AGENDA TITLE: Agreement for Right -of -Way Acquisition at 211 South Hutchins Street
MEETING DATE: August 6, 1997

RECOMMENDED ACTION: That the City Council authorize the City Manager and City Clerk to
execute the right-of-way agreement for 211 South Hutchins Street and
appropriate street funds to pay for this acquisition and title costs.
BACKGROUND INFORMATION: In 1990, the City had six parcels appraised and began negotiations
with the property owners of the west side of Hutchins Street
between Lodi Avenue and Walnut Street to acquire 10 feet of their
property for the eventual widening of Hutchins Street. Only one
property owner sold the 10 -foot strip needed for the proposed widening project at that time. Because
funds were not available for the project itself and the final design of the street was not complete, the City
did not pursue the acquisition of the other parcels. Since that time, the City has acquired two other
parcels in this block of Hutchins Street.
The property owners at 211 South Hutchins Street have now agreed to grant the right of way for a total
of $7,850. This covers payment for the appraised amount of the land and the improvements in the right
of way that will be removed during construction. This payment also includes an amount for noise
mitigation. This house is now for sale and if we purchase from the present owner, we won't have to get
a new appraisal when the property changes ownership.
With this recent acquisition, shown shaded on Exhibit A, the rights of way on four of the six parcels in
this block have been acquired. We feel it is in the City's best interest to purchase the property at
211- South Hutchins Street at this time.
