COUNCIL COMMUNICATION
AGENDA TITLE: Public Hearing to Consider Helmle Reorganization, Including
Annexation to the City of Lodi and Detachment from Certain Districts
as Approved by the Local Agency Formation Commission (Bounded by the
Woodbridge Irrigation District Canal on the North and East; Kettleman
Lane (State Route 12) on the South and Lower Sacramento Road on the
West
MEETING DATE: November 17, 1993

RECOMMENDED ACTION: That the City Council conduct a public hearing to
consider Helmle Reorganization, including annexation to
the City of Lodi and detachment from certain districts as
approved by the Local Agency Formation Commission (Bounded by the Woodbridge
Irrigation District Canal on the North and East; Kettleman Lane (State Route 12) on
the South and Lower Sacramento Road on the West.
BACKGROUND INFORMATION: The Helmle Reorganization consists of 22 parcels and
contains 108 acres. Owners of 16 of the 22 parcels (i.e.
73%) have filed written requests for annexation to the
City. No one has thus far filed a protest. Since it was not 100% owner request for
annexation, the Local Agency Formation Commission could not waive hearing and notice.
At its meeting of July 7, 1993, the City Council adopted Ordinance No. 1579
prezoning the area encompassed by the Helmle Reorganization. The prezoning consists
of a 300 -foot strip of R -C -P, Residential -Commercial-Professional, zoning along the
Kettleman Lane frontage; R-1, Single Family Residential, adjacent to the Sunwest
Subdivision; and R-2, Single Family Residential, on the remaining area.
The City Council adopted Resolution 93-93 initiating the annexation/reorganization
proceedings at its meeting of August 4, 1993.
The Local Agency Formation Commission approved the reorganization on September 24,
1593, with t:,e condition that the approval be subject to the following:
"The City's resolution completing the reorganization shall state that
the affected territory will remain within the countywide boundary of
County Service Area No. 53, Household Hazardous Waste Management."

We hereby transmit a certified copy of this Commission's Resolution
No. 889 approving the above entitled proposal and authorizing the
City of Lodi to conduct subsequent proceedings.
Upon successful completion of subsequent proceedings, your agency
must request that LAFCo execute and file a Certificate of
Completion and Statement of Boundary Change. .Such request must be
accompanied by six certified copies of your resolution ordering the
boundary change and a check payable to the State Board of
Equalization covering its filing fee of Z 600.00.
When the filing is for a city boundary change, the city must also
provide three copies of a map with limiting street addresses and
three copies of a vicinity neap. When several streets have been
included, an alphabetical listing of streets and beginning and
ending street addresses is required.

BEFORE THE LOCAL AGENCY FORMATION COMMISSION OF SAN JOAQUIN
COUNTY APPROVING PROPOSED HELMLE REORGANIZATION (LAFC 18-93)
Including Annexation To The City Of Lodi And Detachment From The
Woodbridge Irrigation District. the Woodbridge Fire District. And
The San Joaquin County Resource Conservation District
WHEREAS, the above entitled proposal was initiated by
resolution of the City of Lodi, and on August 24, 1993, the
Executive Officer certified the application filed for processing in
accordance with the Local Government Reorganization Act; and,
WHEREAS. the Commission held a public hearing on the proposed
reorganization on September 24. 1993, in the Board of Supervisors
Chembera. County Courthouse, pursuant to notice of hearing which
was published, posted and mailed in accordance with State law; and.
WIIEREAS, at said hearing the Commission heard and received
evidence. both oral and documentary, submitted In favor of and in
opposition to the proposed reorganization and all persons present
were given and opportunity to be heard;
NOW THEREFORE, the Local Agency Formation Commission of San °t
Joaquin County DOES HEREBY RESOLVE, DETERMINE. AND ORDER ss
follows:
Section 1. The Negative Declaration adopted by the City of
Lodi as lead agency has been reviewed and considered.
Section 2. The above entitled reorganization is approved
subject to the following condition:
a) The City's resolution completing the reorganization
shall stats that the affected territory will remain
within the countywide boundary of County Service
Area No. 53, Household Hazardous Waste Management.
Section 3. The boundaries are hereby approved as submitted,
said boundaries being set forth in Exhibit A.
Section A. The affected territory is inhabited.
Section 5. The City of Lodi is designated as the
Conducting Authority and the City Council is authorized to initiate
proceedings for inhabited reorganization in accordance with Section
57000 at sen. of the Government Code.

Section S. The Executive Officer is hereby authorized and
directed to mail and file certified copies of this resolution as
required by Section 56853 of the government Code.

