COUNCIL COMMUNICATION
AGENDA TITLE: Consider the Bennett and Compton Reorganization, including
annexation to the City of Lodi and detachment from certain
districts as approved by the Local Agency Formation Commission
(located north of Eilers Lane, and bounded by Lilac Street on the
east, Woodbridge Irrigation District Canal on the north and
Woodhaven Lane on the west).
MEETING DATE: June 3, 1992

RECOMMENDED ACTION: that the City Council conduct a public hearing to
consider completion on the Bennett and Compton
Reorganization including annexation to the City of Lodi
and detachment from certain districts as approved by the Local Agency Formation
Commission (located north of Eilers Lane and bounded by Lilac Street on the east,
WID Canal on the north and Woodhaven Lane on the west).
BACKGROUND INFORMATION: This public hearing is required because LAFCO added three
parcels to the original City Council initiation. The
area was added to make the annexation in conformance
to LAFCO policy and provided for more orderly growth.
The two parcels which receive sewer service from the Woodbridge Sanitary District
will continue with that service until City sewers are available. Upon connection to
City sewer service, LAFCO will detach the area from the Sanitary District.
The Bennett and Compton portion of the annexation has been prezoned for
multiple -family units and bas received Growth Management Allocations for 144 units.
FUNDING: None required.

We hereby transmit a certified copy of this Commission's Resolution
No. 857 approving the above entitled proposal and authorizing the
City of Lodi to conduct subsequent proceedings.
Upon successful completion of subsequent proceedings, your agency
must request that LAFCo execute and file a Certificate of
Completion and Statement of Boundary Change. Such request must be
accompanied by six certified copies of your resolution ordering the
boundary change and a check payable to the State Board of
Equalization covering its filing fee of $ 160.00. Please note that
the State Board of Equalization charges an additional 10% for
statements filed during the month of December.

COUNTY RESOLUTION APPROVING PROPOSED BENNETT/COMPTON
REORGANIZATION (LAFC 3-92) Including Annexation To The city Of
Lodi And Detachment From The Woodbridge Fire District. Tho
Woodbridge Lighting District, And Tho SJC Resource Conservation
District
WHEREAS, the above entitled proposal was initiated uy
resolution of the City of Lodi. and on Harch 16, 1992. the
Executive Officer certifiedthe application filed for processing in
accordance with the Local Government Reorganization Act: and,
WHEREAS. the Commission held a public hearing on the proposed
reorganization on April 17, 1992. in the Board of Supervisors
Chambers, County Courthouse. pursuant to notice of hearing which
was published, posted and mailed in accordance with State law; sr+d.
WHEREAS, at said hearing the Commission heard and received
evidence. both oral and documentary, submitted in favor of and in
opposition to the proposed reorganization and all persons Present
were given and opportunity to he heard.
NOW THEREFORE. the Local Agency Formation Commissicn of r
Joaquin County DOES HEREBY RESOLVE, DETERMINE, AND OROE11 aL

Section t. The Negative Declaration adopted by the city
Lodi, as lead agency, was reviewed and Considered.
Section 2. The above entitled reorganization is avorov•,

A portion of the south half of Section 34, Township 4 North,
Range 6 East, Mount Diablo Base and Meridian, more particularly
described as follows =
Beginning at the southwest corner of the northwest quarter
of the southeast quarter of said Section 34, said corner being
the northwest corner of WOODLAKE NORTH, UNIT NO. 2 (the map or
plat of which is filed in Book of Official Maps and Plats,
Volume 27, page 52, San Joaquin County Records), and also being
on the Lodi Citcy Limit line; thence easterly along said City
Limit line, being along the south line of said northwest quarter
of the southeast quarter of Section 34, and also being along the
north line of said WOODLAKE NORTH, UNIT NO. 2, a distance of
650.92 feet to intersection with the east line of Lilac Street
(60 feet wide); thence leaving said City Limit line and running
along said east line the following three (3) courses: (1) North

Sectign 1,, RESOLVED, BY THE LODI CITY COUNCIL that it determines:
a) Preliminary proceedings for the annexation of certain
described territory to the City of Lodi and detachment from the
Woodbridge Fire District, the Woodbridge Lighting District, and
the San Joaquin County (S.J.C.) Resource Conservation District
were initiated by the filing of the City of Lodi's Resolution Nr,.
92-36 with the Local Agency Formation Commission in the County of
San Joaquin, proposing annexation, of 12 acres more or less of
property (located north of Eilers Lane and bounded by Lilac
Street on the east, the Woodbridge Irrigation District Canal on
the north and Woodhaven Lane on the west) pursuant to the
requirements of the Local Government Reorganization Act.
b) Thereafter, appropriate proceedinge were conducted by said
Local Agency Formation Commission, and on March 16, 1992, the
Executive Officer certified the application an,l on April 17,
1992, said Commission adopted Resolution 857 approving the
proposed annexation subject to the terms and conditions set forth
within the subject resolution, with the following condition:
Whenever City sewer service is provided to the two
parcels nor served by the Woodbridge Sanitary
District, the City of Lodi shall file an application
with LAFCO to detach the overlapped territory from
the Dietrict.
c) Resolution No. 857 of the Local Agency Formation Commission
approving the proposed annexation also authorized the City of
Lodi to complete proceedings for uninhabited reorganization
with notice au -,d hearing, as the designated conducting authority
in a^cordance with Section 57000 et seq. of the Government Code

