HomeMy WebLinkAboutAgenda Report - May 7, 2003 G-01 PHCITY OF LODI COUNCIL COMMUNICATION AGENDA TITLE-, Public Hearing to Consider Resolution/Order to Vacate the East 200 Feet of the Alley West of Central Avenue and North of Oak Street MEETING DATE: May 7,2003 PREPARED BY-, Public Works Director RECOMMENDED ACTION: That the City Council, after reviewing the findings of the Planning Commission, conduct a public hearing and take the appropriate action on the Resolution/Order to Vacate the east 200 feet of the alley west of Central Avenue and north of Oak Street. BACKGROUND INFORMATIONAt its regular meeting of March 19, 2003, the City Council adopted a resolution of intention to vacate the east 200 feet of the alley west of Central Avenue and north of Oak Street, reserving, however, and excepting from the vacation, a permanent easement and right therein to construct, maintain, repair and operate lines for public utilities, in and across the vacated alley alignment, and referred the matter to the Manning Commission, The 200 feet of alley proposed for abandonment currently separates the Joe Serna, Jr,, Charter School from the Lodi Unified School District (LUSD)-owned parking lot. The abandonment of the alley will allow safe pedestrian access between the classrooms and parking lot and allow the school site to be fenced for security purposes. The expansion plans for the school site include a Headstart preschool and portable classrooms on the north side of the existing alley, as shown on Exhibit A. LUSD will dedicate a 25 -foot strip of land along the west boundary of the school site, south of the existing alley, to provide alley access from Oak Street, as shown on the attached Exhibit B. LUSD will also construct and i-naintain a 6 -foot masonry wall along the west side of the proposed alley to separate vehicle traffic from the adjacent residence. The masonry wall will be located on LUSD property. Since the existing alley is currently necessary to provide access to alley residences and service vehicles, the actual order to vacate the existing alley will not be filed until the new alley alignment right-of-way has been dedicated and all alley improvements have been completed and accepted by the City. In response to a letter frorn Mr, and Mrs. Glen Blehm (copy attached), LUSD staff met with concerned property owners at the school site to address their concerns and explain the proposed on-site vehicular circulation at the school site that has been designed to lessen alley traffic and on -street activity. The Planning Commission at its April 23, 2003, meeting, held a public hearing to determine the public need, present m- future, for this alley, The Planning commission determined the vacation and realignrnent of the proposed alley is consistent with the City General Plan, and the abandoned portion of APPROVED-, ;'7,H. 4D Jx o P Public Hearing to Consider Resolution/Order to Vacate the East 200 feet of the Alley West of Central Avenue and North of Oak Street May 7, 2003 Page 2 the public alley no longer serves a public purpose due to the alley realignment to Oak Street. The Commission is providing their findings to the City Council for the May 7 public hearing, Pacific Gas & Electric Company, SBC, Comcast (formerly AT&T Broadband) and the City of Lodi Electric Utility Department, and Street and Water/Wastewater Divisions have approved the abandonment of the east 200 feet of the alley. The City Electric Utility Department has advised that the relocation of'a street light necessitated by the abandonment will be at the expense of the developer. FUNDINGNot applicable. Has anybody on the City Council or Planning Commission checked out the Currant congestion alt the east tl end of the 300 block of Fast Oak Street? If you vacate the east 204 feet of the existing alley and re-route the cars from the alley onto Oak Strect, you're gadding more traffic to a street that is already congested with traffic. Most of the cars its the alley (and there are many) belong to residents living on East Pine Street. It's very obvious when you drive down the alley. Many homes in this area do not have driveways and residents =nust park their cars in the alley or on the street Horner-wners residing at the east egad of the 300 blocky of East Oak Street currently deal with east and west bound Gripe Uric Bias traffic. The buses travel bath ways on Oak Street approximately 3 times every hour. Plias, there are two blas stops at the conter of East Oak and Cetiml Avenue that stop traffic and increase the Congestion, In addition to the bus traffic, parents drop-off and pick-up children at Charter Elementary School, also located at the east end of the 300 knock of East Oak Street. 'When parents drop-off and pick -tip their children, they often block driveways, park in the middle of Lhc street (two cars .deep), park in residents` driveways, and travel in reverse to escape the congestion. The children run across the street and run fror behind parked cars which is very dangerous (and at the same time, the Grape Line Bus goes by), Furthermore, teachers from Charter Elementary School park on the street all day with no regard for the residents who don't have off street parking. On Sundays there are church services and the worshipers also park tin the street and block driveways (and at the sante time, the gape kine Bus goes by), Tho 300 block of east Oak Street, especially the east end of the block (where tiro alley traffic )ell] eater per Resolution _No. 2003-47), is already overused, congested and at tunes dangerous. Box 406 Lodi, CA 95241-1910 WHEREAS, this City Council, acting in accordance with provisions of Part III of Division 9 . of the Streets and Highways Code of this State, did on the 19th day of March, 2003, pass and adopt Resolution of Intention No. 2003-47 therein declaring the intention of said City Council to vacate the east 200 feet of the alley west of Central Avenue and north of Oak Street, Lodi, California, County of San Joaquin, State of California, at the time of