To THE CITY OF LODI
San Joaquin County, California
A portion of the south half of Sections 10 and 11, Township
3 North, Range 6 East, Mount Diablo Base and Meridian, more
particularly described as follows:
Beginning at a point on the north line of Ker_tleman Lane,
said point bears East, 1185.7 feet and North 0048'30" West, 25.00
feet from the southwest corner of the southeast quarter of said
Section 10, said point also being on the Lodi City Limit line;
thence along said City Limit line the following two (2) courses:
(1) North 0048'30" West, 943.J2 feet, and (2) North 89058'24"
West, 1224.58 feet to the west line of Lower Sacramento Road;
thence leaving said City Limit line, northerly along the west
line of said Lower Sacramento Road, 354 feet, more or less, to
intersection with the centerline of Taylor Road, said
intersection being on said City Limit line; thence along said
City Limit line the following three (3) cotxses. (1) easterly
along the centerline of Taylor Road, 40.00 feet to the centerline
of Lower Sacramento Road, (2) northerly along said centerline,

NOTICE IS HEREBY GIVEN that on Wednesday, at the hour of 7:00p.m., or as
soon thereafter as the matter may be heard, the City Council will conduct a
public hearing to consider the following matter:
a) Helmle Reorganization, including annexation to the City of Lodi
and detachment from certain districts as approved by the Local
Agency Formation Commission (bounded by the Woodbridge Irrigation
District Canal on the north and east, Kettleman Lane -State Route
12 -on the south and Lower Sacramento Road on the West)
Information regarding this item may be obtained in the office of the
Community Development Director at 221 West Pine Street, Lodi, California.
All interested persons are invited to present their views and comments on this
matter. Written statements may be filed with the City Clerk at any time prior
to the hearing scheduled herein, and oral statements may be made at said
hearing.
If you challenge the subject matter in court, you may be limited to raising only
those issues you or someone else raised at the Public Hearing described in
this notice or in written correspondence delivered to the City Clerk, 221 West

WHEREAS, the above -captioned proposals were initiated by the Lodi
City Council via Resolution 93-93, adopted August 4, 1993; and
WHEREAS, the Local Agency Formation Commission of the County of
San Joaquin adopted Resolution 890 on September 24, 1993 making
determinations and approving the proposed annexation to the City of
Lodi, described in Exhibit "A" attached hereto and by this reference
incorporated herein; and
WHEREAS, in compliance with the requirements of the Government
Code and the determination of the Local Agency Formation Commission,
the Clerk of the City of Lodi duly and properly gave notice of the

Pursuant to the Commission's Resolution No. 890, the Lodi City Council,
in action taken at its November 17, 1993 regular City Council Meeting,
adopted Resolution No. 93-144 ordering the Helmle Reorganization (LAFC
16-93) including annexation to the City of Lodi and detachment from the
Woodbridge Irrigation District, the Woodbridge Fire District, and the
SJC Resource Conservation District.
Mr. J. Jeffrey Kirst issued :-d filed herewith, pursuant to your
September 29, 1993 letter, a check in the amount of $600.00 payable to
the State Board of Equalization covering the filing fee.
Also, enclosed herewith please find six certified copies of the
heretofore mentioned Resolution No. 93-144.

ORDERING THE HELMLE REORG 1IZATION
INCLUDING ANNEXATION TO THE. CITY OF LODI AND
DETACHMENT FROM CERTAIN DISTRICTS AS APPROVED BY LAFCO
(BOUNDED BY THE WOODBRIDGE IRRIGATION CANAL ON THE NORTH AND EAST;
KETTLEMAN LAME .(STATE ROUTE 12) ON THE SOUTH
AND LOWER SACRAMENTO ROAD ON THE WEST)

WHEREAS, the above -captioned proposals were initiated by the Lodi
City Council via Resolution 93-93, adopted August 4, 1993; and
WHEREAS, the Local Agency Formation Commission of the County of
San Joaquin adopted Resolution 890 on September 24, 1993 making
determinations and approving the proposed annexation to the City of
Lodi, described in Exhibit "A" attached hereto and by this reference
incorporated herein; and
WHEREAS, in compliance with the requirements of the Government
Code and the determination of the Local Agency Formation Commission,
the Clerk of the City of Lodi duly and properly gave notice of the
required hearing to be held November 17, 1993, at the hour of 7:00 p.m.
or as soon thereafter as the matter may be heard in the Council
Chambers, 305 West Pine Street, Lodi, California; the affidavit of such
publication and certificate of posting and mailing are on file; and
WHEREAS, at the hearing of the Local Agency Formation
Commission's resolution making determinations was read allowed or
suamarized, all persons desiring to make oral or written protests or
objections were heard, and.testimony and evidence for and against the
proposed annexation were duly considered; and
WHEREAS, written protests filed and not withdrawn consist of less
than 25 percent of the registered voters or less than 25 percent of the
number of owners of land owning less than 25 percent of the assessed
value of land within the affected territory; now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LODI, AS
FOLLOWS:
1. The City Council hereby orders the territory described in Exhibit
"A" annexed and directs the City Clerk to transmit a certified
copy of this resolution with applicable fees required by Section
54902.5 of the Government Code to the Executive Officer of the
Local Agency Formation Commission of San Joaquin County.

2. The City Council further orders and declares that the territory
described herein be detached from the Woodbridge Irrigation
District, the Woodbridge Fire District and the San Joaquin County
Resource Conservation District, but the said territory remain in
the County Service Area No. 53, Household Hazardous Waste
Management.

A RESOLUTION OF THE LODI CITY COUNCIL
ORDERING THE HELMLE REORGANIZATION
INCLUDING ANNEXATION TO THE CITY OF LODI AND
DETACHMENT FROM CERTAIN DISTRICTS AS APPROVED BY LAFCO
(BOUNDED BY THE WOODBRIDGE IRRIGATION CANAL ON THE NORTH AND EAST;

WHEREAS, the above -captioned proposals were initiated by the Lodi
City Council via Resolution. 93-93, adopted August 4, 1993; and
WHEREAS, the Local Agency Formation Commission of the County of
San Joaquin adopted Resolution 890 on September 24, 1993 making
determinations and approving the proposed annexation to the City of
Lodi, described in Exhibit "A" attached hereto and by this reference
incorporated herein; and
WHEREAS, in compliance with the requirements,of the Government
Code and the determination of the Local Agency Formation Commission,
the Clerk of the City of Lodi duly and properly gave notice of the
required hearing to be held November 17, 1993, at the hour of 7:00 p.m.
or as soon thereafter as the matter may be heard in the Council
Chambers, 305 West Pine Street, Lodi, California; the affidavit of such
publication and certificate of posting and mailing are on file; and
WHEREAS, at the hearing of the Local Agency Formation
Commission's resolution making determinations was re?d allowed or
summarized, all persons desiring to make oral or writ, -en protests or
objections were heard, andtestimonyand evidence for and against the
proposed annexation were duly considered; and
WHEREAS, written protests filed and not withdrawn consist of less
than 25 percent of the registered voters or less than 25 percent of the
number of owners of land owning less than 25 percent of the assessed
value of land within the affected territory; now therefore,
BE IT RESOLVED by THE CITY COUNCIL OF THE CITY OF LODI, AS
FOLLOWS:
1. The City Council hereby orders the territory described in Exhibit
"A" annexed and directs the City Clerk to transmit a certified
copy of this resolution with applicable fees required by Section
54902.5 of the Government Code to the Executive Officer of the
Local Agency Formation Commission of San Joaquin County.

2. The City Council further orders and declares that the territory
described herein be detached from the Woodbridge irrigation
District, the Woodbridge Fire District and the Sar: Joaquin County
Resource Conservation District, but the said territory remain in
the County Service Area No. 53, Household Hazardous Waste
Management.

RELMLE ANNEXATION
TO THE CITY OF LODI
San Joaquin County, California
A portion of the south half of Sections 10 and 11, Township
3 North, Range 6 East. Mount Diablo Base and Meridian, more
particularly described as follows:
Beginning at a point on the north line.of Kettleman Lane,
said point bears East, 1185.7 feet and North 0048130" West, 25.00
feet from the southwest corner of the southeast quarter of said
Section 10, said point also being on the Lodi City Limit line
thence along said City Limit line the following two (2) courses:
(1) North 0048130" West, 943.32 feet, and (2) North 890581240
West, 1224.58 feet to the west line of Lower Sacramento Road;
thence leaving said City Limit line, northerly along the gest
line of said Lower -Sacramento Road. 354 feet, more or less, to
intersection with the centerline of Taylor Road, said
intersection being on said City Limit line; thence along said
City Limit line the following three (3) courses: (1) easterly
along the centerline of Taylor Road. 40.00 feet to the centerline
of Lower Sacramento Road, (2) northerly along said centerline,
0.71 feet to the north line of the south half of the southeast
quarter of said Section 10,•and (3) easterly along -said north
line, 2642.18 feet to the northwest corner of the south half of
the southwest quarter of said Section 11, being in the centerline
of the Woodbridge Irrigation District Canal's 100 -foot wide
right-of-way; thence continue along said City Limit line and run
along said Canal's centerline, the following two (2) courses:
(1) easterly along the north line of the south halms of the
southwest quarter of said Section 11, a distance of 1858.84 feet
and (2) southerly, 1295 feet, more or less, to aforesaid north
line of Kettleman Lane; thence westerly along said north line,
being along said City Limit line, 3304 feet to the point of
beginning.
Containing 108 acres, more or less.