d) On May 6, 1992, the Lodi City Council adopted Resolution. No.
92-86 directing the City Clerk, pursuant to Government Code
Section 57000 et seq., to set a public hearing for the regular
City Council meeting of June 3, 1992 at 7:30 p.m. to consider the
Bennett/Compton reorganization, and detachment from the
Woodbridge Fire District, the Woodbridge Lighting District, and
the S.J.C. Resource Conservation District; The appropriate
advertising and mailings were made pursuant to State statute.
e) On June 3, 1992, a public hearing was held pursuant to
Government Code Section 57000 et seq., and as directed by
Resolution 92-86 described in subsection d) above.
,Section 2. BE IT FURTHER RESOLVED, BY THE LODI CITY COUNCIL:
That the proposal for annexation is ORDERED in accordance with Sect". on
57000 et seq. of the Government Code of the State of California, to wit:
1. Bennett/Compton Addition (contiguous) annexation to the
City of Lodi, subject to the following condition:
Whenever City server service is prwided to the two parcels
now aerved by the Woodbridge Sanitary District, the City
of Lodi shall file an application with LAFCO to detach the
overlapped territory from the District.
2. Detachment of Bennett/Compton Addition from the Woodbridge
Fire District, the Woodbridge Lighting District, and the
San Joaquin County (S.J.C.) Resource Conservation District.
3. A description of said territory is attached hereto
(Rxhibit A) and made a part hereof.

A RESOLUTION OF THE LODI CITY COUNCIL
DIRECTING THE CITY CLERK, PURSUANT TO STATE OF CALIFORNIA GOVERNMENT
CODE SECTION 57000 ET SEQ. TO SET A PUBLIC HEARING TO CONSIDER THE
"BENNETT/COMPTON ADDITION" ANNEXATION/REORGANIZATION, INCLUDING
ANNEXATION TO THE CITY OF LODI AND DETACHMENT FROM THE WOODBRIDGE FIRE
DISTRICT, THE WOODBRIDGE LIGHTING DISTRICT AND THE SJC RESOURCE
CONSERVATION DISTRICT.

WHEREAS, the above -entitled proposal for the "Bennett/Compton
Addition" Reorganization, including annexation to the City of Lodi and
detachment from the Woodbridge Fire District, the Woodbridge Lighting
District and the SJC Resource Conservation District was initiated by
the City of Lodi with adoption of Resolution No. 92-36 entitled "A
Resolution of the Lodi City Council For Application to the San Joaquin
County Local Agency Formation Commission in the Matter of the Proposed
"Bennett and Compton Addition, Including the Detachment of Certain
Territory Within the Area Proposed For Annexation to the City of Lodi"
on March 4, 1992, and on March 16, 1992, the Local Agency Formation
Commission of San Joaquin Executive Officer certified the application
filed for processing in accordance with the Local Government
Reorganization Act; and
WHEREAS, follwing a public hearing regarding the matter held on
April 17, 1992 , the Local Agency Formation Commission of San Joaquin
County adopted Resolution No. 857 - "A Resolution Approving Proposed
Bennett/Compton Reorganization (LAFC 3-92) Including Annexation to
the City of Lodi and Detachment from the Woodbridge Fire District, The
Woodbridge Lighting District, and the SJC Resource Conservation
District", determining and ordering the following:
Section 1. The Negative Declaration adopted by the C-ty of Lodi, as
lead agency, was reviEwed and considered.
Section 2. The above entitled reorganization is approved subject to
the following condition:
A. Whenever city sewer service is "provided to the two
parcels now served b•,! the Woodbridge Sanitary District, the
City of Lodi shall file an application witn LAFCO to detach
the overlapped territory from the District.
Section 3. The boundaries are hereby approved as submitted, said
boundaries being set forth in Exhibit A.
Section 4. The affected territory is uninhabited.
Section 5. The City of Lodi is designated as the conductinq authority
and the City Council is authorized to initiate proceecincs
for uninhabited reorganization in accordance with Section
57000 et seq. of the Government Code.
Section 6. he Executive Officer hereby ae:thorizer and directec to
mail and file certified copies of this resolution as
required by Section 56853 of the Government Code.
NOW, THEREFORE, RE IT RESOLVED, that the Lodi City Council does
hereby direct the City Clerk, pursuant to State of California
Government Code Section 57000 et seq. to set a public hearing for
Wednesday, June 3, 1992 at 7:30 p.m. to consider the Bennett/Compton
Reorganization including annexation to the City of Lodi and detachment
from the Woodbridge Fire District, the Woodbridge Lighting District,
and the SJC Resource Conservation District".
