At the November 4, 1986 General Election the electorate amended the Land Use Element of the•General Plan by adding Maggio Industrial Park, a 37.6 acre industrial project located at the northwest corner of South Stockton Street and Harney Lane. On November 19, 1986, Council adopted Resolution No. 86-170 initiating annexation proceedings on the subject parcel. Following a public hearing regarding the matter held on January 16, 1987 before LAFCJO, the Local Agency Formation Commission of San Joaquin County determined and ordered the following:. 1. The Environmental Impact Report adopted by the City of Lodi as lead agency has been revie!�ed and considered, and a statement of overriding considerations is hereby adoptei. 2. The above entitled reorganization is approved subject to the tens and conditioz:s contained herein. MUM Resolution No. 694) 3. Attached is a copy of Resolution No. 694 before the Local Agency Formation Commission of San Joaquin County - Resolution Approving the Maggio Reorganization (LAFC 18-86) Including Annexation t.) the City of Lodi and Detachment from the Woodbridge Fire District (Exhibit B) On October 2, 1986, Council adopted Ordinance No. 1362 prezoning Maggio Industrial Park to M-2, Heavy.Industrial. Because the subject parcel is located adjacent to the Southern Pacific Transportation right-of-way, it was determined by LAF O that it would be more timely to authorize the City Council to initiate proceedings for uninhabited reorganization in accordance with Section 57000 et seg, of the Government Code which provides that, within 35 days following the adoption of the Candssion`s resolution making determinations, the clerk of the conducting authority shall set the proposal for hearing and give notice of that hearing by mail, publication, and posting. Affidavits of publication and posting and mailing are on file in the office of the City Clerk. At the February 4, 1987 Council adopted Resolution No. 87-24 - Resolution directing the City Clerk, pursuant to the State of California Government Code Section 57000 et seq., to set a Public Hearing March 4, 1987 at 7:30 p.,:i, to consider the Maggio Reorganization, including annexation to the City of Lcdi and detachment from the Woodbridge Fire District. The Environmental impact Report adopted by the City of Lodi as lead agency has been reviewed and considered, and a statement of overriding considerations is hereby adopted. 2. The above entitled reorganization is approved subject to the terms and' conditions contained herein. 3. The boundaries are hereby approved, said boundaries being set forth in Exhibit A. 4. The affected territory is uninhabited. 5. The City of Lodi is designated as the conducting authority and the City Council is authorized to initiate proceedings for uninhabited reorganization in accordanoe with Section 57000 et seq. of the Government Code. 6. Thee Executive officer is hereby authorized and directed to mail and file certified copies of this resolution as required by Section 56853 of the Government Code. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lodi does hereby direct the City Clerk, Pursuant to State of California Government Code Section 57000 et seq., to set a public hearing for Wednesday, 7:30 p.m., March 4, 1987, to consider the Maggio Reorganization 87-24 NOW, TH=URE, BE IT RESOLVED that the City Council of the City of Lodi does hereby direct the City Clerk, pursuant to State of California Goverrunent Code Section 57000 et seq., to set a public hearing for Wednesday, 7:30 p.m., March 4, 1987, to consider the Maggio Reorganization including annexation to the City of Lodi and detachment from the Woodbridge Fire District. The subject Public Hearing will be held in the Chambers of the Lodi City Council at 221 West Pine street, Lodi, California. SECTION II: RESOLVED BY THE CITY COUNCIL OF THE CITY OF LODI: a) That each of the changes in the organization contained in the proposal for reorganization is ORDERED without an election, pursuant to Government Code Section 56439 (c).
