FROM: THE CITY MANAGER'S OFFICE 0-MBER 15, 1986 SUBJECT: PUBLIC HEARING TO CONSIDER REQUEST FOR ONE YEAR EXMZION ON EAST SIDE BUILDING MORATORIUM At the November 6, 1985 Coupcil Meeting, Council adopted Ordinance No. 1369 - An Urgency Ordinance of the City Council Establishing a Building Moratorium on Conversion of Single -Family Hanes to Multiple -Family in Certain Defined Areas Pursuant to State of California Government Code Section 65858 which Ordinance according to State statute was effective for 45 days from the date of its . passage. (See Exhibit A attached) On December 4, 1985 a Public Hearing regarding the matter was held pursuant to State statute. Following the receipt.of background information and public } testimony concerning the matter Council, by motion action, extended the moratorium 10 months and 15 days to provide time for consultants to prepare infrastructure and zoning studies. The firm of Jones and Stokes Associates, Inc. was retained to perform this task. Although the study is well under way, it will be necessary to extend the moratorium to complete this work. Section 65858 of the Government Code of the State of California allows the ordinance to be extended for one year. Such an extension requires a four-fifths vote for adoption. In reviewing the Code, the City Attorney and I concur that the extension would be based on the date of the adoption of the original ordinance. ' At its meeting of`Saptember 17, 1986, Council set this matter for hearing at the October 15, 1986 Regular Council Meeting. The notice of hearing -was duly published pursuant to State Statute and copies of the hearing notice were mailed under Declaration of Mailing to local building contractors and realtors. RECOWIMED ACTION: That Council introduced Ordinance No. 1394 extending for one year (to November 6, 1987) the east side building moratorium on conversion of single-family homes to Ru;itiple-family in certain defined areas pursuant to State of California Government Code Section 65858. Council was reminded that at its meeting of November 6, 1985, the Council declared a moratorium of apartment construction in certain portions of the older portion of the conTminity. This action was taken because of concern ! i that the existing infrastructure could not serve the densities permitted by the existing zoning classification and the loss of the single -family character of the 1 neighborhood. The purpose of this public hearing is to determine if that moratorium should be continued for 11 months in order to provide time for consultants to prepare infrastructure and zoning studies. These studies would direct Council toward the best solution to the problem. ' City Manager-Peterson introduced the subject. Special- pecialassessments assessmentsreceivable consist of deferred revenue since the amounts are not considered available under generally accepted accounting principles. The fund balance deficit of the special assessment fund arises because of the application of generally accepted accounting principles to the financial- inancialreporting reportingfor such funds. Bond proceeds used to finance construction of # special assessment. projects are not recognized as an "other financing <>h source." Liabilities for special assessment bonds payable are accounted for in the special assessment fund. The fund deficit will be reduced and '? eliminated as deferred special assessment installments are received. r Property Taxes: The City receives property tax revenues based on an '? allocation factor calculated by the County of San Joaquin under the provisions of Proposition 13. Sales and Use Taxes: The City receives an allocation of sales and use taxes from the State of California monthly and recognizes the revenues when r! < received. Grants and Other Governmental Revenues: On grants, where expenditure of funds is the prime factor for determining earnings of grant funds, the receivable and revenue are recognized when the expenditures have been Nz incurred. Interfund Transactions: During the course of normal operations the City has ''. numerous transactions between funds, including expenditures and transfers of resources -to provide services, construct assets, and service debt. NOTE C --GRANTS The total amount of grants available was approximately $2,184,000 with ii $1,101,300 of revenues earned through June 30, 1986. Grants receivable at year-end amounted to $676,000. The amount of grants available for future use at June 30, 1986 was $605,000. NOTE ll --EMPLOYEE BENEFIT PLANS The City participates in the State of California's Public Employees' Retirement. System (PERS), which covers substantially all employees, except elected officials and those compensated on an hourly basis who were hired after May 31, 1966. The City'stotal contributions to PERS for the year r=, were approximately $1,573,000. Information is not available as to the excess, if any, of the actuarially -computed value of vested benefits over the total assets of the retirement fund. The City's deferred compensation plan has assets and liabilities totaling $2,955,814 as of June 30, 1986 recorded in an expendable trust fund. Various public agencies formed the California JPIA for F the purpose of sharing the risk of catastrophic general liability, automobile liability and public officials errors and omissions losses because adequate insurance is not available in the commercial insurance market. The ultimate cost of the program to the City.will depend oa the catastrophic losses of all the members, as well as the City's :own loss experience, and '= will be determined retrospectively five years after the end of the current program year. The City pays deposits to the California JPIA each year. These deposits are recorded as expenditures in the year paid as they are a reasonable estimate of.the actual cost of the program.
