HomeMy WebLinkAboutAgenda Report - June 17, 1998 (84)�loF< 1COUNCIL • 4��FOR� AGENDA TITLE: Encroachment Permit and Hold Harmless Agreement for 1100 South Cherokee Lane MEETING DATE: June 17, 1998 PREPARED BY: Public Works Director RECOMMENDED ACTION: Approve the Encroachment Permit and Hold Harmless Agreement for 1100 South Cherokee Lane and direct the City Manager and City Clerk to execute the Agreement on behalf of the City. BACKGROUND INFORMATION: The property owners, Hasmukh M. Bhakta, Rita H. Bhakta, Jayanti M. Bhakta, and Kalavati J. Bhakta, have submitted a construction application (#13432) to obtain a Building Permit for the construction of a monument sign adjacent to the west property line (Cherokee Lane frontage) of the subject property (Exhibit A). The sign structure will encroach on an existing 20 -foot public utility easement (PUE) along the west property line. The Public Works Department has approved the encroachment on the condition that the owners execute a Hold Harmless Agreement, which will be recorded in the County Recorder's office, and obtain written approval for the encroachment from other public utilities. The owners have executed the Encroachment Permit application and required Hold Harmless Agreement, provided written authorization for the encroachment from PG&E, Pacific Bell, and MediaOne, and paid the necessary fees for recording the Hold Harmless Agreement. In addition, the Community Development Department has reviewed and approved the plans. Staff recommends that the Encroachment Permit and Hold Harmless Agreement be approved.
