RECOMMENDED ACTION: Approve the encroachment permit and hold harmless agreement for
1301 West Kettleman Lane and direct the City Manager and City Clerk to execute the
agreement on behalf of the City.
BACKGROUND INFORMATION: The property owners, William Edward Graffigna, Eva F. Graffigna, and
William Graffigna, Jr., have submitted a construction application (#13410) to
obtain a building permit for the construction of a new fuel island, gas pumps, and
car wash at the subject site (Exhibit A).
As a condition of the building permit, the owners are required to provide an on-site storm drainage system which discharges
to the public system, and install a reduced -pressure backflow device assembly on the domestic water service.
Existing public storm drain mains are located on the south and east sides of Kettleman Lane and Ham Lane, respectively,
and existing manholes are not readily accessible from the project site. Connection to either of these mains would require
boring and jacking of the storm drain lateral and installation of new manholes. This would be economically unfeasible for
this project as well as disturbing existing pavement and creating additional facilities requiring City maintenance. There is a
public storm drain manhole located on City property (Municipal Service Center) immediately west of the project site. The
owners have requested an encroachment permit to allow extension of the private storm drain lateral from their site across
City property to this manhole. Staff considers this a reasonable request.
The existing water service for the site extends from Ham Lane along the north property line. The trash enclosure is also
located in this area. If the required reduced -pressure backflow device assembly is installed in this area, it will be vulnerable
to damage by trash trucks. In order to provide protection from vehicular damage, the owner has discussed alternative
locations for the backflow device with the Assistant Water/Wastewater Superintendent and has requested that an
encroachment permit be issued to allow installation of the device on City property immediately to the north. Staff also
considers this a reasonable request.
The owners have executed the encroachment permit application and required hold harmless agreement and paid the
necessary fees for recording the agreement. The agreement stipulates in part that the storm drain lateral and backflow
device are private facilities to be maintained by the owner. Any maintenance or repair operations requiring access to City
property will require the issuance of a separate encroachment permit.
Staff recommends that the encroachment permit and hold harmless agreement be approved.
