Home My WebLink AboutAgenda Report - July 15, 1987 PH (4)PUBLIC HEARING ON SIDEWALK INSTALLATION AT DEL RANCHO MOTOR INN, 501 NORTH CHEROKEE LANE Notice thereof having been published according to law, an affidavit of publication being on file in the office of the CC -45(e) City Clerk, Mayor Olson called for the public hearing to hear and pass upon objections or protests raised by the owner of the property on sidewalk installation at Dei Rancho Motor Inn, 501 North Cherokee Lane, Lodi. Following introduction of the matter by the City Manager, Public Works Director Ronsko apprised the Council that this public hearing was set to hear objections from the property owners required to install sidewalk on the Cherokee Lane frontage of their property at 501 North Cherokee Lane. On June 17, 1987, the City Council determined that sidewalk should be installed on the property fronting the Del Rancho Motor Inn. A Notice to Construct was sent to the property owners requiring sidewalk construction to start within 60 days. This is the only parcel on the west side of Cherokee Lane between Lockeford and Pioneer which does not have sidewalk. The State of California Streets and Highways Code requires that legislative bodies hear and pass upon objections at a public hearing set no sooner than 10 days after giving notice to the property owner. Notice was given on June 25, 1987. There being no persons in the audience wishing to address the Council regarding the matter, the public portion of the hearing was closed. i On motion of Council Member Reia, Hinchman second, Council overruled objections and determined that it is in the public`s best interest to have sidewalk at the subject location and ordered that the installation be made pursuant to the State of California Streets and Highways Code. �. �3�' � .•Gy "C > 'f � 3tiv. $k"%. Cherokee Lane, the City Council determined it was still in the public's best interest to have the sidewalk installed. This means that if you haven't started the construction of this sidewalk by August 25, 1987, this department will have the sidewalk installed. Following the procedures in the Streets and Highways Code, you will then be billed for this construction. If the bill is not paid within five days, it will become a lien on your property. This lien is then turned over to the Tax Collector for collection with your property taxes. As stated in the letter dated June 24, 1987, a licensed contractor must install your sidewalk and a no -cost encroachment permit should be obtained before the work is begun. Cherokee Lane Lodi, CA 95240 SUBJEM Installation of Sidewalk On June 17, 1987, the City Council determined that sidewalk should be installed along your property on Cherokee Lane since this is the only parcel in the block that does not have sidewalk. It is the Council's intent that this sidewalk be installed prior to the Grape Festival. As shown on the enclosed Notice to Construct, the City Council will hold a hearing on July 15, 1987, at 7:30 p.m. to hear any objections to the installation of the sidewalk. Receipt of this notice begins a 60 -day period in which the construction of the sidewalk must start. If construction has not started within that time, the City will hire a contr-jctor to do the work and you will be billed. If that bill is not pa -,d within the required time limit, the cost of the required sidewalk ',nstallation would become a lien on your r property. A licensed contractor must install your sidewalk. Before starting''the work, an Encroachment Permit should be obtained from the Public Works Department at City Nall. There is no cost for this permit and it can be picked up by either you or your contractor. Enclosed is a plan showing the exact location and realignment of the sidewalk to be installed.
