LODI COUNCIL COMMUNICATION AGENDA TITLE: Public Hearing to Consider Transportation Permit Fees in Conformance with California Vehicle Code, §35795(b). MEETING DATE: August 4, 1993 PREPARED BY: Public Works Director RECOMMENDED ACTION: That the City Council consider adopting a Resolution adopting the Caltrans foe schedule for transportation permits in conformance with Lodi Municipal Code § 10.52.040 and California Vehicle Code, §35795(b). BACKGROUND INFORMATION: The California Vehicle Code (CVC Division 15) limits truck width, length, height and weight on all roads in the State. Caltrans and local agencies are allowed to issue permits for loads in excess of these limi:. (CVC §35780 - Exhibit A). The Lodi Municipal Code (LMC) delegates this authority to the Public Works Director (§ 10.52.040 - Exhibit B). These permits arc presently issued free of charge. The Development Services Section of the Engineering Division has been issuing transportation permits for several years. Originally, City encroachment permit forms were modified to cover the extralegal loads. In 1989, Assembly Bill 1849, regarding the issuance of extralegal transportation permits, Has enacted and placed it. the CVC, Division 15, §35781. The law, which became effective January 1, 1990, and operatic-- July 1, 1990, directed Caltrans to develop a standard transportation permit application form. Caltrans accomplished this task and held workshops to acquaint local agency staff with the new form and permit requirements. City staff responsible for transportation permit issuance attended the workshop held in Stockton and have been using the -standard form since that time. A copy of a completed permit is attached for reference (Exhibit Q. This uniform State regulation has led to the growth of private "permitting services" which obtain permits for the truckers along their planned routes. Assembly Bill 1849 also contained CVC Section 35795(b) (Exhibit D) which states in part that local authorities may charge a fee for the issuance of transportation permits and that the fee shall not exceed the fee schedule developed by the Department of Transportation for similar permits issued by Caltrans. §1411.3(a), Title 21, Chapter 2, Subchapter 7 of the California Code of Regulations (formerly California Administrative Code) sets forth the fees which may be charged for issuing transportation permits. The initial fees in 1990 were S 15 and S70 for the issuance of single -trip permits and annual permits, respectively. Current fees arc S 16 and $90. Caltrans is permitted to charge additional fees if a requested route requires special investigation, such as a very heavy load over a bridge needing an engineering analysis (Exhibit E). August 4, 1993 Page 2 In the past, the issuance of these permits did not create a significant impact on staff workload. From 1989 through 1992, the number of transportation permits issued ranged between 10 and 25 per calendar year. Between January 1 and July 27, 1993, however, staff has received requests for 154 transportation permits (67 from just one local trucking firm) and we anticipate that this trend will continue. The reasons for the enormous increase in permit requests are twofold: 1) A heavy equipment auction was held at the former C. C. Wood Co. yard on Lockeford Street in May and June. Approximately 150 pieces of construction equipment were involved; the majority requiring transportation permits from the City prior to transport to and frau the site. Staff estimates that roughly one- third of these units were properly permitted for transport from the site; no transportation permits were obtained for delivery of any equipment to the site. While this auction was theoretically a one-time event, we were informed by several permit applicants that serious consideration was being given to regularly scheduling these types of activities in Lodi due to our convenient, centralized geographic location. 2) The Lodi Police Department (LPD) has undertaken a program to actively enforce permit requirements for extralegal loads traversing City streets. The fines for moving these loads without a permit are substantial and notification of the necessity for permits in Lodi and the increased enforcement activity has spread quickly through the trucking community. in addition, Caltrans regularly routes some overheight loads along Lodi City streets due to height limitations on Highway 99 at the Pine Street overcrossing and on Highway 12 (Kettleman Lane) at the Southern Pacific Railroad overcrossing. The transporters are advised by Caltrans that City permits are required for these rerouted loads. Staff time involved in the permit issuance process averages about 30 minutes per permit. This involves obtaining copies of the Caltrans permits, reviewing routing through Lodi, physically filling out the permit and providing copies of the permit to LPD. The cost to the Public Works Department for issuing these permits is approximately S 18 per permit using the fidl overhead recovery rates. Thus, the Caltrans rates are reasonable for our use. Permits issued between January 1 and July 27, 1993, would have generated revenues totaling $8600 if fees were in place. Several applicants have expressed surprise that the City has no fee for these permits. They