street sweeping schedule so that the same areas of the City
are not always swept at the same time.

PUBLIC HEARING TO CONSIDER REQUEST FOR ONE YEAR EXMZION ON EAST SIDE BUILDING
MORATORIUM
At the November 6, 1985 Coupcil Meeting, Council adopted Ordinance No. 1369 -
An Urgency Ordinance of the City Council Establishing a Building Moratorium on
Conversion of Single -Family Hanes to Multiple -Family in Certain Defined Areas
Pursuant to State of California Government Code Section 65858 which Ordinance
according to State statute was effective for 45 days from the date of its .
passage. (See Exhibit A attached)
On December 4, 1985 a Public Hearing regarding the matter was held pursuant to
State statute. Following the receipt.of background information and public
} testimony concerning the matter Council, by motion action, extended the
moratorium 10 months and 15 days to provide time for consultants to prepare
infrastructure and zoning studies. The firm of Jones and Stokes Associates,
Inc. was retained to perform this task.
Although the study is well under way, it will be necessary to extend the
moratorium to complete this work. Section 65858 of the Government Code of the
State of California allows the ordinance to be extended for one year. Such an
extension requires a four-fifths vote for adoption.
In reviewing the Code, the City Attorney and I concur that the extension would
be based on the date of the adoption of the original ordinance.
' At its meeting of`Saptember 17, 1986, Council set this matter for hearing at
the October 15, 1986 Regular Council Meeting. The notice of hearing -was duly
published pursuant to State Statute and copies of the hearing notice were
mailed under Declaration of Mailing to local building contractors and realtors.
RECOWIMED ACTION:
That Council introduced Ordinance No. 1394 extending for one year (to November
6, 1987) the east side building moratorium on conversion of single-family homes
to Ru;itiple-family in certain defined areas pursuant to State of California
Government Code Section 65858. (See sample Ordinance attached.) Note: This
Ordinance will require a four-fifths vote.

Council for the issuance of Multiple -Family Mortgage Revenue Bonds,
2) the erection of eccmrercial or industrial structures in zones that
conform, and 3) the remodeling of any multiple -family structures.
SECTION 3. Pursuant to Section 65858 of the State of California
Government Code, this Ordinance shall be in effect for 45 days fran its
date of passage.

SECTION 4, All Ordinances and parts of ordinances in conflict herewith
are repealed insofar as such conflict may exist.
SECTION 5. The foregoing Ordinance No. 1369 was introduced and adopted
as an urgency ordinance pursuant to provisions of Section 65858 ,of the
State of California Government Code, because there are indications that
the infrastructure in the subject area is old and may not be able to
tolerate the present zoning for multiple -family units. 'It is therefore
necessary to study the infrastructure to dete.�nine whether or not a
different zoning is necessary for that area.
SECTION 6. This ordinance shall be published one time in the "Lodi
News Sentinel", a daily newspaper of general circulation, printed and
published in the City of Lodi. F

moratorium on conversion .of single-family hares to multiple -family in
certain defined areas of the City of Lodi, said building moratorium
having been approved by, adoption of Ordinance 1369 (copy attached
hereto as Exhibit A and incorporated herein by reference, and as
extended by City Council minute action on December 4, 1985 .(copy

BE IT ORDAINED BY THE LODI CITY COUNCIL.
SECTION 1. That pursuant to Section 65858 of the State of California
Govermrent Code, only single-family dwellings on vacant lots of record
will be permitted to be constructed or reconstructed in the following
described area within the City.of Lodi as of November 6, 1985:
Beginning at the southeast corner of West Turner Road and
North Pleasant Street; thence westerly along West Turner Read

SECTION 5. The foregoing Ordinance No. 1369 was introduced and adopted
as an urgency ordinance pursuant to provisions of Section 65858 of the
State of California Government Code, because there are indications that
the infrastructure in the subject area is old and may not be able to
tolerate the present zoning for multiple -family units. 'It is therefore
necessary to study the infrastructure to determine whether or not a
different zoning is necessary for that area.
SECTION 6. This ordinance shall be published one time in the "Lodi
News Sentinel", a daily newspaper of general circulation printed and
published in the City of Lodi.

As part of our examination, we made a study and evaluation of the system of
internal accounting and administrative controls of the City of Lodi to the
extent we considered necessary to evaluate the system as required by
generally accepted auditing standards, the standards for financial and
compliance audits contained in the U.S. General Accounti,>g Office Standards
for Audit of Governmental Organizations, Programs, Activities, and
Functions, and the Single Audit Act of 1984 (Pub. L. No. 98-502). ..For the
purpose of this report, we have classified the .significant. internal
accounting and administrative controls in the following categories:
- Financing
- Revenue/receipts
- Purchases/disbursements
--External financial reporting
- Grant administration and compliance
The purpose of our study and evaluation was to determine the nature, timing,
and extent of performing the auditing procedures necessary for expressing an
opinion on the City's general purpose financial statements. Our study and
evaluation was more limited than would be necessary to express an opinion on
the system of internal accounting and administrative controls taken as a
whole or on any of the categories of controls identified above.
The management of the City of Lodi is responsible for establishing and
maintaining a system of internal accounting and administrative controls. In
fulfilling this responsibility, estimates and judgments by management are
required to assess the expected benefits and related costs of control

procedures. The objectives of a system are to provide management with

reasonable, but not absolute, assurance that assets are safeguarded against
loss from unauthorized use or disposition, the City is managing its federal
financial assistance programs in compliance with laws and regulations, and

