Hutchins Street RECOMMENDED ACTION: That the City Council take appropriate action after receiving public testimony. Possible actions include: 1. Determine it is in the public's best interest to have sidewalk installed at this location and overrule the property owner's objections to installing the sidewalk. 2. Determine that the sidewalk installation i s not needed at this time. BACKGROUND INFORMATION: This public hearing was set to hear objections from the property owner required to install sidewaik on the property at 1000 S. Hutchins Street. In March 1985, the City Council determined that sidewalk should be installed on developed lots where none presently exists on all major street reconstruction projects. This property i s the only one within the Hutchins Street Improvement Project that does not. have sidewalk. A Notice to Construct was sent to the property owner requiring construction to begin within 60 days and giving them the time and date of this public hearing. The State of California Streets and Highways Code requires that legislative bodies hear and pass upon objections at a public hearing set no sooner than ten days after giving notice to the property owner. This means you have until October 24, 1988 to commence construction of the sidewalk on your property. If by that time you have not begun construction, the Public Works Department will be required to have the sidewalk installed and the work performed by its contractor, following the procedures of the Streets and Highways Code. This would mean a lien on your property for the cost of the work involved. As stated in the letter dated August 5, 1988, and as discussed with your son at City Ha 1 i , a licensed contractor must install your sidewalk and a no -cost encroachment permit should be obtained before the work is begun. CitV Attomev In Nojember 1985, you were notified that the City was in the process of designing the street im>orovements on Hutchins Street from Rimby Avenue to Vine Street and that the City Council had determined that the property owners would be asked to install sidewalk where there was none existing on all street improvement projects. As you know, this project is now well underway and since your property is the or, l y property without sidewalk within the project limits, it is requested that this sidewalk be installed. The work should be done by a licensed contractor of your choice and an Encroachment Permit, available in the Public Works office at City Hail, is needed before starting the work. There is no fee for the permit. There will be a public hearing held on September 7, 1988 to give you an opportunity to Protest the decision of the Council regarding this installation. In confarmance with the Streets and Highways Code, ten days prior to that hearing you will receive a Notice to Construct. This notice begins a 60 -day period when the sidewalk installation must start. If the Council reaffirms its decision that sidewalks must be installed at the public hearing, you will have 50 days remaining to begin that installation.