consider it a cost of doing business and regularly pay fees in other communities. One local firm, however, felt there should be no fee for routine local runs. Staff currently follows the procedure used by Caltrans for issuing transportation permits. The applicant or their permitting service must pick up the permits in person at City Hall so that the original permit with a "wet" signature can be carried in the cab of the transporter. LPD officers can then verify the legality of the load should they stop the transporter on City streets. We have received some complaints because the City does not FAX permits; Caltrans also refuses to FAX permits. Caltrans has, however, approved a number of permitting services and trucking firms which may act as "receiving stations" if local agencies agree to FAX permits. The permits arc imprinted with an approved seal at the receiving station and the transporters may pick them up there. August 4, 1993 Page 3 permit foes due the local agencies and remit these fees on a monthly basis depending on their arrangement with the individual local agency. There is no public receiving station in Lodi; however, there are permitting services in Stockton which act as public receiving stations. We have had several conversations with Caltrans permit personnel, permit applicants and local trucking firms to try to fund ways to minimize the staff time involved without creating undue inconvenience to permit applicants. in an effort to reconcile currant City budget constraints, the ever-increasing amount of staff time involved in the issuance of transportation permits, and the need to provide prompt and convenient service to the trucking community, staff has considered sonic alternative permit issuance procedures which include the implementation of the permit foes allowed by State law. In the course of developing the altcrrmatives, staff conversations with other local agencies is.,- wing transportation permits indicate that there arc a variety of ways to handle the permitting process. most of which generally follow the procedures described below. Transyortation Permit Issuance Procedure Alternatives 1) Phonc-In Approval This procedure would allow the transporter or their permitting service to obtain permit approval over the phone. Staff would obtain all the permit information, establish the permitted route, fill out the permit form, assign a permit number and provide a copy of the permit to LPD. The transporter would be required d to provide the permit number to LPD officers if stopped for permit verification. This procedure does not strictly comply with §35783 of the CVC which requires that the permit be carried in the vehicle to which it refers. The same amount of staff time would be required as for the procedure currently in use, but the transporters would not have to appear in person at City Hall to pick up their permit. It would also necessitate the implementation of some type of permit billing mechanism, if fees are to charged for the permits, since there would be no way to collect fees at permit issuance. The billing process would, of course, require additional staff tam from Development Services and Finance Department staff. 2) Modified Caltrans Procedure Staff would maintain a map showing routine, approved routes over which certain load confmgumt"tons could receive quick permit approval over the counter. For regular, repeated trips, annual permits would be issued for extra length, extra height and some extra width (under twelve feet) loads. We would accept FAX applications and with suitable billing arrangements, we would FAX completed permits to approved receiving stations. Fees for those permits issued at City Hall could be collected at the time of permit issuance. 3) Caltrans Procedure This is the procedure currentlJ in use. As stated above, the transporter or permitting service is required to appear in person to sign and obtain the required transportation permit. Permit foes could be collected at permit issuance with minimal additional work for the Finance Department. Permits and Agreements Permits for Variances 35780. (a) The Department of Transportation or local authorities, with respect to highways under their respective jurisdictions, may, at their discretion upon application and if good cause appears, issue a spacial permit authorizing the applicant: (1) To operate or move a vehicle or combination of vehicles or special mobile equipment of a size or weight of vehicle or loud exceeding the maximum specified in this code. ( ) (2) To use corrugations on the periphery of the movable tracks on a traction engine or tractor, the propulsive power of which is not exerted through wheels resting upon the roadway but by means of a flexible band or chain. (3) Under emergency conditions, to operate or move a type of vehicle otherwise prohibited hereunder, upon any highway under the jurisdiction of the party granting the permit and for the maintenance of which the party is responsible. (4) To operate or move a vehicle or combination of vehicles ti ansporting loads composed of logs only for the purpose of crossing a highway from one private property to another without complying with any or all of the equipment requirements of Division 12 (commencing with Section 24000) and