Because of inherent limitations in any system of internal accounting and

administrative controls, errors or irregularities may nevertheless occur and

those provisions of federal and state law or regulations that could have a
material effect on the financial statements or on the SOCJP program and each
major federal assistance program tested. The results of our tests indicate`
that for the items tested, the City of Lodi complied with the material terms
and conditions of the federal .assistance agreements and of the SOCJP
program, except as described in Exhibit II, the schedule of findings. and

examination and the procedures referred to above, nothing came to our
attention to indicate that the City of Lodi had not complied with the

Complete records are not maintained for general fixed assets and, therefore,
the combined financial statements referred to above do not include a

The records of the enterprise funds were incomplete as to fixed assets and
related depreciation. Because we were unable to satisfy ourselves by
appropriate audit tests or by other means as a result of such incomplete
records, we are unable to express an opinion on the accompanying financial

In our opinion, except that the omission of the financial statement
described above results in an incomplete presentation, as explained in the
preceding paragraph, the combined financial statements, other than the

NOTE A --FINANCIAL REPORTING ENTITY
For financial reporting purposes, in conformance with. NCGA Statement 3, the
City includes all funds, account groups, agencies, boards, commissions, and
authorities that are controlled by or dependent on the City's executive or
legislative branches (the Mayor or the. Council, respectively). Control by
or dependence on the City was determined on the basis of budget adoption,
taxing authority, outstanding debt secured by revenues or general. obligation
of the City, obligations of the City to finance any deficits that may occur,
or receipt of significant subsidies from the City. Based on the foregoing
criteria, all funds and account groups of the City, except for the general
fixed asset group of accounts for which complete records are not maintained,
are included in the City's financial statements.
NOTE B --SIGNIFICANT ACCOUNTING POLICIES
The accounting policies of the City summarized below conform to generally
accepted accounting policies for governmental entities, except that complete
records are not maintained for fixed assets.
Basis of Presentation: The financial transactions of the City are recorded
in individual funds and account group. The various funds and account group
are reported by type in the financial statements. Amounts in the "Totals

(Memorandum Only)" columns in the financial statements represent a summation
of the combined financial statement line items of the fund types and :account

group _and. are presented only for analytical purposes. The summation.`
includes fund types and the account group that. use different ;bases .of
accounting, both restricted and unrestricted amounts, interfund transactions

that have not been eliminated, and the caption "amount to be provided,"

Sales and Use Taxes: The City receives an allocation of sales and use taxes
from the State of California monthly and recognizes the revenues when

received. The City receives 1% of the 6% sales tax assessed within City
limits.

Grants and Other Governmental Revenues: On grants, where expenditure of
funds is the prime factor for determining earnings of grant funds, the
receivable and revenue are recognized when the expenditures have been

incurred. Amounts due from other governmental agencies and the related
revenue thereon are recorded when earned.

Interfund Transactions: During the course of normal operations the City has

numerous transactions between funds, including expenditures and transfers of

The total amount of grants available was approximately $2,184,000 with

$1,101,300 of revenues earned through June 30, 1986. Grants receivable at
year-end amounted to $676,000. The amount of grants available for future
use at June 30, 1986 was $605,000.
NOTE ll --EMPLOYEE BENEFIT PLANS
The City participates in the State of California's Public Employees'
Retirement. System (PERS), which covers substantially all employees, except
elected officials and those compensated on an hourly basis who were hired
after May 31, 1966. The City'stotal contributions to PERS for the year

were approximately $1,573,000. Information is not available as to the
excess, if any, of the actuarially -computed value of vested benefits over
the total assets of the retirement fund.
The City's deferred compensation plan has assets and liabilities totaling
$2,955,814 as of June 30, 1986 recorded in an expendable trust fund. The

deferred compensation plan is a contributory deferred contribution plan that
covers substantially all eligible employees` and provides retirement and
death benefits.

because adequate insurance is not available in the commercial insurance
market.
The ultimate cost of the program to the City.will depend oa the catastrophic
losses of all the members, as well as the City's :own loss experience, and

program year. The City pays deposits to the California JPIA each year.
These deposits are recorded as expenditures in the year paid as they are a
reasonable estimate of.the actual cost of the program.
During the year ended June 30, 1986, tctal amounts paid to the California

NOTE I--COMMITMENTS AND CONTINGENCIES

The City is involved in various litigation which arose during the normal
course of operation. The amount of possible loss cannot; be reasonably
estimated, but, management believes that any loss incurred as a`result of ,
current litigationwillhave an immaterial effect on the City's financial
position.
At June 30, 1986, the City had a commitment to purchase Government National

Mortgage Association Certificates in the amount of $2,050,000 with various
maturities from ;2001 to 2016. The Certificates were settled subsequent to
