COUNCIL COMMUNICATION

SUBJECT: Order of Abandonment to Abwndon Portion of
Easement at lots 42, 33. 3i and 30 at Lakeshore Village. Unit No. 1
RECOMMENDED ACTION: That the City Council adopt an order of Abandonment to
abandon the easements above as shown on the attached map.
BACKGROUND INFORMATION: At the Council meeting of July 15. 1981. the City
Council pt a resolution of intent to abandon these easements and for-
warded it to the Planning Commission for their finding. The Planning Com-
mission determined that there was no public need, present or future, for
these easements.
PG&E, Pacific Telephone, Lodi Cable TV. and the City of Lodi Utilities, have
ali indicated they have no problem with this proposed abandonment since the
developer is p oviding alternate easements.

ORDER VACATING A PUBLIC UTILITY EASEMENT LOCATED
ON LOTS 42, 33, 31 AND 30 AT LAKESHORE VILLAGE,
UNIT NO. 1, LODI, CALIFORNIA
REAS, the City Council of the City of Lodi, acting
in accordance with the provisions ob Section 50430 et seq. of
the Government Code of the State of California, did on the 15th
day of. July, 1981, pass and adopt Resolution No. 81-92 therein
declaring the intention of said City Council to vacate a Public
Utility Easement located on Lots 42, 33, 31 and 30 at Lakeshore
Village, Unit No. 1, Lodi, California, and more particularly
described in said Resolution; and
WHEREAS, said matter has been referred to the Planning
Commission of the City of Lodi and a favorable recommendation
has been made by said Planning Commission to this City Council;
and
WHEREAS, notice of adoption of said Resolution of
Intention to Vacate was regularly given by publication in the
"Lodi Life and Times", a newspaper of general circulation
published in the City of Lodi, County of San Joaquin, and by
posting on the property, both in the time, form and manner as
required by law, and there are on file in the office of the
City Clerk affidavits showing the said publication and posting;
and
WHEREAS, in accordance with the Notice given in said
Resolution No. 81-92 a public hearing was held before said
City Council in the City Hall Council Chambers, City Hall,
Lodi, California, at 8:00 p.m. on August 19, 1981.
WHEREAS, at aforesaid time and place set for public
hearing no person appeared to object to the vacation of said
public easement; and
WHEREAS, the City Council of the City of Lodi did then
and there determine, at said public hearing, that the public
service easement described in said Resolution and more parti-
cularly hereinafter described is unnecessary for present or
prospective public use;
NOW, THEREFORE, IT IS HEREBY ORDERED, pursuant to the
foregoing findings and under the authority of Section 50430
et seq. of the Government Code of the State of California,
that there is hereby abandoned and vacated that certain public
service easement situated in the City of Lodi, County of San
Joaquin, State of California, more particularly described as
follows:

Reference is hereby made to a map or plan on file in f
the office of the City Clerk of the City of Lodi for the parti-
culars as to the proposed vacation.

I hereby certify that the forgoing ORDER VACATING A
PUBLIC UTILITY EASEMENT LOCATED ON LOTS 42, 33, 31
AND 30 AT LAKESHORE VILLAGE, UNIT NO. 1, LODI, CALIFOR-
NIA, was passed and adopted by the City Council of
the City of Lodi in a regular meeting held Wednesday,
August 19, 1981 by the following vote:
Ayes: Councilmen - Katnich, Murphy, Pinkerton and
McCarty
Noes: Councilmen - None
Absent: Councilmen - Hughes
