Council was apprised STREET AND TOKAY that notices to construct were sent to 14 property owners STREET, LODI requiring sidewalk construction to commence in front of their property within 60 days. The State of California Streets and Highway's code requires that legislative: bodies hear and pass upon objections at a public hearing set no sooner than 10 days after giving notice to the property owners. On May 7, 1986, the City Council adopted Resolution No. 86-71 requiring installation of sidewalks on the east side of Stockton Street between Vine Street and Tokay Streets. Mr. Gary Kroll, 17277 N. Cal Road, Lockeford, spoke both on his own behalf and on behalf of Rae Doyle as Stockton Street property owners protesting the requirement to install sidewalks, stating that Pacific Coast Producers would receive the majority of the benefit from these installations, and for that reason he felt it was unfair that the property owners would be responsible for paying for the improvements. Following the public hearing and discussion, the Council overruled the protests and ordered the installation of sidewalks in the subject area. Please be advised that earlier, Council had established alternatives for providing financial assistance for sidewalk installation in areas which meet the criteria for the expenditures of Co mmni.ty Development Block Grant Funds under certain conditions. We have enclosed a copy of the authorizing Resolution No. 86-83 for your information.. Notices to construct were sent to 14 property owners. requiring sidewalk construction to commence in front of their property within 60 days. The State of California Streets and Highway's code requires that legislative bodies hear and pass upon objections at a public hearing set no sooner than 10 days after giving notice to the property owner. Notice was given May 13, 1986. On May 7, 1986, the City Council adopted Res. 86-71 requiring installation of sidewalks on the east side of S±ockton Street between Vine and Tokay Streets. BACKGROUND INFORMATION: The City has let the Improvement for Stockton Street between Vine and Tokay Street to the Claude Woods Company. The underground work on this project has already started. At the last shirtsleeve session, the City staff reviewed with the Council the sidewalk deficiencies between Wee and Tokay Street. There are i4 parcels on the east side of the street which are deficient in sidewalk. On the west side, there is an area which does not have sidewalk, however, the walkway area Is paved with asphalt and contrete. The City of Lodi, as part of its widening, will be putting in the curb and gutter fronting all of these parcels, whether it exists now or not, wiii ae replacing any existing sidewalk at the new location and will be providing con- crete driveways for all of the residents. Per the Council's request, we have, by use of the Assessor records, determined which of the 14 parcels are owner- oecupied. .The following chart shows the address of the Stockton Street parcels deficient in sidewalk, the approximate cost based on the contractor's bid price (this does not Include any tree removal that might be necessary), and whether the parcel is owner -occupied or a rental. Note: An owner -occupied single family residence located on a parcel which also contains rental units does not qualify. 3. Eligible persons shall have the following options: a. Pay 100% of the cost of the sidewali•_ at the time of installation. b. Execute an agreement with the City providing for the granting by the City of a law -interest loan (3%) per annum to finance the sidewalk .installation. Such a loan would be subject to the following: i.it shall be paid off in five annual payments ii. It shall be paid off at the time of sale of the property if such sale occurs in less than five years iii. it shall be recorded C. Agree to placement of a lien on the property for the amount of the sidewalk installation plus 3% ner annum► b interest until such lien is retired.