Division 13 (commencing with Section 29000). These crossings shall be as near to a right angle to the roadway as is practical and shall not include any travel parallel to the roadway. The Department of Transportation shall determine standards and conditions upon which permits shall be issued and any permit not in compliance with those standards and conditions shall be invalid, except that a permit may contain more restrictive conditions if the issuing authority deems it appropriate (b) Under conditions prescribed by the Department of Transportation or the local authority, the Department of Transportation or local authority may accept applications made by, and issue permits directly to, an applicant or permit service by any of the following processes: (1) In writing. (2) By an authorized facsimile process. (3) Through an authorized computer and modem connection. Application fa Perr iit 35781. The Department of Transportation shall develop a standard application form for a permit. The application for a permit shell specifically describe the vehicle and load to be operated or moved and the particular highways over which permit to operate is requested, and whether the permit is requested for a single trip or for continuous operation. Local authorities shall use the standard application form developed by the Department of Transportation. The standard application forts shall be developed in consultation with representatives of local government and the commercial trucking industry. Exhibit Issuance, Withholding, or Restricting Permit 35782. The Department of Transportation or a local authority may issue or withhold the permit at its discretion, or, if the permit is issued, do any of the following when necessary to protect against injury to the road, foundations, surfaces, or structures: (1) Limit the number of trips. (2) Establish seasonal or other time limitations within which the vehicle or vehicles described may be operated on the highways indicated. Otherwise limit or prescribe conditions of operation of the vehicle. (b) The Department of Transportation or a local authority may not requir,: the posting, of a bond as a condition of the issuance of a permit, except that a requirement of extra insurance or other financial security may be imposed as a condition for a permit for unusually large or heavy loads which pose a substantial risk to public facilities. (c) Except as provided in subdivision (b), the Department of Transportation or a local authority may not require proof of financial responsibility in an amount greater than that required for compliance with Section 16500.5 as a condition of the permit, and shall accept evidence of financial responsibility which complies with Section 16028. Possession of Permit 35783. Every permit shall be carried in the vehicle or combination of vehicles to which it refers and shall be open to inspection of any peace officer, traffic officer, authorized agent of the Department of Transportation, or any other oMcer or employee charged with the care or protection or such highways. 1052.010 Vehicle weight limits in city streets. A. Whenever the traffic resolution of the city designates and describes any street. portion thereof as a street or particular highway. the use of which is prohibited by certain vehicles, any commercial vehicle and/or by any vehicles exceeding a maxi- mum gross weight as is therein specified. the public works director shall erect and maintain appropriate signs on those streets affected. B. No vehicle weight limit or restriction shall be established under this section with- out a public hearing. (Vehicle Code Section 21101.) Whencverthe traffic resolution of the city designates and describes any street or portion thereof as a street, the use of which is permitted by vehicles within the length limitations described in Section 354015 of the Vehicle Code. the public works director is authorized to designate such street by appropriate signs as a route for the move- ment of such vehicles. B. When signs are erected giving notice thereof. streets or portions of streets are declared to be routes for the movement of vehicles within the maximum Lengths al- lowed by Section 35401.5 of the Vehicle Code. (Vehicle Code § 35401.5) (Ord. 1410 § I (part), 1987) Exhibit BI I 1052.030 Route restrictions. A. When any commercial vehicle and/or maximum gross weight limit restrictions are established and designated by appropriate signs. the operator of any vehicle not in compliance with the specified restrictions shall not drive on such street except as otherwise provided by city ordinance or in the Vehicle Code. (Vehicle Code § 21101) B. Nothing in the ordinance codified in this title shall prohibit any vehicle exceed- ing the limits established under this chapter coming from an unrestricted street having ingress and egress by direct route to and from a restricted street when necessary for the purpose of making pickups or deliveries of goods. wares and merchandise from or to any building or structure located on such restricted streets or for the purpose of deliv- ering materials to be used in the actual and bona fide repair, alteration. remodeling or construction of any building or structure upon such restricted streets for which a building permit has previously been ob- tained therefor. (Vehicle Code §§ 35703. 