Reimche City Clerk CITY OF LODI 221 West Pine Street Lodi, California 95240 SUBJECT: VARIANCE PERMIT - A-81-18, REDUCE PARKING - 301 WEST LOCUST STREET Dear Mrs. Reimche: This letter will serve as our request to the City of Lodi to appeal the denial by the City of Lodi Planning Commission on the above variance permit. RE PACHE City Clerk RONALD M STE IN City Attorney RE: Variance Permit - A-81-18, Reduce Parking - 301 Hest locust St At its meeting of Mondry, June 8, 1981, the Lodi City Planning Commission determined that a Zoning Hardship did not exist and denied your request to further reduce the required off-street parking to permit the conversion of a garage into office space at 301 Hest locust Street in an area zoned R -C -P, Residential -Commercial -Professional. Section 27-15(e) of the Lodi Municipal Code (i.e. Zoning Ordinance) provides as follows: "Appeal. An applicant or person claiming to be directly and adversely affected by any action of the Planning Commission may, within five days (i.e. working days) after the action, file a written appeal with the City Clerk for transmittal to the City Council." If you wish to appeal the Planning Commission's action, your corres- pondence should be directed to hrs. Alice M. Mills Avenue At its meeting of Monday, June 8, 1981 the Lodi City Planning Commission, by a tie vote, failed to approve your request for a Variance to reduce the required 10 foot rear yard to 6 feet 6 inches to permit the addition to an existing dwelling at 246 N. Mills Avenue in an area zoned R-2, Single -Family Residential. Section 27-15(e) of the Lodi -Municipal Code (i.e. Zoning Ordinance) provides as follows: I'Appeal. An applicant or person claiming to be directly and adversely affected by any action of the Planning Commission may, within five days (i.e working days) after the action, file a written appeal with the City Clerk for transmittal to the City Council." Reimche, City Clerk Dear_ Sirs This letter will advise you that I wish to appeal the decision of the Planning Commission relative to the non -approval of my request for a variance. (Zoning variance - A-18-17 - Reduce Rear Yard, 246 N. stills Ave.) The City states that the sole purpose of any variance shall be to prevent discrimination. This is'exsctly'what I intend to prove to the City Council under this appeal. I believe the City is now liable for failing to approve the requeet.
