COUNCIL • • �4t�FOR�P AGENDA TITLE: Rescind Contract Award and Re -Award Contract for 1997 Sidewalk Repair Program and Miscellaneous Concrete Work ($48,670) MEETING DATE: April 2, 1997 PREPARED BY: Public Works Director RECOMMENDED ACTION: That the City Council adopt the attached resolution rescinding the contract award to Tri -Valley Construction and re -awarding the contract for the above project to Popuch Concrete Contracting, Inc. in the amount of $48,670. BACKGROUND INFORMATION: This project will provide the City with a unit price bid for removing and replacing curb, gutter and sidewalk in various locations throughout the City. This is an annual contract and will be used to administer the sidewalk repair program and to repair bad curb and gutter as needed during 1997. A clause in the specifications will allow the City to extend the contract an additional year if it is mutually agreed upon by City staff and the contractor. Purchase orders will be issued for the work to be done. This project was awarded to Tri -Valley Construction on February 5, 1997. On March 12, 1997, the City received notice from Tri -Valley Construction that they were in financial difficulties and requesting to be relieved of their contract obligations with the City of Lodi. The City has not signed a contract with Tri -Valley Construction because there has been problems in getting their insurance company to provide us with the proper wording and coverage on the certificate of insurance. The City received six bids on this project and the second low bidder was Popuch Concrete Contracting, Inc., of Lodi. Their bid of $48,670 is approximately $2,300 higher than that of Tri -Valley Construction. Popuch Concrete Contracting, Inc. has worked for the City on previous Sidewalk Repair Program and Miscellaneous Concrete Work projects and is a very capable company. Staff is now recommending that Council rescind the contract award to Tri -Valley Construction and re - award the contract for the 1997 Sidewalk Repair Program and Miscellaneous Concrete Work to Popuch Concrete Contracting, Inc., of Lodi in the amount of $48,670. Dixon Flynn -- City Manager CAWARD2.DOC � 03!25/97 RESOLUTION NO. 97-38 A RESOLUTION OF THE LODI CITY COUNCIL RESCINDING AND RE -AWARDING THE CONTRACT FOR 1997 SIDEWALK REPAIR PROGRAM AND MISCELLANEOUS CONCRETE WORK ------------------------------------------------------------------ ------------------------------------------------------------------ WHEREAS, the Lodi City Council awarded the bid for the 1997 Sidewalk Repair Program and Miscellaneous Concrete Work to the low bidder, Tri -Valley Construction of Manteca, CA on February 5, 1997; and WHEREAS, Tri -Valley Construction of Manteca is unable to meet the obligations and requirements of the specifications and complete the work as originally bid; and WHEREAS, City staff has requested that the contract award be rescinded and re -awarded to the second lowest bidder, Popuch Concrete, Lodi. NOW, THEREFORE, BE IT RESOLVED by the Lodi City Council that the award of the Bid for the 1997 Sidewalk Repair Program and Miscellaneous Concrete Work, be made to the next low bidder, Popuch Concrete, Lodi, in the amount of $48,670.00.