35704) C. When any truck length route is estab- lished under this chapter and designated by appropriate signs, the operator of any vehi- cle not in compliance with the specified limits shall drive on such routes and none other except as otherwise provided by city ordinance or in the Vehicle Code. Tbc public works director may issue permits in accordance with the applicable provisions of the Vehicle Code for the operation of vehicles exceeding the weight/ length limitations imposed by this chapter and the Vehicle Code. (a) The Department'of Transportation may charge a fee for the issuance of permits pursuant to this article. The fee schedule established by the Department of Transportation pursuant to this section shall be established by a regulation adopted pursuant to Chapter 4.5 (commencing with Section 11371) of Part 1 of Division 3 of Title 2 of the Government Code, and shall not produce a total estimated revenue in excess of the estimated total cost to that department for administering this article. Special services necessitated by miusually large or heavy loads requiring engineering investigations, or other mrvices. may be billed separately for each permit. The funds collected by the Department of Transportatio-i pursuant to this section shall be deposited in the State Highway Accoun . in the State Transportation Fund. (b) Local authorities maydwge a fee for the issuance of permits pursuant to this article . However. the fee schedule established by a local authority pursuant to this section shall be estaNished by ordinance or resolution adopted atter notice and hearing, and the fee shall not exceed the fee schedule developed by the Department of Transportation pursuant to subdivision (a). The fee for the issuance of permits shall be developed in consultation with representatives of local government and the commercial trucldng industry. Notice of the hearing shall be by publication as provided in Section 6064 of the Government Code. The hearing shall be held before the legislative body of the local authority. All objections shall be considered and interested parties shall be afforded an adequate opportunity to be heard in respect to their objections. Special services necessitated by unusually large or heavy loads requiring engineering investigations, escorts, tree trimming, or other services shall be billed separately for each permit. This law became effective January 1, 1990 and operative July 1, 1990. It required the Department of Transportation (Caltrans) to develop a standard application form for a permit. The transportation - permit form (copy attached) was developed in accordance with Section 35781 of the CVC and was presented throughout the State in a series of meetings with Caltrans representatives and representatives from numerous' -cities and counties. In addition to the meetings, the form was forwarded by mail to all cities and counties in California. Section 35781 reads in part, "Local authorities shall use the standard application form developed by the Department of Transportation." Caltrans has received numerous complaints from .Lndustry as well as from the law enforcement agencies that not all local agencies are using the form developed. We ask that you please review the attached standard application form and confirm that it is the application in use by your agency. Also contained in Assembly Bill 1849 (1989) is CVC, Section 35795(b) which states in part, "local authorities may charge a fee for the issuance of permits"; "and the fee shall not exceed the fee schedule developed by the Department of Transportation. It This is to notify you that Section 11411.3(a), Title 21, Chapter 2, Subchapter 7 of the California Administrative Code has been amended to increase the fees for issuing transportation permits. The fees for single trip permit and rider issuance have been increased from $15.00 to $16.00. The fees for the issuance of annual permits have been increased from $85.00 to $90.00. These fees, by law, are the maximum charge permitted except that "special services necessitated by unusually large or heavy loads requiring engineering investigations, or other services, may be billed separately for each permit." Again, we wish to reiterate that Caltrans has received many complaints that some local authorities are charging much more than the fees specified in the California Administrative Code. ` Exhibit E 1 Section 35780(a) of the California Vehicle Code states that "The Department. of Transportation or local authorities, with respect to highways tinder their respective jurisdictions, may, at their discretion upon application and if good cause appears, issue a special permit" etc. Caltrans -is occasionally advised that there are transportation permits being issued by local authorities authorizing the use of State highway structures and facilities. Unless there is an agreement (Delegation of Authority) between the State of California and the local authority, these permits should not be issued. If you wish to pursue the authority, by agreement, you should contact the local Caltrans Permit Engineer for your .area. If you would like your personnel trained regarding Caltrans policy, please contact Mr. Fred Hight, (916) 654-6677.
