MEETING DATE: January 5, 1994 PREPARED BY: Community Development Director RECOMMENDED ACTION: that the City Council set Public Hearing for February 4, 1994 to consider the Sproul Reorganization, including annexation to the City of Lodi and detachment from certain districts as approved by the Local Agency Formation Commission located at 5435, 5479, 5535, 5567 5909 and 6161 East State Route 12 and 17282 North Guild Avenue. BACKGROUND INFORMATION: The Sproul Reorganization consists of 7 parcels and contains 40 acres. When the City Council initiated the reorganization it consisted of only the parcels located at 5909 and 6161 East State Route 12. After the Council acted, Mr. Gary Guthrie, owner of 17282 North Guild Avenue (northeast corner of State Route 12 and Guild Avenue), petitioned LAFCO for annexation to the City. The parcels at 5435, 5479, 5535 and 5567 East State Route 12 were added to the annexation by LAFCO. The Local Agency Formation Commission approved the reorganization consisting of all 7 parcels on December 17, 1993 with the following condition: "The City's Resolution completing the reorganization shall state that the affected territory will remain within the boundary of County Service Area No. 53, Household Hazardous Waste." Since this annexation did not have 100% owner consent LAFCO could not waive hearing and notice. No one protested at the time of the LAFCO hearing. FUNDING: Application fee. Ja es B. PETERSON Kr% c+os City Manager CGt CCC093.49,1TXTD.01C RESOLUTION NO. 895 BEFORE THE CAL AGENCY FORMATION COMMISSION OF SAN JOAQUIN COUNTY APPROVING PROPOSED SPROUL REORGANIZATION (LAFC 20-93) Including Annexation To The City Of Lodi and Detachment From The Mokelumne Fire District And The SJC Resource Conservation District WHEREAS, the above entitled proposal was initiated by resolution of the City of Lodi, and on October 18, 1993, the Executive Officer certified the application filed for processing in accordance with the Local Government Reorganization Act; and, WHEREAS, the Commission held a public hearing on the proposed reorganization on December 17, 1993, in the Board of Supervisors Chambers, County Courthouse, pursuant to notice of hearing which was published, posted and mailed in accordance with State law; and WHEREAS, at said hearing the Commission heard and received evidence, both oral and documentary, submitted in favor of and in opposition to the proposed reorganization and all persons present were given an opportunity to be heard; NOW THEREFORE, THE Local Agency Formation Commission of San Joaquir County DOES HEREBY RESOLVE, DETERMINE, AND ORDER as follows: Section 1. The Negative Declaration adopted by the City of Lodi as lead agency has been reviewed and considered. Section 2. The above entitled reorganization is approved subject to the following condition: a) The City's resolution completing the reorganization shall state that the affected territory will remain within the countywide boundary of County Service Area No. 53, Household Hazardous Waste Management. 10,11 1-51".1111 RESOLUTION 895 PAGE 2 Section 3. The boundaries are hereby amended to include the four parcels located west of Guild Avenue, said boundaries being set forth in Exhibit A. Section 4. The affected territory is uninhabited. Section 5. The City of Lodi is designated as the Conducting Authority and the City Council is authorized to initiate proceedings for uninhabited reorganization in accordance with Section 57000 et seq. of the Government Code. Section 6. The Executive Officer is hereby authorized and directed to mail and file certified copies of this resolution as required by Section 56853 of the Government Code. BARBER, H R N Local Agency Formation Commission of San Joaquin County EXHIBIT A October 22, 1993 DESCRIPTION OF PROPOSED SPROUL ANNEXATION TO THE CITY OF LODI San Joaquin County, California A portion of the northeast quarter of Section 6, and the northwest quarter of Section 5, Township 3 North, Range 7 East, Mount Diablo Base and Meridian, more particularly described as follows: Beginning at the intersection of the north line of State Highway 12 with the east line of said Section 6, said intersection being on the Lodi City Limit line; thence South 1006100" East along said City Limit line, 80.47 feet to the south line of State Highway 12; thence leaving said City Limit line, easterly along said south line of State Highway 12, a distance of 535 feet, more or less, to intersection with the southerly production of the east line of Parcel "A° of Parcel Map filed in Book 11 of Parcel Maps at page 73, San Joaquin County Records; thence North 0°15' West along said southerly production and the east line of said Parcel "A", 761 feet, more or less, to the northeast corner thereof; thence North 89005' West along the north line of said Parcel "A" and its westerly production, 535.2 feet to intersection with said east line of Section 6; thence southerly along said east line, 195.17 feet to the northeast corner of that certain tract of land deeded to John Taylor Fertilizers Co., Recorded as Instrument No. 82030372, Official Records of San Joaquin County; thence North 88046' West along the north line of said Fertilizers Co. land, 885.4 feet to the northwest corner thereof, being the northeast corner of that certain tract of land deeded to Gary V.
