HomeMy WebLinkAboutAgenda Report - March 5, 2003 G-03 PH4DCITY OF LODI TL COMMUNICATION AGENDA TITLE: Public blearing to Consider Adopting Resolution Approving the Stormwater Management Program (SMP) and Authorizing the City Manager to Submit the Program to the Regional Water Quality Control Board (RW CB) MEETING DATE_ March 5, 2003 PREPARED Public Works Director RECOMMENDED ACTI N: That the City Council conduct a Public Hearing to consider adopting a resolution to approve City of Lodi's Stormwater Management Program (SMTP) as prepared by Black & Veatch Corporation and. authorize the 'City ; tanager to submit a Notice of Intent ( OI) to the Regional Water Quality Control Board ( W C ) for coverage under the State's General Permit for the National Pollutant Discharge Elimination System ( IPI E) Phase 11 Permit Application. BACKGROUND INFORMATION: The State of California Water Resources Control Board, in compliance with Federal mandates, will require uire the City of Lodi, as well as ether cities and entities, plus construction sites disturbing one or more acres, to obtain NPDES Phase 11 Stormwater permits by March 10, 2003. The current application cast is $7,500, which is also the annual permit cosi for populations between 50,000 and 74,999. Under the jurisdiction of the Central Malley Regional Water Quality Control Board, the State has developed a general storrnwat r permit, under which agencies required to have a permit would submit a Notice of Intent to apply for coverage. An alternative would be to seek coverage minder another entities' permit, such as San Joaquin County (Exhibit A). Staff proposes to apply for coverage under the permit. The City will have five years to implement a stormwater program that will meet general Phase li requirements. Background on these requirements was presented to Council at the March 26, 2002, Shirtsleeve Session. Ivey to the Notice of Intent is the Stormwater Management Plan which must be submitted with the Notice_ The City. has hind Mack & Veatch Corporation as a consultant to assist the City with the preparation of a Stormwater ter nagement Program and other documentation necessary for obtaining an NPOES Phase 11 permit. They have been working with the City on this project since May 2002. As. intended and previously stated in the March 20, 2002, Council Communication, the City worked with Mack & Veatch in utilizing existing materials for completion of this work. Mack & Veatch has completed the necessary tasks listed below: 1. Summary of existing system, maintenance practices, and municipal code 2. Determine RVV CE requirements and prepare written summary 3. Facilitate establishing goals and objectives 4. Prepare Stormwater Management Program 5, prepare NPDES permit of Intent and related forms 5, Estimate cost of stormwater management activities and five-year implementation - Details can be found on pages 11-41 through 11-43 under the Program Cost Summary section of the City's Stormwater Management Program and will be included in the next budget. GCSMP NO3 011,9143 Public Hearing to Consider Adopting Resolution Approving the Stormwater Management Program (SMP) and Authorizing the City Manager to Submit the Program to the Regional dater Quality Control Board (RC) !arch 5, 200 Page Black & Veatch has also assisted in the development of the City's Best Management Practices (BMP), Found in the appendix of the SMP, these practices have been developed to assist the City in maintaining our stormwat r Management Program and can be used as a source of information. Although having the BMP in place is required by the RWQCB, the suggested practices are not mandatory and are provided as optional guidelines when dealing with and managing storm.water issues. City staff will develop a. tormw ter Team that will be responsible for updating these practices by improving development standards and by improving our own construction specifications. Since specific practices ar reit. mandatory, the BMP will be reviewed and/or edited as needed due to technology changes and according to the effectiveness of each practice while managing the City's stormwater program. California's implementation of the Federal requirements has been delayed due to a recent Federal Court decision. (See attached fact s eet, Exhibit .) One of the issues was the lack of required public input in adopting the SMP. Thus, staff is conducting a public hearing on this item. A copy of the Stormwater Management Program was included in the Council's February 5, 2003, packet. Additional cosies are available at the Public Works Department on request and will be pasted on the City's website. No, the Small MS4 Permit item was removed from the agenda in light of the recent Stn �r Et, ttct._g Ap kpls q��ci ion,.. The State Water Resources Control Board has decided to delay issuance of the Small M 4 Permit, The Decision may require revisions to the application requirements for the Permit, and the State Board is awaiting information from the U. U.S. Environmental Protection Agency regarding compliance with the decision. It I am an automatically designated Small MS41, must I still comply with the March 10, deadline? The. existing Phase 2 regulations, which were upheld in the Decision, require that automatically designated mall M84s M84apply for coverage under an. NPDES permit by. March 10, 2003. (A list of MS4s In urbanized areas can be found in r�ttAoriment,1 of the draft general permit.) The State Beard may not adapt a general permit fear small M4s by that date. Small M a4s may choose to submit are NOI package by that date, even though there may not be an adopted permit or an adopted NOI form. If Small M 4s do file an NOl form, we recommend they use the form in the draft permit. Glick here for the recommended form. As a reference; the draft general permit provide a framework for the S MP. What is to be included in an NOI package? An NOpackage must include a completed and signed NON farm, a complete SWMP, and the appropriate free based on the current ee_Sc'hedule . In accordance with the Fee Schedule school districts are not required to submit the fee. As a reference the d_ raft gpner i permit provides a framework for the SWIVIP, Wast do you mean ycomplete. SWMP? It is not anal ipated that the VVM:P b fully implemented upon submittal with the Not. It is also recognized that the inti l SWMP may not be complete. However, it is the intent of this draft general permit that the SWMP that will be submitted with the NOI contain sufficient information such that Regional Board staff and interested parties understand the BMPS that will be implemented immediately or the BIVIPs that will be developed and implemented over the course of the Permit term. It is also expected that the initially submitted SWIVIP will contain measurable goals, schedules, and assignment of responsible parties for each IMP its required in the f=ederal regulations,. it is anticipated that the SWMP initially submitted may be revised or modified at the direction of the Executive Officer of the appropriate Regional Board based on the findings of regional Bard staff's review of the SWMP. Those MS4s lac ated wfthill urbanized areas as defined in the latest DecenniaI Census by the Bureau of the Census currently the 2000 Census. These areas are listed in Attachment 1 of the draft general permit. 2.
