AGENDA TITLE: Set a Public Hearing to consider Planning Commission's recommendation to
approve the following requests of Terry Piazza, Baumbach and Piazza, Inc. on
behalf of River Pointe Partners, (1) for a General Plan amendment to redesignate
the parcels at 1 and 11 West Turner Road (APN 041-250-10 and 26) from H1,
Heavy Industrial to LDR, Low Density Residential; (2) to rezone the parcels at I
and 1 I West Turner Road (APN's 041-250-10 and 26) from M-2, Heavy
Industrial to P -D, Planned Development District, and (3) to certify the River
Pointe Environmental Impact Report as adequate environmental documentation
MEETING DATE: August 17, 1994

RECOMMENDED ACTION: The City Council set a Public Hearing for 7:00 p.m., Wednesday,
September 21, 1994 to consider Planning Commission's
recommendation to approve the following request of Terry Piazza,
Baumbach and Piazza, Inc. on behalf of River Pointe Partners:
1. for a General Plan Amendment to redesignated the parcels at 1 and l 1 West Turner Road (APN 041-
250-10 and 26) from HI, Heavy Industrial, to I.DR, Low Density Residential;
2. to rezone the parcels at 1 and 11 West Turner Road (APN's 041-250-10 and 26) from M-2, Heavy
Industrial, to P -D, Planned Development District; and;
3. to recommend certification of the River Pointe Environmental Impact Report as adequate
environmental documentation.

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that on Wednesday, October 5, 1994 at the hour of
7:00 p.m., or as soon thereafter as the matter may be heard, the City Council will conduct
a Public Hearing to consider the following matter.
a) The Planning Commission's recommendation to approve the following
requests of Terry Piazza, Baumbach & Piazza, Inc. on behalf of River
Pointe Partners:
1) for a General Plan amendment to redesignate the parcels
at 1 and 11 West Turner Road (APN 041-250-10 and 26) from
Hl, Heavy Industrial, to LDR, Low Density Residential;
2) to rezone the parcels at 1 and 11 West Turner Road (APN's 041-
250-10 and 26) from M-2, Heavy Industrial, to P -D, Planned
Development District; and
3) to certify the River Pointe Environmental Impact Report as
adequate environmental documentation
Information regarding this item may be obtained in the office of the Community
Development Director at 221 West Pine Street, Lodi, California. All interested persons
are invited to present their views and comments on this matter. Written statements may
be filed with the City Clerk at any time prior to the hearing scheduled herein, and oral
statements may be made at said hearing.
If you challenge the subject matter in court, you may be limited to raising only those
issues you or someone else raised at the Public Hearing described in this notice or in
written correspondence delivered to the City Clerk, 221 West Pine Street, at or prior to the
Public Hearing.

At its meeting of Monday, August 8, 1994, the Lodi City Planning Commission reconunended that
the City Council take the following actions on your requests on behalf of River Pointe Partners:
1. Approve General Plan Amendment to redesignate the Parcels at I and 11 West Turner Road
(APN's 041-250-10 and 26) from HI, Heavy Industrial'to LDR, Low Density Residential;
2. Approve rezoning (2-91-22) the parcels at I and 11 West Turner Road (APN's 041-250-10 and
26) from M-2, Heavy industrial to R -i, Single -Family Residential; and
3. Certify the River Pointe final Environmental impact Report (EIR 92-1) as adequate
environmental documentation on the projects.
These rccommcndations have been forwarded to the City Council for final hearing action.
Ms. Jennifer Perrin, City Clerk, will inform you of the time and place of the City Council's public
hearing.

Much concern has been voiced by various entities over the impact our River Pointe project will have
on the riparian corridor along the south bank of the Mokelumne River. I would like to take this
opportunity to invite the members of the City Council and any Staff you may deem appropriate to join
me on a guided walk along the river at the north boundary of our project and across the river on the
east side of the Southern Pacific tracks. The purpose of this walk will be a first hand look at what is
planned and what steps we have taken to mitigate the loss of any riparian corridor. 1 will be happy to
answer all questions pertaining to these points.
Please call me at your earliest convenience to arrange a date and time for our tour.
