AGENDA TITLE: Intention to Vacate the South 174 Feet of Sacramento Street
MEETING DATE: July 1, 1998

RECOMMENDED ACTION: That the City Council adopt the attached resolution of intention to
abandon the south 174 feet of Sacramento Street, as shown on
Exhibit A, refer the matter to the Planning Commission, and set it for
public hearing at the regular Council meeting of August 5, 1998.
BACKGROUND INFORMATION: As noted in the attached letters dated June 2 and 11, 1998,
(Exhibits B and C), Vanderlans & Sons, Inc. needs additional
space to expand their business. To obtain this additional space, the
company has requested that the City abandon the south 174 feet of
Sacramento Street. This is a cul-de-sac and is not needed for traffic other than access to the abutting
properties. There are three property owners that would be affected by the proposed abandonment:
Gerald Vanderlans, E. J. Ebel, and the City of Lodi. Mr. Vanderlans and Mr. Ebel have requested the
abandonment in the June 11 letter. The City of Lodi property is for a pump station and would not be
affected by the abandonment as long as access is permitted.
A permanent easement will be maintained to allow access to the City of Lodi pump station and to permit
construction, maintenance, repair, and operation of utilities, both publicly and privately owned. All
agencies and departments have been notified of the intention to vacate.

Dear Mr. Prima:
On May 1, 1998 you met with me, Eric Vanderlans, Tony Goehring, Rad Bartlam and
Wes Fujitonie. The purpose of this meeting was to go over requirements the city may
have for a plant expansion we hope to do as soon as possible.
I showed a drawing of our existing buildings and our proposed new buildings along with a
proposed parking layout. During this meeting it was determined that there was no place
for loading and unloading freight other than in the street. Typically this has been, and is
continuing to be, done all up and down a large portion of our street by other companies
who own property on both sides of south Sacramento street. We were told that the city
wants this to be no longer allowed on a public street.
Since we own property on both sides of the street, with the exception of one parcel, we
are proposing the idea of abandoning this portion of the street. The owner of that one
parcel is in agreement as well. This property is located on the end of a cul-de-sac and we
feel this could be done very easily. The City of Lodi has a pump station located on the
very end of this cul-de-sac and, of course, would have 24-hour access to this pump
station.
Therefore we are proposing to have this street abandoned as per city requirements, and we
need to know how td proceed in order to get this accomplished. At this point, with the
amount of growth we are experiencing, we are running out of room at our existing plant,
so time is a very important issue. Whatever can be done to facilitate this through the city
process in an expedited manner would be very much appreciated.

SUBJECT: Street Abandonment Request
Dear Mr. Prima:
As the owner of Vanderlans & Sons, Inc. and the property on which it is located, at the
end of the cul-de-sac on So. Sacramento street (addresses 1320, 1328, 1325 and 1345)
I am writing to formally request that this portion of the street be abandoned. These
properties are located on both sides of this street.
Granting of this request would allow us to do a much needed expansion of our facilities,
and would allow freight to be loaded and unloaded in the abandoned area of the street. If
this abandonment were to be refused we would not be able to proceed with our expansion
and still comply with city ordinances.
There is one other property owner who would be affected because his property is at the
end of the street, at 1339 So. Sacramento St., between my properties. Mr. Ebel is in favor
of this abandonment request, and his signature also appears below.
Also, the City of Lodi has a pump station located at the end of the street and we would
definitely be able to ensure the city would have 24-hour accessability to this station.

NOTICE IS HEREBY GIVEN that on Wednesday, August 5, 1998 at the hour of 7:00 p.m., or as soon

305 West Pine Street, Lodi, to consider the following matter:

Further, this matter was referred to the Planning Commission to be heard on July 22, 1998.

All interested persons are invited to present their views and comments on this matter. Written statements

Further, the City Council referred the matter to the Planning Commission for its recommendation
and set the matter for a Public Hearing before the Lodi City Council on August 5, 1998.
