BEFORE THE CITY COUNCIL OF THE CITY OF LODI, CALIFORNIA
A RESOLUTION DESCRIBING AMENDED BOUNDARIES
OF ASSESSMENT DISTRICT AND APPROVING THE MODIFICATION
OF ENGINEER'S REPORT AND ASSESSMENT ROLL AS DIRECTED
LODI CENTRAL CITY REVITALIZATION ASSESSMENT DISTRICT NO. 95-1
WHEREAS, this Council has undertaken proceedings for the formation of an
assessment district for the acquisition and/or construction of improvements in the City of
Lodi and following the public hearing on the Engineer's Report it has determined that
public convenience and necessity require that a certain portion of the proposed district
should be deleted therefrom and directed the Engineer to amend its report and assessment
roll showing such deletions and a corresponding increase in the contribution of the City to
the cost of the project, without any increase in the assessments on the remaining parcels of
property in the district;
NOW, THEREFORE, IT IS RESOLVED AND ORDERED by the City Council of
the City of Lodi, California, that:
1. Pursuant to the provisions of Section 3113 of the California Streets and
Highways Code, the proposed boundaries of the assessment district to be assessed in the
proceedings, are hereby described as shown on an amended map of the assessment district
on file in the office of the City Clerk, which indicates by a boundary line the extent of the
territory included in the assessment district and which shall govern for all details as to the
extent of the district, reference to such map hereby being made for particulars. the map
contains the name of the City and a distinctive designation in words or by number of the
district shown thereon, and a reference to the prior recording of the proposed boundary
map.
2. On the original and at least one copy of the map the City Clerk shall endorse
her certificate evidencing the date and adoption of this resolution. The Clerk shall file the
original of such amended map in her office and not later than ten (10) days after adoption
Of this resolution shall file a copy thereof with the County Recorder of San Joaquin County
for placement in the Book of Maps of Assessment and Community Facilities Districts.
3. Pursuant to the provisions of Section 10310.4 and 10352, subsection (a), of
the California Streets and Highways Code, it is determined that the portion of the
assessment district containing certain parcels lying east of the Railroad properties shall be
eliminated, as shown on the above amended boundary map, without increasing the amount
of any assessment by reason thereof or substantially affecting the distribution of benefits
from the work.
4. The Engineer's Report, as amended, showing the deletion of the parcels and
assessments related thereto, and the corresponding increase in the contribution of the City
to the project, without any increase in the assessments on the remaining parcels of property
in the district, as directed by this Council, is hereby approved.