completion and acceptance by the City of the realigned alley improvements south of the existing alley, reserving, however, and excepting from the vacation, a permanent and right therein to construct, maintain, repair, and operate lines for public utilities, in, over, and across said vacated alley alignment, and more particularly described as follows, to wit: The east 200 feet of the alley west of Central Avenue and north of Oak Street, Lodi, California, as shown on Exhibit A attached. WHEREAS, said notice of said intended vacation was regularly given by publication and by posting, both in time, form, and manner as required by law as is evidence by affidavits on file and on record in the office of the City Clerk of the City of Lodi; and WHEREAS, in accordance with the provisions stated herein and also contained in the posted notices of the adoption of said resolution, notice was given that a public hearing would be held before the City Council in the City Council Chambers, Carnegie Forum, 305 West Pine Street, Lodi, California, beginning at 7:00 p.m. on Wednesday, May 7, 2003, where and when any person interested in or objecting to said vacation could appear and be heard in relation thereto; and WHEREAS, at that time and place, a public hearing was held and conducted and testimony received for and against the vacation contemplated; and WHEREAS, at the May 7, 2003, City Council meeting, from the evidence submitted, the City Council of the City of Lodi did determine that the east 200 feet of the alley west of Central Avenue and north of Oak Street, Lodi, California, will be unnecessary for present or future public use when the realigned alley improvements south of the existing alley are completed and accepted by the City and did so find and declare; and WHEREAS, the Planning Commission did find that the subject vacation was consistent with the General Plan of the City of Lodi. NOW, THEREFORE, BE IT RESOLVED that pursuant to the findings and under the authority of Section 8323 of the Streets and Highways Code of the State of California, that the east 200 feet of the alley west of Central Avenue and north of Oak Street, Lodi, California, and more particularly described below shall be abandoned upon completion and acceptance by the City of the realigned alley improvements: The east 200 feet of the alley west of Central Avenue and north of Oak Street, Lodi, California, as shown on Exhibit A attached hereto. Reserving, and excepting from the vacation, a permanent and right therein to construct, maintain, repair, and operate lines for public utilities, in, over, and across said vacated alley alignment. Reference is hereby made to a map or plan an file in the office of the City Clerk of the City of Lodi for the particulars as to the proposed vacation. Lodi, CA 95241-1910 WHEREAS, this City Council, acting in accordance with provisions of Part ltl of Division 9 of the Streets and highways Code of this State, did on the 19th day of March, 2003, pais and adopt Resolution of Intention No. 2003-47 therein declaring the intention of said City Council to vacate the east 2 0 feet of the alley west of Central Avenue and north of Oak Street, Lodi, California, County of San Joaquin, State of California, at the time of completion and acceptance by the City of the realigned alloy improvements south of the existing alley, reserving, however, and excepting from the vacation, a permanent and right therein to construct, maintain, repair, and operate limes for public utilities, in, over, and across said vacated alley alignment, and more particularly described as follows, to wit; The east 200 foot of the alloy vest of Central Avenue and north of Oak Street, Lodi, California, as shown on Exhibit A attached. WHEREAS, said notice of said intended vacation was regularly give by publication and by posting, bath in time, form, and manner as required by law as is evidence by affidavits on file and on record in the office of the City Merit of the City of Lodi; and WHEREAS, in accordance with the provisions stated herein and also contained i the pasted notices of the adaption of said resolution, notice was given that a public hea.ring would be held before the City Council in the City Council Chambers, Carnegie Forum, 305 West fine Street, Lodi, California, beginning at 7:00 p.m. on Wednesday, May 7, 2003, where and when any person interested in or objecting to said vacation could appear and be heard in relation thereto; and WHEREAS, at that time and place, a public hearing was held and conducted and testimony received for and against the vacation contemplated; and WHEREAS, AS, at the May 7, 2003, City Council meeting, from the evidence submitted, the City Council of the City of Lodi did determine that the east 200 feet of the alley west of Central Avenue and north of Oak Street, Lodi, California, will be unnecessary for present or future public use when the realigned alley improvements south of the existing alley are completed and accepted by the City and did so find and declare; and WHEREAS, the Planning Commission did find that the subject vacation was consistent with the General Plan of the City of Lodi. NOW, THEREFORE, BE IT RESOLVED that pursuant to the findings and under the authority of Section 8323 of the Streets and Highways Code of the State of Califomia, that the east 200 feet of the alley west of Central Avenue and north of Oak Street, Lodi, California, and more particularly described below shall be abandoned upon completion and acceptance by the City of the realigned alley improvements: The east 200 feet of the alley west of Central Avenue and north of Oak Street, Lodi, California, as shown on Exhibit A attached hereto. Reserving, and excepting from the vacation, a permanent and right therein to construct, maintain, repair, and operate lines for public utilities, in, over, and across said vacated alley alignment. Reference is hereby made to a map or plan on file in the office of the City Clerk of the City of Lodi for the particulars as to the proposed vacation.
