AGENDA TITLE: Encroachment Permit and Hold Harmless Agreement for 601 East Kettleman Lane
MEETING DATE: July 1, 1998

RECOMMENDED ACTION: Approve the encroachment permit and hold harmless agreement for
601 East Kettleman Lane and direct the City Manager and City Clerk to
execute the agreement on behalf of the City.
BACKGROUND INFORMATION: The property owner, Promod Trehan, has submitted a construction
application (#13659) to obtain a building permit for the construction
of a 75 -foot freeway sign adjacent to Kettleman Lane at the subject
site (Exhibit A). The sign structure will encroach on an existing
16.5 -foot overhead public utility easement (PUE) along the Kettleman Lane frontage. The PUE
prohibits structures in excess of 23 feet in height due to the proximity of overhead electrical lines.
The Electric Utility Department has approved the encroachment on condition that the sign be located
such that there is at least 15 feet clearance from existing electrical lines and that the owner execute a
hold harmless agreement.
The owner has executed the encroachment permit application and required hold harmless agreement
and paid the necessary fees for recording the agreement. The Community Development Department
has reviewed and approved the plans.
Staff recommends that the encroachment permit and hold harmless agreement be approved.
FUNDING: Recording fees paid by owner.
