MEETING DATE: May 3, 1995 PREPARED BY: Community Development Director RECOMMENDED ACTION: that the City Council conduct a public hearing to consider the Planning Commission's recommendation that the City Council amend Chapter 17.60 of theLodi Municipal Code by adding a new section thereto relating to parking in front and side yard Setbacks. BACKGROUND INFORMATION: Code Enforcement Officer Leland Schmiedt indicated to the City Attorney's office that he needed a tool to keep people from parking in landscaped areas in street and street side yard areas. He indicated that this was a problem that the "Ugly" Ordinance did not address, and that it was a major problem, especially in the eastside residential areas. The City Attorney's office prepared the amendment which was the subject of a Planning Commission public hearing on March 13, 1995. At that time the Commission returned the proposal to the City Attorney for changes. Specifically, the Planning Commission wanted to restrict the amount of yard area that could be paved. The ordinance has been changed to accommodate the request and limits the paved area to 45% of a street or street side yard. The Planning Commission recommended the amendment to the City Council at its meeting of March 27, 1995. FUNDING: None required. JBS/ck Enclosures. r110 J mes B. Perrin City Clerk Telephone: (209) 333-6702 NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN that on Wednesday, May 3, 1995 at the hour of 7:00 p.m., or as soon thereafter as the matter may be heard, the City Council will conduct a Public Hearing to consider the following matter: a) Discuss Amending Lodi Municipal Code Chapter 17.60 Adding a New Section Relating to Parking in Front and Side Yard Setbacks Information regarding this item may be obtained in the office of the Community Development Director at 221 West Pine Street, Lodi, California. All interested persons are invited to present their views and comments on this matter. Written statements may be filed with the City Clerk at any time prior to the hearing scheduled herein, and oral statements may be made at said hearing. McNatt City Attorney JACITYCLRKIFORMSINOTCDD DOC 4/5/95 ORDINANCE NO. 1617 ------------------ ------------------ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LODI AMENDING CHAPTER 17.60 OF THE LODI MUNICIPAL CODE BY ADDING A NEW SECTION THERETO RELATING TO PARKING IN FRONT OR SIDE YARD SETBACKS BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LODI AS FOLLOWS: SECTION 1. Chapter 17.60 - Stopping, Standing and Parking - is hereby amended by adding thereto a new Section 17.60.160 relating to Parking in Front or Side Yards Setbacks, to read as follows: A. No person shall stop, stand or park, or allow the stopping, standing or parking of any vehicle as defined by the California Vehicle Code, or any boat whether trailer mounted or not, in any front or side yard setback required on any property zoned R-1, R-2, R -CP, R -LD, R-GA,R-MD or R -HD by Title 17 of this code, except on a permanent driveway or parking pad of a minimum 2 inches of asphalt concrete, or similar material over a compacted subgrade or equivalent. B_ No person shall install or place asphalt concrete or other similar material upon more than forty-five percent of any front or street side yard setback required on any property zoned R-1, R-2, R -CP, R -LD, R -G -A, R -MD or R -HD by Title 17 of this code. C. Notwithstanding Paragraph "A" above, parking of vehicles. or boats in such front yard or side yard setbacks shall -1- not be prohibited if: 1. The setback area in which the vehicle or boat is parked is completely enclosed by an opaque fence not less than seven (7) feet in height; and 2. Such fence is otherwise in compliance with all applicable zoning provisions and standards of the City of Lodi. C. This section shall not apply to the parking of vehicles or boats in unpaved portions of front yard or side yard setbacks for the purpose of, and only for such time as is reasonably necessary to wash or clean such vehicle or boat. SECTION 2. All ordinances and parts of ordinances in conflict herewith are repealed insofar as such conflict may exist. SECTION 3. This ordinance shall be published one time in the "Lodi News Sentinel", a daily newspaper of general circulation printed and published in the City of Lodi and shall be in force and take effect thirty days from and after its passage and approval.
