUNCIL: a) That the proposal for annexation is ORDERED in accordance with Section 57002(c) of the Government Code of the State of California. 1. Anagnos (contiguous) annexation to the City of Lodi. 2. Detachment of Anagnos from the Woodbridge Fire District and the SJC Resource Conservation District. 3. A description of said territory is attached hereto (Exhibit A) and made a part hereof, as though set out in full. Section 3. BE IT FURTHER RESOLVED, BY THE LODI CITY COUNCIL: That the above entitled reorganization is approved subject to the condition that the City of Lodi shall initiate separate proceedings to propose annexation of the three parcels located immediately north along Lower Sacramento Road, containing about 9 acres. Reimche City Clerk 92-03 RES9203/TXTA.02J EXHIBIT A October 25, 1991 ANAGNOS ANNEXATION TO THE CITY OF LODI San Joaquin County, California A portion of Section 10, Township 3 North, Range 6 East, Mount Diablo Base and Meridian, more particularly described as follows: Commencing at the Southwest corner of the Southeast Quarter of said Section 10, said corner being in the intersection of Kettleman Lane (State Highway Route No. 12) and Lower Sacramento Road; thence North 0°03114" West, 65.00 feet and North 89 21'42" west, 40.00 feet to a point on the west line of Lower Sacramento Road, said point being on the Lodi City Limit line, and also being the TRUE POINT OF BEGINNING; thence leaving said City Limit line, r northerly along said west line of Lower Sacramento Road, 903.88 feet to the westerly production of the north line of that certain 13.84 acre parcel of land shown on Record of Survey, filed in Book of Surveys, Volume 27, page 160, San Joaquin County Records; thence South 89°58'24" East along said westerly production and north line of 13.84 acre parcel, 1224.58 feet to the northeast corner thereof; thence South 0°48'30" East along the east line of said 13.84 acre parcel and its southerly production, 943.32 feet to the north line of said Kettleman Lane, being on said City Limit tine; thence along said Citv Limit line the following three (3) courses: (1) westerly along said north line of Kettleman Lane, 1081.31 feet to the southerly end of the round corner curve at the northeast corner of the intersection of said Kettleman Lane with Lower Sacramento Road, (2) along said round corner curve, northwesterly on a curve to the right, having a radius of 50.00 feet (the long chord of which bears North 44°41'55" West, 70.27 feet), an arc distance of 77.92 feet to -the northerly end of said curve, and (3) South 85000'06" West, 95.35 feet to the true point of beginning.
