AGENDA TITLE: Public Hearing regarding adoption of the San Joaquin County Integrated Solid Waste
Management Summary Plan and Countywide Siting Element.

RECOMMENDED ACTION: That City Council adopt a resolution approving the San Joaquin County
Integrated Solid Waste Management Summary Plan and Countywide Siting
Element.
BACKGROUND INFORMATION: AB939 requires replacement of existing County Solid Waste
Management Plans with an Integrated Waste Management Plan for
each county in California. This plan summarizes existing Source
Reduction and Recycling Elements (SRRE) and NonDisposal Facility
Elements (NDFE) for the incorporated and unincorporated areas of San Joaquin County. It also includes
a discussion of jurisdictions involved, agency roles, and a statement of goals, policies and objectives set
forth by the S.J. County Integrated Waste Management Task Force. The Plan provides a County profile
and discusses plan administration. This is followed by a description of current solid waste management
practices and a summary of each jurisdiction's SRRE, NDFE and Household Hazardous Waste Element.
AB939 also requires each County to prepare a Siting Element to verify S.J. County has at least 15 years
disposal capacity for all waste generated during that period. The Siting Element provides detailed
descriptions of disposal facilities that will be used for the next 15 years. The element verifies S.J. County
has more than enough existing disposal capacity for the planning period through 2010.
Public Resources Code 21000 requires environmental review of these documents. Both the Summary
Plan and Siting Element were reviewed in compliance with the California Environmental Quality Act.
Negative declarations were adopted for each by the Board of Supervisors.
The San Joaquin County Integrated Waste Management Task Force has reviewed this Integrated Solid
Waste Management Summary Plan and Countywide Siting Element and determined it meets their goals
and policies. California Code of Regulations, Section 18783 requires each City and the County to
conduct public hearings prior to adoption by resolution. This document must be approved by S.J. County
and a majority of the Cities within the County, representing a majority of the population of the
incorporated areas. Copies for public review have been placed in the City Clerks Office and City Library.

The San Joaquin County Integrated Waste Management Task Force has
reviewed and approved the "Final San Joaquin County Integrated
Waste Management Summary Plan and Siting Element" dated
April 1996, and recommends its adoption by the County and each of
the Cities within the County (see attached letter from George L.
Barber, Task Force Chair).
Assembly Bill 939 which created the Integrated Waste Management
Act of 1989 (ACT) required each City and each County (for its
unincorporated areas) to prepare and adopt a Source Reduction and
Recycling Element, Nondisposal Facility Siting Element, and
Household Hazardous Waste Element. Accordingly, San Joaquin
County and each of its Cities prepared and adopted the required
Elements. The ACT further requires each County to prepare a
Summary Plan which summarizes the Elements adopted by the Cities
and the County, and a Disposal Element which identifies disposal
facilities required by the Cities and the County for the period
of 1990 through 2010.
Working with the Task Force, the County prepared and presented
several working drafts to the Cities for review and comment. In
June and July 1995, preliminary drafts of the Siting Element and
Summary Plan were approved by the Task Force and circulated to
the Cities, local and State agencies, and throughout the County
for comment. Further, the Board of Supervisors conducted public
hearings to receive additional input (see attached). The
preliminary drafts were revised where appropriate, to incorporate
comments received during the extensive review period. A
California Environmental Quality Act review was performed on both
the Summary Plan and the Siting Element (see attached Negative
Declarations).

The ACT requires the County and each of its Cities to conduct
public hearings before considering adoption of the Final Summary
Plan and Siting Element. At least thirty days in advance of the
public hearings, the County and each of its Cities must publish
notices of the hearings in local newspapers of general
circulation (see attached California Code of Regulations). The
Final Summary Plan and Siting Element must be adopted by a
Resolution of the governing bodies of the County and the majority
of the Cities representing the majority of the population of the
incorporated areas within the County. Therefore, your City is
requested to notice and hold the required public hearing and
consider adoption of the Summary Plan and Siting_Element. County
Department of Public Works staff will be available on request, to
make a brief presentation or answer questions when your Council
considers this matter.
After adoption of the Summary Plan and Siting Element, please
forward a copy of the Resolution and proof of publication of
notice for the public hearing to Tom Horton, Department of Public
Works, Post Office Box 1810, Stockton, 95201.

Resolution are attached for your use. If you have any questions,

The Integrated Waste Management Task Force has reviewed the Final
San Joaquin County Integrated Waste Management Summary Plan and
siting Element and found them to be consistent with the goals and
policies established by the Task Force. on May 3, 1996, the Task
Force approved the Final San Joaquin County Integrated Waste
Management Summary Plan and Siting Element and recommended
adoption of the Summary Plan and Siting Element by the Cities and
the County of San Joaquin.
Prior to adoption of the Final Summary Plan and Siting Element,
by resolution, it is necessary that each jurisdiction hold a
public hearing with a 30 day notice.

RESOLUTION NO. 96-80
A RESOLUTION OF THE LODI CITY COUNCIL
ADOPTING THE INTEGRATED SOLID WASTE MANAGEMENT
SUMMARY PLAN AND COUNTYWIDE SITING ELEMENT FOR
THE COUNTY OF SAN JOAQUIN
WHEREAS, the Integrated Waste Management Act of 1989 (ACT) requires each
County for its unincorporated areas, and each City to prepare and adopt Source Reduction
and Recycling Elements, Nondisposal Facility Elements, and Household Hazardous
Waste Elements; and,
WHEREAS, the ACT requires each County to prepare and adopt a Countywide
Disposal Facility Siting Element (Siting Element) which identifies the facilities which
will be used by the County and Cities within the County, to dispose of waste during the
period of 1990 through 2010, and an Integrated Solid Waste Management Summary Plan
(Summary Plan) which summarizes the Elements prepared and adopted by the County
and the Cities within the County, and
WHEREAS, the County and each City within the County have prepared and
adopted individual Source Reduction and Recycling Elements, and Nondisposal Facility
Elements, and jointly prepared and adopted a Countywide Household Hazardous Waste
Element; and
WHEREAS, the County has prepared a Summary Plan and Siting Element in
accordance with the requirements of the ACT; and
WHEREAS, the County's Integrated Waste Management Task Force has
approved the Summary Plan and Siting Element and recommends its adoption by the
Cities and the County; and
WHEREAS, the ACT requires the County and each City to consider adoption of
the Summary Plan and Siting Element after conducting a Public Hearing with a published
thirty day notice; and
WHEREAS, a Public Hearing with a published thirty day notice has been held;
NOW, THEREFORE, BE IT RESOLVED that the City of Lodi hereby adopts the
Integrated Solid Waste Management Summary Plan and Countywide Siting Element
dated April 1996, for the County of San Joaquin.

following matter:
