HomeMy WebLinkAboutAgenda Report - November 17, 1993 PH (4)4`4r Oi CITY OF LODI COUNCIL COMMUNICATION AGENDA TITLE: Public Hearing to Consider Helmle Reorganization, Including Annexation to the City of Lodi and Detachment from Certain Districts as Approved by the Local Agency Formation Commission (Bounded by the Woodbridge Irrigation District Canal on the North and East; Kettleman Lane (State Route 12) on the South and Lower Sacramento Road on the West MEETING DATE: November 17, 1993 PREPARED BY: Community Development Director RECOMMENDED ACTION: That the City Council conduct a public hearing to consider Helmle Reorganization, including annexation to the City of Lodi and detachment from certain districts as approved by the Local Agency Formation Commission (Bounded by the Woodbridge Irrigation District Canal on the North and East; Kettleman Lane (State Route 12) on the South and Lower Sacramento Road on the West. BACKGROUND INFORMATION: The Helmle Reorganization consists of 22 parcels and contains 108 acres. Owners of 16 of the 22 parcels (i.e. 73%) have filed written requests for annexation to the City. No one has thus far filed a protest. Since it was not 100% owner request for annexation, the Local Agency Formation Commission could not waive hearing and notice. At its meeting of July 7, 1993, the City Council adopted Ordinance No. 1579 prezoning the area encompassed by the Helmle Reorganization. The prezoning consists of a 300 -foot strip of R -C -P, Residential -Commercial-Professional, zoning along the Kettleman Lane frontage; R-1, Single Family Residential, adjacent to the Sunwest Subdivision; and R-2, Single Family Residential, on the remaining area. The City Council adopted Resolution 93-93 initiating the annexation/reorganization proceedings at its meeting of August 4, 1993. The Local Agency Formation Commission approved the reorganization on September 24, 1593, with t:,e condition that the approval be subject to the following: "The City's resolution completing the reorganization shall state that the affected territory will remain within the countywide boundary of County Service Area No. 53, Household Hazardous Waste Management." Upon successful completion of subsequent proceedings, your agency must request that LAFCo execute and file a Certificate of Completion and Statement of Boundary Change. .Such request must be accompanied by six certified copies of your resolution ordering the boundary change and a check payable to the State Board of Equalization covering its filing fee of Z 600.00. When the filing is for a city boundary change, the city must also provide three copies of a map with limiting street addresses and three copies of a vicinity neap. Schroeder RESOLUTION NO. 890 BEFORE THE LOCAL AGENCY FORMATION COMMISSION OF SAN JOAQUIN COUNTY APPROVING PROPOSED HELMLE REORGANIZATION (LAFC 18-93) Including Annexation To The City Of Lodi And Detachment From The Woodbridge Irrigation District. the Woodbridge Fire District. And The San Joaquin County Resource Conservation District WHEREAS, the above entitled proposal was initiated by resolution of the City of Lodi, and on August 24, 1993, the Executive Officer certified the application filed for processing in accordance with the Local Government Reorganization Act; and, WHEREAS. the Commission held a public hearing on the proposed reorganization on September 24. 1993, in the Board of Supervisors Chembera. County Courthouse, pursuant to notice of hearing which was published, posted and mailed in accordance with State law; and. WIIEREAS, at said hearing the Commission heard and received evidence. both oral and documentary, submitted In favor of and in opposition to the proposed reorganization and all persons present were given and opportunity to be heard; NOW THEREFORE, the Local Agency Formation Commission of San °t Joaquin County DOES HEREBY RESOLVE, DETERMINE. AND ORDER ss follows: Section 1. The Negative Declaration adopted by the City of Lodi as lead agency has been reviewed and considered. Section 2. The above entitled reorganization is approved subject to the following condition: a) The City's resolution completing the reorganization shall stats that the affected territory will remain within the countywide boundary of County Service Area No. 53, Household Hazardous Waste Management. Section 3. The boundaries are hereby approved as submitted, said boundaries being set forth in Exhibit A. Section A. The affected territory is inhabited. Section 5. The City of Lodi is designated as the Conducting Authority and the City Council is authorized to initiate proceedings for inhabited reorganization in accordance with Section 57000 at sen. of the Government Code. The City Council hereby orders the territory described in Exhibit "A" annexed and directs the City Clerk to transmit a certified copy of this resolution with applicable fees required by Section 54902.5 of the Government Code to the Executive Officer of the Local Agency Formation Commission of San Joaquin County. -1- 3' r 2.
