HomeMy WebLinkAboutAgenda Report - July 1, 1998 (54)COUNCILCITY OF LODI • • AGENDA TITLE: Improvement Deferral Agreement for 731 Peach Street MEETING DATE: July 1, 1998 PREPARED BY: Public Works Director RECOMMENDED ACTION: Approve the Improvement Deferral Agreement for 731 Peach Street and authorize the City Manager and City Clerk to execute the Agreement on behalf of the City. BACKGROUND INFORMATION: The owners, John M. and Karen J. Keagy, have submitted a construction application (#13625) for an interior remodel and patio cover installation at the subject property. The site is located at the northwest corner of Peach Street and Cochran Road, as shown on Exhibit A. Installation of street frontage improvements, including curb, gutter, sidewalk, street paving and street lights, is required as a condition of the building permit in conformance with Lodi Municipal Code §15.44, Off-site Improvements and Dedications. Since there are currently no street frontage improvements on any of the parcels fronting Peach Street or the adjacent parcel on Cochran Road, the owner has requested final inspection and issuance of a Certificate of Occupancy prior to the installation of the improvements required as a condition of the building permit. Based on past practice in similar situations, staff feels this is a reasonable request. The owners have signed an Improvement Deferral Agreement and paid the necessary recording fees for the Agreement. The Agreement, in part, states that the owner will pay for and complete the design and installation of the required improvements at the time of installation of such improvements on adjacent parcels, or at the request of the City, whichever occurs first.
